	The Board considered the following evidence: 

	Exhibit A - Application for correction of military records.

	Exhibit B - Military Personnel Records (including advisory opinion, if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his records to show that he does not have a Bachelor’s Degree.

2.  The applicant states that his Officer Record Brief (ORB) and Official Military Personnel File (OMPF) are in error for showing that he has a Bachelor’s Degree.  He further states that he completed 135 credit hours at the University of Wisconsin-La Crosse, but he never completed his degree and was never awarded a degree.

3.  The applicant provides a copy of his DA Form 61 (Application for Appointment), a copy of his Army Continuing Education System (ACES) Record, a copy of his ORB dated 3 March 2004, a copy of his DA Form 2A (Personnel Qualification Record), a copy of his Standard Form (SF) 86 (Questionnaire for National Security Position), and a self-authored statement in support of his application.

CONSIDERATION OF EVIDENCE:

1.  The applicant's records show that he enlisted in the Regular Army on 23 July 1997 for a period of 4 years, under the provisions of Army Regulation 601-210 (Active and Reserve Component Program).

2.  The DA Form 3286-59 (United States Army Delayed Enlistment Program) shows that the applicant enlisted for two programs: the 9B Program [U.S. Army Station-Unit-Command-Area (CARS) Program] and the 9C Program [U.S. Army Loan Repayment Program (LRP)].

3.  The applicant's DA Form 3286-59 also shows that the applicant enlisted for a military occupational specialty (MOS) which had a cash bonus equal to $12,000 at the time of his enlistment. 

4.  The applicant's DA Form 3286-66 (Statement of Understanding for the U.S. Army Incentive Enlistment Program) shows the applicant placed his signature on the form indicating he fully understood his entitlements of the cash bonus, LRP, and the CARS programs. 

5.  Item 23 (Education) of the applicant's DA Form 1966/3 (Record of Military Processing in the Armed Forces of the United States) shows a listing of high schools and colleges attended by the applicant.  The applicant listed attendance at the University of Wisconsin, La Crosse, during the period September 1990 through May 1996 and indicated he did not graduate from that college by placing an "X" in the "No" Column of the "Graduate" portion of his education.

6.  Item 10 (Where You Went to School) of the applicant's SF 86 shows that the applicant attended the University of Wisconsin-La Crosse, during the period September 1990 through May 1996.  The applicant left the entries "Degree/Diploma/Other" and "Month/Year Awarded" blank.

7.  On 15 December 1998, the applicant submitted a DA Form 61, applying for appointment as a commissioned officer or warrant officer in the Regular Army or Army Reserve or to obtain selection for attendance at the U.S. Army Officer Candidate School.

8.  Item 21c (Civilian Education) of the DA Form 61 shows that the applicant listed attendance at the University of Wisconsin-La Crosse, was awarded a Bachelor’s Degree, earned 135 credit hours, attended 6 years of college, and majored in Sports and Recreation Management. 

9.  Section III (Service data) of the applicant's ORB shows that he was appointed as a second lieutenant (2LT) in on 25 May 2000 with Officer Candidate School (OCS) as his source of appointment.  

10.  Section VII (Civilian Education) of the applicant's ORB shows that he completed a “Baccalaureate” Degree in Recreation at the University of Wisconsin-La Crosse in 1996. 

11.  Records show the applicant was honorably discharged on 30 May 2004 and the DD Form 214 (Certificate of Release or Discharge from Active Duty) the applicant was issued shows that his Reserve Obligation terminated on 18 September 2005.

12.  The applicant's DA Form 2A and the ACES Record both show the applicant was a High School graduate.  There is no reference to college or credit hours on either form.

13. Army Regulation 600-8-104 (Military Personnel Information Management/ Records), chapter 4, section III, describes the steps to update a Soldier's Officer Record Brief.  Soldiers may submit a memorandum requesting officer records brief changes to the Commander, Army Human Resources Command, ATTN:  AHRC-OPZ-IS, Alexandria, Virginia 22332-0400.

14.  Army Regulation 635-5 (Separation Documents) prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, release from active duty service, or control of the Active Army. It establishes standardized policy for preparing and distributing the DD Form 214.  Paragraph 2-1 of this regulation states that the DD Form 214 is a summary of a Soldier's most recent period of continuous active duty.  It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that his records should be corrected to show that he does not have a Bachelor Degree.

2.  The Officer Record Brief is in informal compilation of an officer's military service.  The ORB is a record that is maintained while an officer is in an active status and is not considered an official document and therefore, is not under the jurisdiction of the Army Board for Correction of Military Records.

3.  The applicant's DD Form 214 does not list the applicant's civilian education.  Therefore, there is no corrective action required.

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable error or injustice.  Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.
