THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests:
a. reconsideration of his denial for award of the Combat Infantryman Badge (CIB);
b. correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show award of the Aircraft Crewman Badge (now known as the Basic Aviation Badge); and
c. award of any other awards and decorations to which he is entitled, to include the Air Medal, the Vietnam Campaign Medal with Device (1960), the Vietnam Service Medal with 2 bronze service stars, the National Defense Service Medal, 2 Overseas Service Bars, and several unit citations (not named).
2. The applicant states, in effect, that his last duty station was in Alaska and he was sent to Fort Lewis, Washington, to process for discharge. He was separated on temporary records and all his awards and decorations were not annotated on his DD Form 214.
3. The applicant provides a copy of his DD Form 214; a copy of his DA Form 20 (Enlisted Qualification Record); and a copy of his Aircraft Crewman Badge orders.
CONSIDERATION OF EVIDENCE:
1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20050014793, on 22 June 2006. This decision denied the applicant award of the CIB, and granted him award of the Air Medal, the Vietnam Service Medal with 4 bronze service stars, the Republic of Vietnam Gallantry Cross with Palm Unit Citation, the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation, and the Expert Marksmanship Qualification Badge with Machinegun and Rifle Bars.
2. On 8 September 2006, the applicant was issued a DD Form 215 (Correction to DD Form 214) adding the Air Medal, the Vietnam Service Medal with 4 bronze service stars, the Republic of Vietnam Gallantry Cross with Palm Unit Citation, the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation, and the Expert Marksmanship Qualification Badge with Machinegun and Rifle Bars. As a result, these awards will not be discussed further in the Report of Proceedings.
3. The applicant's issue regarding award of the CIB will also not be discussed further in these proceedings. The applicant has not provided any new evidence which was not previously considered and discussed on 22 June 2006 during his initial application to this Board (AR20050014793). Additionally, his request for reconsideration for award of the CIB was received more that 1-year after this Boards original decision. Therefore, his next remedy concerning this issue is to appeal to a court of appropriate jurisdiction.
4. The applicant served in the Regular Army from 17 December 1968 through
19 August 1969. He served in the Republic of Vietnam (RVN) from 12 June 1969 through 31 August 1970. He performed duties as a rifleman with Company A, 4th Battalion, 12th Infantry until 6 September 1969, when he was assigned to the 213 Aviation Company for duty as a door gunner.
5. Special Orders Number 324, Department of the Army, Headquarters, 11th Aviation Battalion (Combat), dated 20 November 1969, awarded the applicant the Aircraft Crewman Badge. This award is not shown on his DD Form 214.
6. The applicant's DA Form 20 shows that he was awarded 2 Overseas Service Bars which are not shown on his DD Form 214.
7. A thorough review was made of Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register); however, the applicant's units of assignment were not cited for any unit awards during the applicant's tenure.
DISCUSSION AND CONCLUSIONS:
1. Special Orders awarded the applicant the Aircraft Crewman Badge, which is now known as the Basic Aviation Badge. Therefore, he is entitled to have his record corrected to show this award.
2. The applicant was awarded 2 Overseas Service Bars which are recorded on his DA Form 20. Therefore, he is entitled to have his record corrected to show these awards.
3. The applicants unit was not awarded any unit awards during the tenure of his assignment. Therefore, he is not entitled to any unit awarded to be added to his separation document.

BOARD DETERMINATION/RECOMMENDATION:
1. The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding the already-awarded Basic Aviation Badge and 2 Overseas Service Bars to his DD Form 214.
2. The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to award of unit awards and their addition to his DD Form 214.
