THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that the dates he served in an imminent danger pay (IDP) zone in support of Operation Enduring Freedom be corrected on his DD Form 214 (Certificate of Release or Discharge from Active Duty).

2.  The applicant states, in effect, that the correct dates that he served in Iraq were from 29 March 2006 to 10 July 2007 and that this service equals almost 
17 months.

3.  The applicant provides a copy of his DD Form 214 in support of this application.

CONSIDERATION OF EVIDENCE:

1.  The applicant's DD Form 214 shows that he was ordered to active duty in support of Operation Enduring Freedom on 18 September 2005.  He was awarded the military occupational specialty (MOS) 62B, (Wheeled Vehicle Mechanic).  The highest rank he attained while serving on active duty was Sergeant (E-5). 

2.  The applicant’s DD Form 214 shows that he was released from active duty and transferred to the United States Army Reserve (USAR) on 19 August 2007.  He was credited with 1 year, 11 months, and 2 days of active duty service.

3.  The applicant's DD Form 214 shows in Item 12f (Foreign Service) that he was credited with 1 year, 3 months, and 15 days of foreign service.

4.  The applicant’s DD form 214 shows in 18 (Remarks) shows that he was credited with serving in an IDP zone from 29 March 2007 to 10 July 2007.

5.  Contact with the Military Pay Office, Defense Finance and Accounting Services (DFAS) confirms that the applicant received IDP from 27 March 2006 to 
10 July 2007.

6.  Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214.  The regulation in effect at the time directs, in pertinent part, that the purpose of the separation document is to provide the individual with documentary evidence of their military service.  It is important that information entered on the form should be complete and accurate.


7.  Paragraph 2-4 of Army Regulation 635-5 indicates that Item 12f (Foreign Service) of the DD Form 214 should show the total amount of foreign service completed during the period covered in block 12c (Net Active Service This Period).

8.  Paragraph 2-4 of Army Regulation 635-5 also indicates that Item 18 (Remarks) of the DD Form 214 should contain the following entry when a Soldier is ordered to active duty and deployed to a foreign country: 

      "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD -YYYYMMDD)."

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that his DD Form 214 should be corrected to show the correct dates of his service in an IDP zone.

2.  The available evidence shows the applicant was ordered to active duty in support of Operation Enduring Freedom and he was deployed to Iraq from 
27 March 2006 to 10 July 2007; he received IDP during this same period.  The applicant is entitled to correction of his DD Form 214 to show this service.

3.  The applicant’s period of foreign service from 27 March 2006 to 10 July 2007 equals 1 year, 3 months and 15 days.  Therefore, item 12f is correctly annotated on his DD Form 214.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending the individuals DD Form 214 issued on 19 August 2007 by: 
	a.  deleting the entry “SERVICE IN IRAQ FROM 20070329 -20070710”; and 

	b.  adding the entry "SERVICE IN IRAQ FROM 20060327–20070710"

2.   The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to additional foreign service.
