      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that Item 12f (Foreign Service),
Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons
Awarded or Authorized) and Item 14 (Military Education) of his 1 August
2006 Separation Document (DD Form 214) be corrected.

2.  The applicant states, in effect, that the total overseas service
reflected in Item 12f of his DD Form 214 should reflect a total of 1 year,
5 months, and 17 days, which includes 1 year, 2 months, and 15 days of
service in Germany and
3 months and 2 days of service in Iraq.  He also claims that the Army
Achievement Medal (AAM), Iraq Campaign Medal (ICM) and Overseas Service
Ribbon (OSR) should be added to Item 13 of the DD Form 214, and that the
National Defense Service Medal (NDSM) entry in Item 13 should reflect the
3rd Award.  He further states that the Army Medical Department (AMEDD)
Officer Basic Course (OBC) he completed in 1992 and the Combat Casualty
Care Course he completed in 1993, should be added to Item 14 of his 2006
separation document.

3.  The applicant provides the following documents in support of his
application:  Soldier Deployment History Out-processing Report, dated 10
August 2006; and
DD Forms 214, dated 11 December 1971, 6 September 1999 and 1 August 2006.

CONSIDERATION OF EVIDENCE:

1.  The applicant's record shows that he served on active duty in an
enlisted status for 1 year, 7 months and 13 days from 29 April 1970 through
11 December 1971, at which time he was honorably separated to attend
school.  The DD Form 214 he was issued at that time shows he earned the
National Defense Service Medal (NDSM), Expert Marksmanship Qualification
Badge with Rifle (M-14) Bar and Sharpshooter Marksmanship Qualification
Badge with Rifle (M-16) Bar.  It also shows that he completed 1 year, 2
months and 15 days of overseas service during the period covered by the DD
Form 214 (29 April 1970-11 December 19971).

2.  On 5 March 1992, the applicant was appointed a second lieutenant in the
United States Army Reserve (USAR), and on 4 September 1992, he entered
active duty in that status.  On 6 September 1996, he was honorably
separated.  The DD Form 214 he was issued at the time shows he earned the
Meritorious Service Medal (MSM); Army Commendation Medal (ARCOM), AAM ,
Army Good Conduct Medal (AGCM); NDSM; Army Service Ribbon (ASR), and OSR.
3.  Item 14 of the applicant's 6 September 1996 DD Form 214 shows he
completed an 11-week AMEDD OBC in 1992 and a 2-week Combat Casualty Course
in 1993.

4.  On 5 March 2004, the applicant entered active duty in the Army Nurse
Corps (ANC), in the rank of major, and was initially assigned to the 86th
Combat Support Hospital, Fort Campbell, Kentucky.

5.  An Officer Evaluation Report (OER) on file confirms the applicant's
rating for the period 29 September 2004 through 9 March 2005, included
service in Iraq as a medical surgery nurse.

6.  The applicant's Officer Records Brief (ORB), dated 9 June 2006,
indicates in Section I (Assignment Information-Overseas Duty) that he
served in Germany for 12 months through 1 December 1971.  There are no
other overseas service entries contained on the ORB.

7.  On 3 August 2006, the applicant was honorably discharged by reason of
miscellaneous/general reasons after completing 2 years, 4 months, and 1 day
of active military service during the period.  The DD Form 214 he was
issued at the time contains the entry "0000  00  00" in Item 12f and Item
13 shows he earned the following awards:  MSM; ARCOM; AGCM; NDSM (2nd
Award); Global War on Terrorism Service Medal (GWOTSM); and ASR.

8.  The applicant provides a Soldier Deployment History Out-Processing
Report, dated 10 August 2006.  This document shows that he was deployed for
92 days between 8 December 2004 and 10 March 2005.

9.  Army Regulation 635-5 (Separation Documents) prescribes the separation
documents that must be prepared for Soldiers on retirement, discharge,
release from active duty service, or control of the Active Army.  It also
establishes standardized policy for preparing and distributing the DD Form
214.  Chapter 2 contains DD Form 214 preparation instructions.  The
instructions for Item 12f state that the total amount of foreign service
completed during the period covered by the DD Form 214 will be entered.
The instructions for Item 13 state to list awards and decorations for all
periods of service.  The instructions for Item 14 (Military Education)
state to list formal in-service training courses successfully completed
during the period of service covered by the DD Form 214. The instructions
for Item 18 state that for an active duty Soldier deployed with his or her
unit during their continuous period of active service, the entry "SERVICE
IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD -
YYYYMMDD)" will be added to Item 18.

10.  Army Regulation 600-8-22 (Military Awards) contains the Army's awards
policy.  Paragraph 2-10 contains guidance on the NDSM.  It states, in
pertinent part, that it is authorized for honorable active service during
the following periods: 27 June 1950 through 27 July 1954; 1 January 1961
through 14 August 1974;
2 August 1990 through 30 November 1995; and 11 September 2001 through a
date to be determined.  It further states that a second or subsequent award
of the NDSM is authorized to members who served in one or more of the four
time periods for the award.  A second or subsequent award is recognized
with a bronze service star.

11.  Paragraph 2-17 of the awards regulation contains guidance on the Iraq
Campaign Medal (ICM).  It states, in pertinent part, that it is authorized
to members who served in Iraq on or after 19 March 2003, to a future date
to be determined by the Secretary of Defense or the cessation of Operation
Iraqi Freedom.

DISCUSSION AND CONCLUSIONS:

1.  The applicant's contention that Item 13 and Item 12f of his DD Form 214
should be corrected was carefully considered and found to have partial
merit.

2.  The evidence of record confirms the applicant completed 3 months and
2 days of overseas service in Iraq during the period covered by the DD Form
214.  Therefore, it would be appropriate to delete the current entry in
Item 12f of the applicant's 1 August 2006 DD Form 214 and to replace it
with the entry
"0000  03  02"; and by adding the entry "SERVICE IN IRAQ FROM
2004/12/08-2005/03/10" to Item 18.

3.  The applicant's record also shows that he is entitled to the 3rd Award
of the NDSM based on his service during three separate qualifying periods
for the award.  It also shows he is entitled to the Iraq Campaign Medal,
for his qualifying service in Iraq, and that he had received the AAM and
OSR during prior periods of active duty service.  Therefore, it would be
appropriate to correct Item 13 of his 1 August 2006 DD Form 214 by adding
the ICM, AAM, and OSR and by correcting the NDSM portion of the entry to
reflect his entitlement to the
3rd Award of the NDSM.

4.  By regulation, only overseas service and military courses completed
during the period covered by the DD Form 214 will be entered in Item 12f
and Item 14.  Thus, it would not be appropriate to enter the Germany
service completed by the applicant in 1971 or the courses he completed in
1992 and 1993, which were properly documented in previously issued
separation documents, to his 1 August 2006 DD Form 214.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to
warrant a recommendation for partial relief.  As a result, the Board
recommends that all Department of the Army records of the individual
concerned be corrected by amending his 1 August 2006 DD Form 214 as
follows:  Item 12f - delete the current entry and replace it with the entry
"0000  03  02"; Item 13- add the
Army Achievement Medal, Overseas Service Ribbon, Iraq Campaign Medal and
delete the current National Defense Service Medal portion of the entry and
replace it with the entry "National Defense Service Medal (3rd Award);
Item 18 - add the entry "SERVICE IN IRAQ FROM 2004/12/08-2005/03/10"; and
by providing him a correction to his separation document that includes
these changes.

2.  The Board further determined that the evidence presented is
insufficient to warrant a portion of the requested relief.  As a result,
the Board recommends denial of so much of the application that pertains to
adding Germany overseas service and military courses completed in 1992 and
1993, which were properly documented in previously issued DD Forms 214, to
Items 12f and 14 of his
1 August 2006 separation document.
