IN THE CASE OF:
BOARD DATE: 31 July 2008
DOCKET NUMBER: AR20080007106
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that his date of birth (DOB) be changed from 26 March 1948 to 23 July 1947.
2. The applicant states that his parents gave incorrect information. He had 12 brothers and sisters with no birth certificates.
3. The applicant provides a copy of his birth certificate.
CONSIDERATION OF EVIDENCE:
1. The applicant underwent a pre-induction physical examination on 23 February 1968 which shows his DOB as 26 March 1948. He was inducted into the Army of the United States on 10 April 1968. His DD Form 47 (Record of Induction) shows his DOB as 26 March 1948.
2. The applicant completed a DD Form 398 (Statement of Personal History) in which he indicated his DOB as 26 March 1948. His DA Form 20 (Enlisted Qualification Record) shows his DOB as 26 March 1948.
3. The applicant provided a copy of his birth certificate, filed on 1 August 1947, which shows his DOB as 23 July 1947.
4. The applicant was honorably released from active duty on 1 April 1970. His DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) shows his DOB as 26 March 1948 in item 5 (DOB).
DISCUSSION AND CONCLUSIONS:
1. For historical purposes, the Army has an interest in maintaining the accuracy of its records. The data and information contained in those records should actually reflect the conditions and circumstances that existed at the time the records were created. In the absence of a showing of material error or injustice, those records should not be changed.
2. Although the applicants birth certificate shows his DOB is 23 July 1947, there are various documents in his personnel record which indicate his DOB as 26 March 1948. While the applicant's desire to have the records changed is understandable, there is no basis for compromising the integrity of the Army's records. This Board action will be filed in his military records so a record of the DOB he is currently using will be on hand.
BOARD VOTE:

BOARD DETERMINATION/RECOMMENDATION:
The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.

Item 5 (DOB) of the DD Form 47 (Record of Induction) completed at that time shows the entry "11 Jul 1948." The DD Form 398 in the applicant's record shows that the applicant provided the DOB shown on his birth certificate at some point during his military service.

The applicant states that he believed the information given to him as a youngster concerning his DOB and place of birth to be true. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicants failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. This Board action will be filed in his military records as a record of the DOB and place of birth he is...

The applicant states, in effect, he was born on 18 February 1948, but his DD Form 214 shows a DOB of 8 February 1947. When he was separated, the applicant's DD Form 214 should have shown his DOB as 18 February 1947 based on all evidence in his service record; however, an administrative error was made and his DOB was reflected as 8 February 1947. Therefore, it would be appropriate to correct the applicant's DD Form 214, but only as indicated below.

His record shows he was inducted into the Army of the United States on 27 October 1966. The evidence the applicant submitted is not sufficient to show an error exists for changing his DD Form 214. The evidence of record shows that upon his initial induction, the applicant's DOB was listed as 24 January 1947. The evidence of record also shows that during his next enlistment and reenlistment, the applicant used 24 January 1947 as his DOB which is also consistent with various documents in his personnel service records and his birth certificate. Therefore, all his three DD Forms 214 should be corrected to show his DOB as 24 January 1947.
