THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that his DD Form 214 (Certificate of Release or Discharge from Active Duty) be amended to correct the spelling of his middle name.  

2.  The applicant states that his middle name is misspelled.  Specifically, that it should be corrected by changing the fourth letter of the applicant’s middle name from “n” to “u.”

3.  The applicant provides copies of his DD Form 214 (Certificate of Release of Discharge from Active Duty), birth certificate, and social security card in support of this application.

CONSIDERATION OF EVIDENCE:

1.  The applicant's records show that he enlisted in the United States Army on 3 November 1999.  He completed basic training and advanced individual training and was awarded the military occupational specialty 25V (Combat Documentation/Production Specialist).  The highest rank he achieved was specialist/pay grade E-4.

2.  The applicant’s DD Form 214 shows that he was honorably discharged on 2 November 2005.  He completed a total of six years of creditable active military service.

3.  The applicant’s DD Form 214 shows his full name with an “n” as the fourth letter of his middle name.

4.  The applicant’s birth certificate, dated 16 September 1998, shows his full name with a “u” as the fourth letter of his middle name.

5.  The applicant’s social security card shows only the first letter of his middle name.

6.  The applicant’s DD Form 4 (Enlistment/Reenlistment Document), dated 3 November 1999, shows only the first letter of his middle name.

7.  The applicant's DA Form 2-1 (Enlisted Record Brief), dated 21 March 2005, shows only the first letter of his middle name.

8.  The applicant’s military service record in the Army Human Resources Command Integrated Web Services data base [a web-based collection of data, applications, and tools to assist career managers and other human resource personnel in supporting Active Army, Army Reserve, and Army National Guard Soldiers, veterans, retirees, family members, and other stakeholders; the principal application is the Soldier Management System] shows his full name with a “u” as the fourth letter of his middle name.

DISCUSSION AND CONCLUSIONS:

1.  The applicant's request that his DD Form 214 be amended to correct the spelling of his middle name was carefully considered and determined to have merit.

2.  In view of the evidence provided, the applicant’s middle name as it appears on his DD Form 214, dated 2 November 2005, appears to contain an administrative error; therefore, the applicant is entitled to correction of his DD Form 214 to show his full name with a “u” as the fourth letter of his middle name.
