CONSIDERATION OF ADDITIONAL EVIDENCE:

32.  On 2 August 2006, new information was received from the applicant in regard to the decision of the Army Board for Correction of Military Records (ABCMR) in Docket Number AR 2000044795, dated 26 June 2001.

33.  The evidence submitted consists of the applicant's statement contending that negative security information related to his relief packet as a recruiter is still being maintained by the Program Management Division, Outsourcing Division, United States Army Recruiting Command.  The applicant further says that he was informed that they do not have to remove it.  

ADDITIONAL DISCUSSION AND CONCLUSIONS:

9.  At the time of the decision of the ABCMR in Docket Number AR 2000044795, dated 26 June 2001, it was the intent of the ABCMR to make the applicant’s record as administratively correct as it should properly have been at the time. This included the specific provision that the CID record of titling action be expunged.

10.  The ABCMR's decision in Docket Number AR 2000044795, by specifying the records involved, failed to provide for the removal of any and all related documents and information contained in electronic databases or other nonelectronic files that may adversely affect the applicant's personal security clearance determination.  In particular, it did not direct the removal of documents and electronic information pertaining to his having been relieved as a recruiter.  

11.  However, it was the ABCMR's intention to make this Soldier whole again by not only restoring him to active duty, but to restore all of his rights and privileges.  This cannot be accomplished unless all derogatory information related to this action is removed from all United States Army files (hard copy and electronic), to include those that would adversely affect his personal security clearance.

The Board determined that the evidence presented was sufficient to warrant amendment of the decision of the Army Board for Correction of Military Records set forth in Docket Number AR 2000044795, dated 26 June 2001, to show that all documents and electronic data related to this case, and in particular, those negative documents and electronic data specifically concerning or affecting the applicant's personal security status, held by all offices within the United States Army, but most particularly by the United States Army Recruiting Command, be removed, deleted, or otherwise destroyed.
