IN THE CASE OF:
BOARD DATE: 18 September 2008
DOCKET NUMBER: AR20080010920
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, that his base pay be adjusted for the period 26 February 1982 through 4 July 1996 as a result of a Pay Entry Basic Date (PEBD) correction and that he be paid any monies due to him.
2. The applicant states, in effect, that his PEBD was recently corrected in the finance system to show 26 February 1982; however, the Defense Finance and Accounting Service (DFAS) only paid part of his claim (from 5 July 1996 due to his previous separation date). He states that DFAS will only pay him for the period 26 February 1982 to 4 July 1996 if directed by the Board.
3. The applicant provides DD Forms 827 (Application for Arrears in Pay), dated 29 June 2008 and 23 December 2007; a letter, dated 13 June 2008, from DFAS; a DFAS-DE Form 110 (Corrected Records Computation); and a payment worksheet.
CONSIDERATION OF EVIDENCE:
1. The applicant enlisted in the U.S. Army Reserve (USAR) on 26 February 1982. He was discharged from the USAR on 21 July 1984 to accept a commission. He was appointed a Reserve officer on 22 July 1984. He is currently serving as a lieutenant colonel in the USAR.
2. Records at the U.S. Army Human Resources Command, St. Louis, Missouri show the applicants PEBD was changed to 26 February 1982 in 2008.
3. The applicant provided a letter, dated 13 June 2008, from DFAS which states, in pertinent part, that since his previous date of separation from active duty was
4 July 1996, DFAS could not adjust his base pay for his PEBD correction. The letter stated that if the applicant was claiming base pay credit for the period
4 July 1996 and prior he needed to file for a correction of military records.
DISCUSSION AND CONCLUSIONS:
Evidence of record shows the applicants PEBD was corrected to show
26 February 1982. Therefore, the applicants base pay should be adjusted for the period 26 February 1982 through 4 July 1996 as a result of a PEBD correction and he should be paid any monies due to him.

The evidence of record shows the applicant entered ROTC in September 1983 and enlisted in the USAR (SMP) on 20 August 1984. It would be equitable to correct his records to show his PEBD was adjusted to 20 August 1984 prior to his retirement with all pay and allowances (by reason of earlier longevity increases), retroactive to 23 September 1996, due as a result of this correction. As a result, the Board recommends that all Department of the Army records of the individual concerned be...

Ronald D. Gant | |Member | The Board considered the following evidence: Exhibit A - Application for correction of military records. The evidence of record shows the applicant entered ROTC in September 1983 and enlisted in the USAR (SMP) on 20 August 1984. The applicant enlisted in the ARNG on 19 September 1985 for 8 years. The evidence of record shows the applicant never had a break in service (contrary to the applicants belief) from the time he enlisted in the ARNG on 19 September 1985 until he was transferred to the Retired Reserve in April 2007. The applicants records should be corrected to show he enlisted in the USAR effective 18 September 1999 for 3 years, that he never had a break in service, and that his PEBD is 19 September 1985.
ARMY | BCMR | CY2010 | 20100015586
He also provides his April 2010 LES which shows his PEBD (Pay Entry Basic date) as 3 February 1976 (the date he initially enlisted in the USAR) and that he was receiving pay based on 34 years of total service. Section 010101 (service which is creditable) states for most members who enter and serve on active duty without a break in service, the basic pay date is the date the member enters active or inactive service. d. Section 010103A(2) (Creditable Prior Enlisted Service) states...

The applicant states that in the early years of the SMP, the DA Form 4824-R was not required to be forwarded to the member's Military Personnel Records Jacket. Therefore, it appears the applicant meets the eligibility requirements to have her membership time in the SMP from 3 January 1980 through 29 July 1981 credited towards her PEBD. That all of the Department of the Army records related to this case be corrected by showing that the DA Form 4824-R prepared for the applicant on 4 January...

The applicant requests that he be granted service credit for his participation in the Simultaneous Membership Program (SMP) and that his pay entry basic date (PEBD) be adjusted accordingly. The applicant's NGB Form 22 confirms he was discharged from the PAARNG on 27 December 1987 and was credited with 1 year, 3 months, and 26 days of service in the SMP. The DODFMR, volume 7A, subparagraph 010101.B, states that for most members who enter and serve on active duty without a break in service,...

Therefore, he requests that his records be corrected to show his service in the SMP while serving in the United States Army Reserve Officer Training Corps (ROTC) and the United States Army National Guard. Evidence of record shows that the applicant enlisted in the USAR on 3 September 1980 but was not assigned as an ROTC cadet in MOS 09R20 until 1 December 1980. There is no evidence that the applicant performed any active duty service during the time he was granted SMP credit.

The applicant states: a. once commissioned, an officer's service in the SMP will count towards retirement and a higher rate of pay; b. he was a non-scholarship ROTC/SMP participant in the Arkansas Army National Guard (ARARNG) while enrolled in the University of Arkansas from 11 December 1982 to 10 May 1984; c. based on his ROTC service and participation in the SMP, he is entitled to 1 year and 5 months additional service credit, compensation for this service towards his retirement, and...
