THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that his separation document, DD Form 214, be corrected to add his Bronze Star Medal (BSM).

2.  The applicant states that his DD Form 214 does not reflect his BSM.

3.  The applicant provides General Orders Number 1605 dated 26 June 1969 which awards him the BSM for the period July 1968 to May 1969.

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, 





has determined it is in the interest of justice to excuse the applicant’s failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  The applicant’s military records could not be located.  However, alternative documents show that he was inducted and entered active duty on 8 August 1967.

3.  He was awarded the military occupational specialty of light weapons infantryman and was promoted to pay grade E-5.

4.  He was honorably released from active duty on 30 May 1969 to attend school.  His DD Form 214 shows that he was awarded the National Defense Service Medal, the Vietnam Service Medal, the Vietnam Campaign Medal, and the Good Conduct Medal.

5.  Department of the Army General Order Number 8, dated 1974, awarded all personnel assigned to the United States Army Vietnam from 8 February 1962 through 28 March 1973 the Republic of Vietnam Gallantry Cross with Palm Unit Citation.

DISCUSSION AND CONCLUSIONS:

1.  The applicant’s orders confirm that he was awarded the BSM.  It would now be appropriate to amend the applicant’s DD Form 214 to add this award.

2.  The applicant is also entitled to the Republic of Vietnam Gallantry Cross with Palm Unit Citation.
