The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion, if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests reconsideration of his earlier request to correct his military records to show that he was missing in action for a 14 day period.
2. The applicant states, in effect, that he was captured by the enemy on
27 November 1950, escaped shortly afterwards, and was lost in enemy territory for 14 days. He further states that he was returned to military control on
12 December 1950.
3. The applicant provides copies of his orders awarding him the Purple Heart, hospital admission record from the Office of the Surgeon General (SGO File)(previously submitted), book review, and extracts of newspaper articles.
CONSIDERATION OF EVIDENCE:
1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20070001100, on 18 July 2007.
2. With exception of the book review, the documentation provided by the applicant has been previously considered by the Board. The book review describes the applicant's recollections of his experience in Korea.
3. The applicant provides new argument based on the Board's previous correction of his records. He essentially states that since he escaped from the enemy on 29 November 1950 but was not admitted to the hospital until
12 December 1950, those 14 days should be recognized in his records as "missing in action."
DISCUSSION AND CONCLUSIONS:
There is no official evidence of record to substantiate the applicant's contention that he was "missing in action" during the 14 day period between his escape from the enemy and his admission to the hospital. Regrettably, there is insufficient evidence to grant the requested relief.
BOARD VOTE:
________ ________ ________ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
__PHM __ __KSJ__ ___JGH__ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis to amend the decision of the ABCMR set forth in Docket Number AR20070001100, dated 18 July 2007.

In the statement, a former service member of the applicant's unit stated, in effect, the applicant was slightly wounded on the left cheek by sniper fire for which he sought no medical attention. The witness also stated, in effect, that in November 1952, Company F, his unit, moved out in a fighting withdrawal, the Chinese were shelling them with mortars, and the applicant was struck in the left knee. There is no evidence of record, and the applicant has provided insufficient evidence, which...

The applicant states that his hospital records should show his back injury on 7 July 1950 and that the folliculitis only showed up while he was at the 118th Hospital in Japan. The applicant submitted a copy of a Western Union message, dated 10 July 1950; a copy of the National Archives Korea War Casualty File, dated 24 October 2005; a compilation of the 21st Infantry Regiment Casualties from 3 to 7 July 1950, dated 28 December 2001; and a copy of the hospital admissions card, dated 3 July...

The applicant requests reconsideration of his previous application to add the Silver Star and the Purple Heart to his WD AGO Form 53-55 (Enlisted Record and Report of Separation - Honorable Discharge). Although the 1973 fire in St. Louis destroyed many military records, the newspaper article he provides should serve as proof that he was awarded the Silver Star and the Purple Heart. In the applicant's previous application, he provided copies of newspaper articles which show a missing in...

The applicant requests that his records be corrected to show a field promotion to corporal and to show he is entitled to a Purple Heart for wounds received on or about 10 August 1950. Although some of the available documents list the applicant as a corporal, these records are insufficient in and of themselves to correct his records to show he was a corporal at the time of his separation. Available medical records do show he was wounded in action on 27 September 1950.

BOARD DATE: 27 May 2010 DOCKET NUMBER: AR20090020560 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. There is no evidence in his available service records which shows he suffered a wound/injury that resulted from hostile action or that he was treated for such wound/injury. The applicant's military records are not available to the Board for review. Further, an OTSG Hospital Admission Record on file confirms the applicant was treated by military medical personnel in Korea for a wound to abdomen he received as a result of enemy action. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by awarding him the Purple Heart, for being wounded in action in Korea on 19 August 1950; by showing he...

The applicant states he was wounded in combat during World War II and should have been awarded the Purple Heart. The applicantÂ’s military records are not available to the Board for review. The applicant was also insistent, by providing a page from a World War II history book that discussed the German V-1 flying bomb (or buzz bomb) and by annotating that page, stating he was wounded as a result of an exploding German buzz bomb.

The applicant's elected representative's contention that regulations in effect at the time of the incident were not cited by the Board and that the applicant's BSM for heroism proves that the Board was in error in its conclusion are new arguments and require that the Board reconsider the applicant's request. In its first consideration of this case, the Board concluded that the evidence of record clearly shows that the applicant suffered from a recurring hernia and was sent for medical...

He further states that the Army Morning Report should be compared with the Army War Casualty Roster and it should be determined why the two reports differ from one another. Substantiating evidence must be provided to verify that the wound was the result of hostile action, the wound must have required treatment by military medical personnel, and the medical treatment must have been made a matter of official record. By regulation, in order to award the Purple Heart it is necessary to...
