THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that his records be corrected to show he requested an extension of entitlement to shipment of his household goods.

2.  The applicant states that he was experiencing a family problem and it slipped his mind to request an extension for shipment of his household goods.  He states it was also partially his fault due to the fact he was unaware he was supposed to request an extension.  He thought the move was there for him as long as he used it within five years of retirement.  He states he was not able to find a job at his home of record until now.  It would be financially impossible for him to take his family home now and to act on that opportunity.  

3.  The applicant provides a supplemental letter; his retirement orders; his DD Form 214 (Certificate of Release or Discharge from Active Duty); and e-mails regarding his request for shipping entitlement reinstatement.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 18 September 1984 and he continued to serve on active duty through a series of reenlistments.

2.  Headquarters, U.S. Army Garrison, Fort Meade, Maryland Orders 061-0002, dated 1 March 2004, released the applicant from active duty on 30 September 2004 and on the following date, placed him on the retired list.  The additional instructions on the orders indicated that he was authorized to ship his household goods to his home of selection within one year of his separation.  He was entitled to one year, non-temporary, storage of his household goods.  His home of record was indicated as Lynnwood, Washington.

3.  The applicant submitted statements in support of his claim.  He stated he attempted to move from Edgewood, Maryland to his home in Lynnwood, Washington, but he was told that he no longer had that option because he had not made a request to extend this entitlement.  He was going through some family problems during this time and, due to the emotional stress, he neglected to turn in his extension in September 2005.  He was told by transportation that he had up to five years to use this move and it had only been two years.  He would like reinstatement of his move entitlement.  

4.  Paragraph U5365 of the Joint Federal Travel Regulation states a member is required to contact a Transportation Office for an extension prior to the 1st anniversary date of his or her retirement.  A member is required to request an extension yearly.  Travel and transportation entitlements expire 6 years from the date of retirement.  

DISCUSSION AND CONCLUSIONS:

1.  The applicant was released from active duty on 30 September 2004 and placed on the retired list on 1 October 2004.  He did not use his shipment entitlement of his household goods.  He stated that due to family problems, he neglected to request an extension of his shipment entitlement of his household goods.

2.  It would be equitable to correct his records to show he requested, and received, an extension of his shipment entitlement of his household goods on 1 September 2005 and 1 September 2006.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing he requested, and received, an extension of his shipment entitlement of household goods on 1 September 2005 and 1 September 2006.
