Exhibit A - Application for correction of military records.

Exhibit B - Military Personnel Records (including advisory opinion, if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests reconsideration of his earlier request for correction of Item 11d (Effective Date) on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show he was released from active duty on 23 November 1967 instead of 2 November 1967.

2. The applicant states, in effect, that his expiration term of service date was 23 November 1967.

3. The applicant provides a copy of his DD Form 214, dated 23 November 1967, and a copy of his separation orders.

CONSIDERATION OF EVIDENCE:

1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20070008581 on 30 October 2007.

2. The applicant was inducted into the Army of the United States on 18 January 1966 and served in military occupational specialty (MOS) 11B (Light Weapons Infantryman). He was honorably released from active duty and transferred to the U.S. Army Reserve Control Group (Annual Training) on 23 November 1967.

3. Item 11d of the DD Form 214 he was issued at the time of his separation shows the entry "23 November 1967." However, the "3" digit in his date of separation is almost illegible, even on the record carbon copies of the DD Form 214.

4. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. The purpose of the separation document is to provide the individual with documentary evidence of their military service. It is important that information entered on the form should be complete and accurate. This regulation specified that the DD Form 214 is a summary of a Soldier's most recent period of continuous active duty to include attendance at basic and advanced training. The DD Form 214 will be prepared for all personnel at the time of their retirement, discharge, or release from active duty. The DD Form 214 was prepared in multiple copies, using carbon paper. In the version in effect at the time, the date the Soldier entered active duty status was entered in Item 10c and the last active duty date was entered in Item 11d.

DISCUSSION AND CONCLUSIONS:

1. Although Item 11d on the applicant’s DD Form 214 properly shows he was released from active duty on 23 November 1967, this date is almost illegible on all copies of the form.

2. The purpose of the separation document is to provide the individual with documentary evidence of their military service. Therefore, in the interest of justice and equity, the applicant is entitled to correction of his records to show a clear, readable, and legible date of separation shown on his DD Form 214.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant amendment of the ABCMR’s decision in Docket Number AR20070008581, dated 30 October 2007. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by issuing the applicant a DD Form 215 (Correction to the DD Form 214) that shows his date of release from active duty as 23 November 1967.

The DD Form 214 is a "snapshot in time" and is a reflection of the applicant's record of active Army service at the time of his separation from active duty. Evidence of record shows the applicant enlisted in the Regular Army on 10 January 1967, which is properly reflected on his DD Form 214 for the period ending 19 November 1967. Since the applicant was discharged from the USAR on 1 January 1973, almost 1 year after his release from active duty, there is no basis for amending item 11d of...

The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) by amending the date of his release from active duty from 5 January 1968 to 5 January 1969. He was on active duty for 2 years, as reflected both in his records and on his DD Form 214. The applicant requests item 11d of his DD Form 214 be corrected to show his release from active duty date as 5 January 1969.

He was issued a DD Form 214 at the time of his discharge which shows "31 May 1967" in Item 11d and "18 July 1966" in Item 16c. The evidence of record shows the applicant enlisted in the Regular Army on 18 July 1966 and was discharged to accept a commission on 31 May 1967. Item 17c of this DD Form 214 also properly shows 1 June 1967 as the date entered on active duty for this period of service.

The applicant states the separation date shown on his DD Form 214 contains a typographical error in the year and should show 11 April 1967, not 11 April 1965. The applicant's DD Form 214 shows he entered active duty on 12 April 1965. Therefore, it would be appropriate to correct this item to show the applicant was separated from active duty on 11 April 1967.

The evidence of record shows that the applicant entered active duty for training on 29 March 1967 and was honorably released from active duty on 29 July 1967. His DD Form 214 correctly shows the dates of entry and separation and the net period of active service. It appears that the applicant’s periods of service documented on the NA Form 13041 were performed as part of his USAR training obligation and could not be entered on the DD Form 214 as they occurred outside the period covered by...
