THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of the Board’s denial of his request to correct his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show that he entered active duty in June 1962 and to show his service in the Republic of Vietnam.  He also requests, in effect, as a new issue correction of his DD Form 214 to show all authorized awards.

2.  The applicant states that he wants a correct DD Form 214 with everything that should be on it.

3.  The applicant provides a copy of his DD Form 214, in support of his application.

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20040007047, on 7 June 2005.

2.  In its original decision the Board found that the applicant's original enlistment contract confirms that he entered active duty on 2 November 1962 and there is no evidence to show he served in the Republic of Vietnam.  Furthermore, the applicant had submitted no evidence to support his claim.


3.  Army Regulation 15-185 sets forth procedures for processing requests for correction of military records.  Paragraph 2-15b governs requests for reconsideration.  This provision of the regulation allows an applicant to request reconsideration of an earlier ABCMR decision if the request is received within one year of the ABCMR's original decision and it has not previously been reconsidered.

4.  The applicant's request for reconsideration was not received within one year of the ABCMR's original decision and he has not submitted any new evidence that was not previously considered by the Board.  As a result, his request for reconsideration does not meet the criteria outlined above, and will not be discussed any further in this case.

5.  Item 26 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) of his DD Form 214 shows the Marksman Marksmanship Qualification Badge with Rifle Bar (M-14).

6.  A review of the applicant's record indicates entitlement to additional awards and decorations not shown in item 26 of his DD Form 214.

7.  Army Regulation 600-8-22 (Military Awards) provides that the National Defense Service Medal is awarded for honorable active service for any period between 27 July 1950 through 27 July 1954, 1 January 1961 through 14 August 1974, 2 August 1990 through 30 November 1995, and 11 September 2001 to a date to be determined.

8.  Item 28 (Qualification of Arms) of his DA Form 20 (Enlisted Qualification Record) shows the Marksman Marksmanship Qualification Badge with Rifle Bar (M-1).

DISCUSSION AND CONCLUSIONS:

The evidence shows that the applicant is authorized the awards of the National Defense Service Medal for honorable active service during the period  
1 January 1961 through 14 August 1974 and the Marksman Marksmanship Qualification Badge with Rifle Bar (M-1).  Therefore, he is entitled to correction of his records to show these awards.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief pertaining to the applicant's new awards issue.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing award of National Defense Service Medal and the Marksman Marksmanship Qualification Badge with Rifle Bar
(M-1) on his DD Form 214.
