THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his military records to show award of the Combat Infantryman Badge.

2.  The applicant states that he was an infantry Soldier deployed to Iraq for 
12 months and was awarded the Combat Infantryman Badge around May 2005. 

3.  The applicant provides a copy of his Certificate of Release or Discharge from Active Duty (DD Form 214).

CONSIDERATION OF EVIDENCE:

1.  On 22 January 2002, the applicant enlisted in the Regular Army.  He completed his initial training and was awarded military occupational specialty (MOS) 11C (Indirect Fire Infantryman).

2.  The applicant’s Enlisted Record Brief, dated 31 March 2006, shows that on 
31 July 2004, he was assigned for duty as a gunner with Headquarters and Headquarters Detachment, 1st Battalion, 11th Armored Cavalry Regiment.  On 
16 October 2005, the applicant was reassigned within this unit as surplus. 

3.  The applicant served in Iraq during the period from 30 January 2005 to 
15 January 2006.

4.  On 30 April 2006, the applicant was released from active duty and transferred to the United States Army Reserve Control Group (Reinforcement).  He had attained the rank of specialist, pay grade E-4, and had completed 4 years, 
3 months, and 9 days of creditable active duty.

5.  Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of his DD Form 214 list his awards as the National Defense Service Medal, Global War on Terrorism Service Medal, Army Service Ribbon, Overseas Service Ribbon, and the Iraq Campaign Medal.  It does not show award of the Combat Infantryman Badge.

6.  Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, that the Combat Infantryman Badge is awarded to infantry officers and to enlisted and warrant officer persons who have an infantry military occupational specialty (MOS).  They must have served in active ground combat while assigned or attached to an infantry unit of brigade, regimental or smaller size.  

DISCUSSION AND CONCLUSIONS:

1.  The evidence clearly shows that the applicant was awarded an infantryman military occupational specialty.   However, it does not show that he was assigned to an infantry unit of brigade, regimental, or smaller size or that he ever engaged in active ground combat while assigned in Iraq. 

2.  In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust.  The applicant has failed to submit evidence that would satisfy the aforementioned requirement.

3.  In view of the foregoing, there is no basis for granting the applicant's request.
