THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of his 20 February 2005 Separation Document (DD Form 214) be corrected by adding the Combat Action Badge (CAB).

2.  The applicant states, in effect, that he feels that it should be a matter of record he was involved in combat action with his unit during Operation Iraqi Freedom (OIF), and that as a result, his DD Form 214 should reflect award of the CAB.  

3.  The applicant provides a DD Form 214; Report of Separation and Record of Service (NGB Form 22); and Honorable Discharge Certificate in support of his application.

CONSIDERATION OF EVIDENCE:

1.  The applicantÂ’s record shows that on 20 February 2005, he was honorably released from active duty by reason of completion of required active service.  The DD Form 214 issued to him at this time shows he completed a total 1 year,
2 months, and 3 days of active military service and that he held the rank of sergeant (SGT).  Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) shows he earned the following awards:  National Defense Service Medal; Global War on Terrorism Expeditionary Medal; Global War on Terrorism Service Medal; Armed Forces Reserve Medal with "M" (Mobilization) Device; and Army Service Ribbon. 

2.  The applicant's Official Military Personnel File (OMPF) record contains Commonwealth of Pennsylvania, Department of Military and Veterans Affairs, The Adjutant General Orders Number 347-187, dated 13 December 2003, which ordered the applicant to active duty in support of Operation Iraqi Freedom (OIF), effective 18 December 2003.  It also contains Headquarters, 28th Infantry (Keystone) Division Harrisburg Military Post, Harrisburg, Pennsylvania, Orders Number 137-019, dated 18 May 2006, which awarded him the CAB for his active engagement with the enemy on 10 April 2004.

3.  Army Regulation 635-5 (Separation Documents) prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, release from active duty service, or control of the Active Army.  It also establishes standardized policy for preparing and distributing the DD Form 214.  Chapter 2 contains item-by-item preparation instructions for the DD Form 214.  The instructions for Item 13 are to list awards and decorations for all periods of service.

DISCUSSION AND CONCLUSIONS:

The applicant's contention that his record should be corrected to show award of the CAB was carefully considered and found to have merit.  The evidence of record confirms the applicant was awarded the CAB for actively engaging the enemy on 10 April 2004.  This award was approved by the appropriate authority and properly announced in orders.  Therefore, it would be appropriate to add it to his DD Form 214 at this time.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by 
amending his 20 February 2005 DD Form 214 by adding the Combat Action Badge to the list of awards in Item 13; and by providing him a correction to his separation document that includes this award.
