THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, reconsideration of the award of the Bronze Star Medal (BSM).  He further requests that his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) be reissued with his correct awards, to include the BSM.

2.  The applicant provides a copy of General Orders Number 7950, dated
22 October 1968; a copy of the BSM award certificate; and a copy of the narrative citation, which he maintains were attached to his original application. 

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20050015544 on 11 May 2006.

2.  The applicant’s original packet does not show General Orders Number 7950 as one of the documents provided in his application to the Board.  

3.  Headquarters, 101st Airborne Division General Orders Number 7950, dated 22 October 1968, shows that the applicant was awarded the BSM for meritorious service in connection with military operations against a hostile force.  The date of the action was listed as 1 January 1968 to 31 August 1968.  The certificate was dated 22 October 1968.

4.  The applicant’s records contain one DD Form 215 (Correction to DD Form 214).

5.  Army Regulation 635-5 (Personnel Separations) establishes standardized procedures for preparation and distribution of the DD Form 214.  The regulation states, in pertinent part, that once a DD Form 214 has been issued, do not reissue the form except when it is determined that the original DD Form 214 cannot be properly corrected by issuance of a DD Form 215 or if the correction would require issuance of more than two DD Forms 215. 

DISCUSSION AND CONCLUSIONS:

1.  The BSM orders and certificate are sufficient evidence to correct the applicant’s records to show this award.

2.  Evidence of record shows that the applicant was issued one DD Form 215. Therefore, his records can be properly corrected with the issuance of another  DD Form 215.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant amendment of the ABCMR’s decision in Docket Number AR AR20050015544, dated 11 May 2006.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing he was awarded the BSM.

2.  The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to reissuing a new DD Form 214.
