	The Board considered the following evidence:

	Exhibit A - Application for correction of military records.

	Exhibit B - Military Personnel Records (including advisory opinion, if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his Certificate of Release or Discharge from Active Duty (DD Form 214) to show his correct dates of active duty service.

2.  The applicant states that his DD Form 214 does not show his correct dates of service.

3.  The applicant provides copies of his DD Form 214, enlistment contract, and deployment orders.

CONSIDERATION OF EVIDENCE:

1.  On 1 December 1998, the applicant enlisted in the Alabama Army National Guard for 8 years.  He was ordered to initial active duty for training (IADT) on 
5 January 1999.  He completed his initial training and was awarded military occupational specialty (MOS) 31U1O (Signal Support Systems Specialist).  He was released from IADT on 20 July 1999 and returned to the Alabama Army National Guard.  He had completed 6 months and 16 days of creditable active duty.

2.  On 1 May 2004, the applicant was honorably discharged from the Alabama Army National Guard and as a Reserve of the United States Army.  He had attained the rank of specialist, pay grade E4 and had completed 4 years, 
11 months, and 17 days of creditable inactive service.

3.  On 4 May 2004, the applicant enlisted in the Regular Army for 3 years and 
17 weeks beginning in the rank of specialist, pay grade E4.  He completed advanced individual training and was awarded MOS 63M1O (Bradley Fighting Vehicle System Maintainer).

4.  Permanent Orders 314-8, 3rd Infantry Division, dated 9 November 2004, assigned the 3rd Brigade Combat Team to the Coalition Forces Land Component Command, United States Army Forces Central Command, in support of Operation Iraqi Freedom, effective on or about 19 January 2005.  The applicant is shown on the accompanying personnel list as part of the unit's maintenance support. 

5.  The applicant’s Enlisted Record Brief, dated 31 January 2007, shows that he served overseas in support of Operation Iraqi Freedom for a 12-month period from 17 January 2005 to 17 January 2006.  It also shows that he was promoted to the rank of sergeant, pay grade E5, on 1 January 2006.
6.  On 31 January 2007, the applicant was honorably discharged.  He had completed 2 years, 8 months, and 28 days of creditable active duty service during this period.  He also completed 1 year and 1 day of overseas service.

7.  Item 12 (Record of Service) of the applicant’s DD Form 214 for the period of service ending 31 January 2007 shows that he entered active duty on 1 January 2006, completed 3 years,3 months, and 9 days of active duty and had no foreign service and no prior active or inactive service. 

DISCUSSION AND CONCLUSIONS:

1.  The evidence clearly shows that the applicant’s record of service as shown on his DD Form 214 for the period ending 31 January 2007 is incorrect.  The applicant entered active duty on 4 May 2004.  He was discharged on 31 January 2007.  Therefore, he served 2 years, 8 months, and 28 days of active service.  He also served 6 months and 16 days of prior active duty and had 4 years, 
11 months, and 17 days of prior inactive service.  He served overseas for 1 year and 1 day during this period of service.  Therefore, his DD Form 214 should be corrected to show this creditable service.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned, particularly his DD Form 214 for the period ending 31 January 2007, be corrected by:

	a.  showing in Item 12a (Date Entered AD This Period): 2004, 05, 04;

	b.  showing in Item 12b (Separation Date this Period): 2007,01,31;

	
c.  showing in Item 12c (Net Active Service This Period): 2 years, 
8 months, and 28 days;

	d.  showing in Item 12d (Total Prior Active Service): 6 months, 16 days;

	e.  showing in Item 12e (Total Prior Inactive Service): 4 years, 11 months, and 17 days; and

	 f.  showing in Item 12f (Foreign Service): 1 year and 1 day.
