CONSIDERATION OF ADDITIONAL EVIDENCE:

14. On 14 August 2007, the U. S. Army Human Resources Command –
Alexandria, VA informed the Board analyst, in regard to the decision of the
Army Board for Correction of Military Records (ABCMR) in Docket Number
AR20070001192 dated 26 June 2007, that voluntary retirements occur on the
last calendar day of the month.

ADDITIONAL DISCUSSION AND CONCLUSIONS:

5. At the time of the decision of the ABCMR in Docket Number AR20070001192
dated 26 June 2007, it was the intent of the ABCMR to make the applicant’s
record as administratively correct as it should properly have been.

6. The ABCMR's decision in Docket Number AR20070001192 erroneously
corrected the applicant’s records to show he was released from active duty
and placed on the retired list on 13 July 2001.

7. The recommendation in ABCMR Docket Number AR20070001192 should be
amended to show the applicant was released from active duty on 31 July 2001
and placed on the retired list on 1 August 2001.

The evidence of record shows the applicant entered ROTC in September 1983 and enlisted in the USAR (SMP) on 20 August 1984. It would be equitable to correct his records to show his PEBD was adjusted to 20 August 1984 prior to his retirement with all pay and allowances (by reason of earlier longevity increases), retroactive to 23 September 1996, due as a result of this correction. As a result, the Board recommends that all Department of the Army records of the individual concerned be...
