RECORD OF PROCEEDINGS
IN THE CASE OF:
BOARD DATE: 6 February 2007
DOCKET NUMBER: AR20060011450
I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual.
The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion, if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests he be reconsidered for award of the Purple Heart
2. The applicant states his reconsideration request is based on new evidence.
3. The applicant provides two "buddy statements" from individuals who claim to have served with him in Vietnam and can attest to his being wounded.
CONSIDERATION OF EVIDENCE:
1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20050016789 on 13Â July 2006.
2. The applicant's record shows he served in Vietnam from 28 November 1966 through 26 November 1967 with Company B, then Headquarters Company, 2nd Battalion, 2nd Infantry Regiment, 1st Infantry Division.
3. One witness avers he served in Vietnam from October 1966 to October 1967 in the "same company as [applicant]" and that the applicant was wounded when his Armored Personnel Carrier (APC) hit a mine. The statement does not indicate the unit involved or the date of the wounding. The statement does not indicate whether the applicant was treated for his wound.
4. The second witness avers he served in Vietnam from November 1966 to May 1967 with 2nd Battalion, 2nd Infantry Regiment. He states the applicant was in "Recon" when he knew him. He states the applicant received wounds to his right arm and knee on an unspecified date when his APC hit an anti-personnel mine. This witness does not indicate whether the applicant received treatment.
DISCUSSION AND CONCLUSIONS:
1. The applicant has submitted two witness statements written by individuals some 40 years after the fact. The statements offer no details concerning date, time, location, nor do they indicate precisely the nature of the wound(s), or whether treatment was received.
2. As stated in the previous Board Proceedings, the applicant's record is silent as to any wound received in Vietnam. Furthermore, his name does not appear on the Vietnam Casualty List, a compilation of all casualties during the Vietnam War.
3. In order to justify correction of a military record, the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy this requirement.
BOARD VOTE:
________ ________ ________ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
__jea___ __jlp___ __eem___ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis to amend the decision of the ABCMR set forth in Docket Number AR20050016789, dated 13 July 2006.

Application for correction of military records (with supporting documents provided, if any). There is no evidence in the available records which show that the applicant was awarded the Purple Heart or was wounded as a result of hostile action in Vietnam. In the absence of orders or other evidence of record showing that the applicant was injured or treated for wounds as a result of hostile action in Vietnam, the eyewitness statements provided by the applicant are not sufficient as a basis...

However, by regulation, in order to support award of the PH there must be evidence that the wound for which the award is being made was received as a result of enemy action, that the wound required treatment by military medical personnel, and a record of this medical treatment must have been made a matter of official record. The applicant's record did contain some medical treatment records; however, they failed to show that he was treated for a combat-related wound on 28 May 1967 or at...

d. On 31 January 2007, a former Soldier of the applicant's unit wrote that when he had arrived in the unit, the applicant had been wounded earlier but was back with the unit as an APC driver. e. On 9 March 2007, the applicant's former company commander wrote a letter stating that the applicant was a driver of an APC. The evidence clearly shows that the applicant was awarded an infantryman MOS and was assigned to an infantry unit of brigade, regimental, or smaller size while assigned in the...

The applicant requests he be awarded the Purple Heart and that it be added to his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge). There are no orders awarding the applicant the Purple Heart and his records do not contain evidence that he was ever wounded in action. While the Board does not question the sincerity of these statements, by themselves and without corroborating evidence, they are insufficient to establish entitlement to award of the Purple Heart.
ARMY | BCMR | CY2014 | 20140019067
In the original consideration of his case that occurred on 24 February 2000, the applicant submitted a medical statement indicating he had sustained an ear injury in October 1968 and in July 1999, officials from the Army's Personnel Command informed him that he was not authorized an award of the Purple Heart because his injury was considered accidental. Creditable witness statements indicate he received injuries from an enemy act (being blown off an APC due to a landmine explosion). As a...

Headquarters, 25th Infantry Division, General Orders (GO) Number 1055, dated 8 March 1968, awarded the applicant the Purple Heart for wounds received in action against a hostile force on 5 March 1968. The applicant's request for correction of his military service records to show he sustained a concussion and was awarded a second award of the Purple Heart was carefully considered. As a result, the Board recommends that all Department of the Army records of the individual concerned be...

A review of the medical records provided by the applicant show that on 4 June 1967 while conducting a combat sweep, the applicant was struck in the face by a tree limb while riding on an armored personnel carrier (APC) which required hospitalization and treatment. The applicantÂ’s contention that he should have been awarded the Purple Heart for his injuries in Vietnam on 4 June 1967 has been noted; however, the applicant has failed to show through the evidence submitted with his application...

The applicant states he was wounded in action in the Republic of Vietnam (RVN); however, his records do not show award of the Purple Heart. The applicant served a qualifying period of active enlisted service for the first award of the Army Good Conduct Medal from 8 November 1965 to 7 November 1968. a. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. awarding him the Purple Heart for wounds received in action in the...
