The Board considered the following evidence:

Exhibit A - Application for correction of military records.

Exhibit B - Military Personnel Records (including advisory opinion, if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests that her DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show the award of the Army Service Ribbon (ASR) and Army Good Conduct Medal (AGCM) for her military service.

2. The applicant states, in effect, that all awards which were authorized for her service are missing from the DD Form 214.

3. The applicant provides a copy of her DD Form 214 and a copy of an excerpt which provides the eligibility criteria for the ASR and the AGCM.

CONSIDERATION OF EVIDENCE:

1. The applicant's military records show that she entered active duty for five years on 22 September 2003. She completed basic combat training and advanced individual training and was awarded the military occupational specialty 97E1O (Interrogator).

2. Her available military records do not contain any assignment instructions. On 1 December 2004, the applicant was honorably discharged for pregnancy after serving 1 year, 2 months, and 10 days of active service.

3. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of the applicant's DD Form 214 shows the National Defense Service Medal, Global War on Terrorism Service Medal, Marksman Marksmanship Qualification Badge with Rifle Bar, Marksman Marksmanship Qualification Badge with Grenade Bar and the Army Lapel Button. However, it does not show the AGCM and ASR.

4. Army Regulation 600-8-22 (Military Awards) provides that the Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service. Also, for the first award only, upon termination of service on or after 27 June 1950 of less than
3 years but more than 1 year. Although there is no automatic entitlement to the Good Conduct Medal, disqualification must be justified.

5. Army Regulation 600-8-22 shows that the Army Service Ribbon was established by the Secretary of the Army on 10 April 1981. This regulation states, in pertinent part, that effective 1 August 1981, all members of the Active Army, Army National Guard, and Army Reserve in an active Reserve status are eligible for the award upon successful completion of initial entry training. The award may be awarded retroactively to those personnel who completed the required training before 1 August 1981 provided they had an Active Army status on or after 1 August 1981.

6. A review of the applicant's records does not indicate entitlement to additional awards and decorations not shown in item 25 of her DD Form 214.

DISCUSSION AND CONCLUSIONS:

1. The applicant requests that her DD Form 214 be corrected to show the awards of the ASR and the AGCM for her military service.

2. Records show that the applicant successfully completed her initial entry training as required and was awarded the military occupational specialty 97E1O. Therefore, the applicant is entitled to correction of her records to show the award of the ASR.

3. Records show she is entitled to the first award of the AGCM for the period
22 September 2003 to 1 December 2004 based on completion of a period of qualifying service of less than three years, but more than one year, ending with the termination of a period of Federal military service. Her records do not contain any adverse information. Therefore, she is entitled to correction of her records to show this award.

The applicant states, in effect, that her unit was awarded a unit citation while she was assigned and she should have received this award. The evidence of record confirms the applicant served on active duty during a qualifying period for the NDSM and that he was eligible to be awarded the AGCM based on his "excellent" conduct and efficiency ratings and the lack of a court-martial conviction and/or unit commander disqualification during his active duty service. Therefore, it would appropriate to award him the AGCM for his qualifying period of honorable active duty service from 16 January 1964 through 15 January 1966 and the...
