RECORD OF PROCEEDINGS

	IN THE CASE OF:

	BOARD DATE: 31 May 2007
	DOCKET NUMBER: AR20060016186

I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual.

The Board considered the following evidence:

Exhibit A - Application for correction of military records.

Exhibit B - Military Personnel Records (including advisory opinion, if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests that her rank be corrected on her separation from active duty orders and on her discharge orders from the U. S. Army Reserve (USAR) to show Private First Class (PFC)/E-3.

2. The applicant states, in effect, that she was a PFC/E-3 and not a Private
(PV2)/E-2 when she was discharged.

3. The applicant provides her DD Form 214 (Certificate of Release or Discharge from Active Duty) with the ending period 14 December 1997; Headquarters, 18th Personnel Services Battalion, Fort Bragg, NC Orders 317-0302, dated
13 November 1997; and U. S. Army Human Resources Command, St. Louis (USAHRCSTL) Orders D-03-408405, dated 10 March 2004.

CONSIDERATION OF EVIDENCE:

1. The applicant enlisted in the Regular Army on 5 March 1996 and successfully completed basic training and advanced individual training. She was awarded military occupational specialty 71G (Patient Administrative Specialist).

2. An undated DA Form 4187 (Personnel Action) shows that the applicant was advanced to the rank of PFC/E-3 with the effective date and date of rank of
6 May 1997.

3. There is no derogatory information in the applicant's records and no evidence to show she was reduced to the rank of PV2/E-2 after her advancement to the rank of PFC/E-3.

4. The applicant was honorably discharged for disability on 19 December
1997 in the rank of PFC/E-3. She was not transferred to the USAR. Her DD Form 214 with the ending period 19 December 1997 shows her date of rank as 6 May 1997 in item 12h.

5. Headquarters, 18th Personnel Services Battalion, Fort Bragg, NC Orders
317-0302, dated 13 November 1997 show the applicant's rank as PV2/E-2.

6. There is evidence in the applicant's records that show she later enlisted in the UASR.

7. USAHRCSTL Orders D-03-408405, dated 10 March 2004, show that applicant was discharged from the USAR effective 10 March 2004 and show her rank as PV2/E-2.
DISCUSSION AND CONCLUSIONS:

1. Evidence of record shows that the applicant was promoted to PFC/E-3 on
6 May 1997 and there is no evidence to show she was reduced to the rank of PV2/E-2. Therefore, her 13 March 1997 discharge orders should be corrected to show the rank of PFC/E-3.

2. It appears the applicant's 10 March 2004 orders discharging her from the USAR were issued in error. The applicant had been discharged in March 1997, not transferred to the USAR. There is no evidence of record to show she later enlisted in the USAR. These orders should be revoked.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

	a. amending Headquarters, 18th Personnel Services Battalion, Fort Bragg, NC Orders 317-0302, dated 13 November 1997 to show her rank as "PFC;" and

	b. revoking USAHRCSTL Orders D-03-408405, dated 10 March 2004.
