THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, correction of his Certificate of Release or Discharge from Active Duty (DD Form 214) to show all of his foreign service.

2.  The applicant states that the person processing his DD Form 214 did not have the correct information.

3.  The applicant provides copies of his DD Form 214, deployment orders, and temporary change of station orders.

CONSIDERATION OF EVIDENCE:

1.  On 10 October 2004, the applicant, a sergeant, pay grade E-5, and a member of the California Army National Guard, was ordered to active duty in support of Operation Enduring Freedom.  He reported to Fort Lewis, Washington.

2.  On 16 January 2005, the applicant reported to Hohenfels, Federal Republic of Germany for training and subsequent movement to Kosovo.  On or about 
6 February 2005, the applicant was assigned for duty in Kosovo.  On or about 
20 July 2005, the applicant was TCS (temporary change of station) to Fort Lewis, Washington, for medical care.  [Total overseas service during this period was 
1 year, 6 months, and 5 days.] 

3.  During the period from on or about 21 July through 11 October 2005, the applicant was TCS to Fort Lewis, Washington.  [2 months and 21 days].

4.  On 12 October 2005, the applicant returned to Kosovo for duty with Task Force FALCON.  He departed Kosovo on or about 17 January 2006 and was subsequently placed on medical hold at Fort Lewis, Washington effective 
8 February 2006.  [During this period he served in Kosovo for 3 months and 
6 days.]

5.  On or about 4 July 2006, the applicant was TCS to receive health care under the California Community Based Health Care Organization (CBHCO) based on his medical conditions identified while he was in an active duty status in support of Operation Enduring Freedom.  

6.  On 16 May 2007, the applicant was released from active duty and transferred to 2nd Battalion, 185th Armored Regiment, Escondido, California.  He had attained the rank of staff sergeant, pay grade E-6, and had completed 2 years, 
7 months, and 7 days of creditable active duty during this period of service.

7.  Item 12f (Record of Foreign Service) of the applicant’s DD Form 214 shows 
3 months and 11 days.  Item 18 (Remarks) of this same form, does not indicate any of his deployments during this period of service.

8.  Army Regulation 635-5 (Separation Documents) provides, in pertinent part, that Item 18 (Remarks) will contain the following entry for Reserve Component Soldiers: "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD - YYYYMMDD)." 

DISCUSSION AND CONCLUSIONS:

1.  The evidence of record clearly shows that the applicant served overseas during the periods from 16 January to 20 July 2005 and from 12 October 2005 to 17 January 2006.  This foreign service totals 1 year, 9 months, and 11 days.  The applicant’s DD Form 214 shows only 3 months and 11 days of total foreign service; therefore, he is entitled to correction of his DD Form 214 to show his total foreign service this period.

2.  Furthermore, Item 18 (Remarks) of the applicant’s DD Form 214 is devoid of his deployed service and should be corrected to show his service in Kosovo from 6 February 2005 to 20 July 2005; and again from 12 October 2005 to 17 January 2006.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

      a.  showing in Item 12f of his DD Form 214 his foreign service as 1 year,
9 months, and 11 days; and

	b.  showing in Item 18 of his DD Form 214 his deployments as "SERVICE IN KOSOVO FROM 20050206 – 20050720" and "SERVICE IN KOSOVO FROM 20051012 - 20060117."
