THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his service in Iraq from 5 April 2003 through 25 November 2003. 

2.  The applicant states that he was deployed in Iraq during the period 5 April 2003 through 25 November 2003. 

3.  The applicant provides a copy of Memorandum for Record dated 24 December 2003 and a copy of a Memorandum Letter of Release dated 9 November 2003. 

CONSIDERATION OF EVIDENCE:

1.  The applicant's DD Form 214 shows that he enlisted in the Regular Army on 23 February 2000 for a period of 4 years and that he was awarded military occupational specialty (MOS) 31R (Multi-channel Transmission Systems Operator and Maintainer).  The form further shows that the applicant was honorably released from active duty on 22 February 2004 and the highest grade he held during his military service was private first class/pay grade E-3.

2.  The applicant's DA Form 2-1 (Personnel Qualification Record) and his Enlisted Record Brief are not available for review with this case.

3.  Item 18 (Remarks) of the applicant's DD Form 214 does not list any overseas service. 

4.  Memorandum for Record, dated 24 December 2003 and authenticated by the commander, Headquarters and Headquarters Company, 16th Signal Battalion, Fort Hood, Texas, shows that the applicant was deployed in support of Operation Iraqi Freedom during the period 5 April 2003 through 25 November 2003.

5.  Memorandum for the Theater Clearance Facility, dated 9 November 2003 and authenticated by the commander, Headquarters, 3rd Armored Cavalry Regiment (ACR) shows that the applicant was released from the Central Command (CENTCOM) Area of Operations (AOR) effective 20 November 2003 due to his upcoming expiration term of service (ETS).

6.  Army Regulation 635-5 (Separations Documents) states, in pertinent part, that the "Remarks" block of the Soldier's DD Form 214 is used for mandatory requirements when a separate block is not available and as a continuation for entries in blocks 11 (Primary Specialty), 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized), or 14 (Military Education).  For an active duty Soldier deployed with his or her unit during their continuous period of active service, enter the statement "Service in (Name of County Deployed) from (inclusive dates for example, YYYYMMDD – YYYMMDD).”

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that he is entitled to correction of his military records to show his overseas service in Iraq during the period 5 April 2003 through 25 November 2003.

2.  The evidence of record shows he was deployed with the 16th Signal Battalion in support of Operation Iraqi Freedom during the period 5 April 2003 through 25 November 2003.  Therefore, he is entitled to correction of his records to show his service in Iraq during this period.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing in Item 18, “Service in Iraq From 20030405 – 20031125.”
