      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, promotion reconsideration for chief
warrant officer four under the 2007 year criteria.

2.  The applicant states, in effect, that he was not selected for
promotion to chief warrant officer four due to not meeting the education
requirements, the Warrant Advanced Course (WOAC).  He also states, in
effect, that he completed the WOAC on 8 January 2007 but, the completion
certificate was not placed in his personnel records until 31 January
2007; therefore, it was not seen by the 2007 promotion selection board.

3.  In support of his request, the applicant provided copies of his WOAC
completion certificate and DD Form 214 (Certificate of Release or
Discharge from Active Duty).

CONSIDERATION OF EVIDENCE:

1.  Based upon a review of the applicant’s records by the Office of
Promotions, Reserve Components, Human Resources Command, St. Louis,
Missouri, it was determined that the applicant’s official military
personnel file (OMPF) contained material error when he was considered and
not selected for promotion to chief warrant officer four by the 2007
Reserve Components Selection Board (RCSB).  His WOAC completion certificate
was not seen.

2.  Current promotion policy specifies that promotion
consideration/reconsideration by a special selection board may only be
based on erroneous non-consideration or material error that existed in
the record at the time of consideration.

DISCUSSION AND CONCLUSIONS:

1.  The applicant’s records contained material error when reviewed for
promotion to chief warrant officer four by the 2007 RCSB and should now be
submitted for appropriate special selection board consideration for this
purpose.

2.  In view of the foregoing findings and conclusions, it would be
appropriate to correct the applicant’s records as recommended below.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to
warrant a recommendation for relief.  As a result, the Board recommends
that all Department of the Army records of the individual concerned be
corrected by submitting his records to a duly constituted special
selection board for promotion consideration for chief warrant officer four
under the 2007 year criteria.

2.  That if selected, his records be further corrected by showing he was
promoted to chief warrant officer four on his date of eligibility, as
determined by appropriate Departmental officials, using the 2007 year
criteria, provided he was otherwise qualified and met all other
prerequisites for promotion.

3.  That if not selected, the applicant be so notified.
