	Exhibit A - Application for correction of military records.

	Exhibit B - Military Personnel Records (including advisory opinion, if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of his request for award of the Purple Heart.

2.  The applicant states the Purple Heart is not shown on his DD Form 214 (Armed Forces of the United States of Transfer or Discharge).  He further states he has never received the Purple Heart medal or certificate.

3.  As new evidence, the applicant provides a copy of DA Form 8-275-3 (Clinical Record Cover Sheet) dated 21 March 1969. 

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records, which were summarized in the previous consideration of the applicant's case by the Army Board of Correction of Military Records (ABCMR) in Docket Number AR20040009383, on 23 August 2005. 

2.  On 26 January 1968, the applicant was inducted into the Army of the United States for a period of 2 years.  He completed all required training and was awarded the military occupational specialty (MOS) 11B (Light Weapons Infantryman).  The applicant was assigned to the Republic of Vietnam from 
24 July 1968 to 23 July 1969 with Company A, 2nd Battalion, 1st Infantry, 196th Infantry Brigade.

3.  The applicant submitted new evidence to the Board for its review and consideration.  The new evidence provided is a copy of the applicant's Clinical Record, dated 21 March 1969, which shows the applicant was Injured as a result of Hostile Action (IRHA) on 19 March 1969 near the vicinity of Tien Phuoc in the Republic of Vietnam.  The form shows the applicant was injured because of an enemy rocket propelled grenade (RPG) explosion.  The applicant injured his right hand during the explosion.  He was admitted to the 27th Surgical Hospital on 19 March 1969 and treated, then transferred to the 249th General Hospital on 21 March 1969 for continued medical treatment.  The Clinical Record shows the entry in Item 25, "Purple Heart awarded this hospital, General Order no 59, dated 20 Mar 69."

DISCUSSION AND CONCLUSIONS:

The applicant has provided to the Board sufficient evidence to support reversing its previous decision by correcting his military record to show award of the Purple Heart for wounds incurred on 19 March 1969 in the Republic of Vietnam.  The Clinical Record shows the applicant was injured as a result of hostile action, the wound was treated by military medical personnel, and that the medical treatment was made a matter of official record.  Further, the Clinical Record shows the 27th Surgical Hospital awarded him the Purple Heart and that permanent general orders were published by the hospital commander as required by U. S. Army Vietnam Regulation 672-1 (Decorations and Awards).

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant amendment of the ABCMR's decision in Docket Number AR20040009383, dated 23 August 2005.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by awarding the Purple Heart for wounds received as a result of hostile action on 19 March 1969 in the Republic of Vietnam.
