IN THE CASE OF:
BOARD DATE: 8 July 2008
DOCKET NUMBER: AR20080007118
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his military records to show award of the Combat Infantryman Badge.
2. The applicant states that he was an infantry Soldier deployed to Iraq for
12 months and was awarded the Combat Infantryman Badge around May 2005.
3. The applicant provides a copy of his Certificate of Release or Discharge from Active Duty (DD Form 214).
CONSIDERATION OF EVIDENCE:
1. On 22 January 2002, the applicant enlisted in the Regular Army. He completed his initial training and was awarded military occupational specialty (MOS) 11C (Indirect Fire Infantryman).
2. The applicants Enlisted Record Brief, dated 31 March 2006, shows that on
31 July 2004, he was assigned for duty as a gunner with Headquarters and Headquarters Detachment, 1st Battalion, 11th Armored Cavalry Regiment. On
16 October 2005, the applicant was reassigned within this unit as surplus.
3. The applicant served in Iraq during the period from 30 January 2005 to
15 January 2006.
4. On 30 April 2006, the applicant was released from active duty and transferred to the United States Army Reserve Control Group (Reinforcement). He had attained the rank of specialist, pay grade E-4, and had completed 4 years,
3 months, and 9 days of creditable active duty.
5. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of his DD Form 214 list his awards as the National Defense Service Medal, Global War on Terrorism Service Medal, Army Service Ribbon, Overseas Service Ribbon, and the Iraq Campaign Medal. It does not show award of the Combat Infantryman Badge.
6. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, that the Combat Infantryman Badge is awarded to infantry officers and to enlisted and warrant officer persons who have an infantry military occupational specialty (MOS). They must have served in active ground combat while assigned or attached to an infantry unit of brigade, regimental or smaller size.
DISCUSSION AND CONCLUSIONS:
1. The evidence clearly shows that the applicant was awarded an infantryman military occupational specialty. However, it does not show that he was assigned to an infantry unit of brigade, regimental, or smaller size or that he ever engaged in active ground combat while assigned in Iraq.
2. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy the aforementioned requirement.
3. In view of the foregoing, there is no basis for granting the applicant's request.
BOARD VOTE:
________ ________ ________ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
___X____ ___X____ ___X____ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.

Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of the applicant's DD Form 214 shows he was awarded the National Defense Service Medal, the Iraqi Campaign Medal, the Global War on Terrorism Service Medal, and the Army Service Ribbon. Specific requirements state, in effect, that an Army enlisted Soldier must have an infantry or special forces specialty, satisfactorily performed duty while assigned or attached as a member of an infantry, ranger or...

The applicant requests award of the Combat Infantryman Badge for his combat service in Iraq as an infantryman. The applicant provides a copy of his Certificate of Release or Discharge from Active Duty (DD Form 214) and a personal statement regarding an incident on 4 January 2007. The available evidence clearly shows the applicant was awarded an infantryman MOS and was assigned to an infantry unit of brigade, regimental, or smaller size.

Application for correction of military records (with supporting documents provided, if any). The applicant requests, in effect, that the Combat Infantryman Badge and his deployment in Afghanistan be added to his DD Form 214 (Certificate of Release or Discharge from Active Duty). There are no orders in the applicants service personnel records that show he was awarded the Combat Infantryman Badge.
ARMY | BCMR | CY2008 | 20080016771
There are no orders in the applicants service personnel records that show he was awarded the Combat Infantryman Badge. The evidence of record fails to show the applicant was awarded the Combat Infantryman Badge. To be entitled to award of the Combat Infantryman Badge, the evidence must show that an applicant held and served in an infantry MOS or special forces primary duty while the unit engaged in active ground combat.
ARMY | BCMR | CY2009 | 20090000522
The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Combat Infantryman, the Army Achievement Medal, and the Army Commendation Medal. The applicant states that he received the Combat Infantryman Badge for his deployment to Iraq during the period 5 August 2003 to 10 April 2004 and that his DD Form 214 does not reflect the Army Achievement Medal. As a result, the Board recommends that all Department of...

There are three requirements for award of the Combat Infantryman Badge: the Soldier must be an infantryman satisfactorily performing infantry duties, he must be assigned to an infantry unit during such time as the unit is engaged in active ground combat, and he must actively participate in such ground combat. Notwithstanding his sincerity, in the absence of official documentary evidence that conclusively shows he was personally present with a qualifying infantry unit when the unit was...

For example, an 11B assigned to an infantry battalion is not eligible for award of the CAB. The evidence clearly shows that the applicant was assigned to a civil affairs battalion at the time he was awarded the Combat Action Badge. Evidence shows that the applicants records contain administrative error which does not require action by the Board.

He states that during the incident in question, he treated others along with treating himself and he was awarded the Purple Heart which signifies that he was injured; yet, he has not received his orders awarding him the Combat Medical Badge. Paragraph 8-7b(4)1 of Army Regulation 600-8-22 (Military Awards) provides that on or after 18 September 2001, medical personnel assigned or attached to or under operational control of any ground Combat Arms unit (not to include members assigned or...
