CONSIDERATION OF ADDITIONAL EVIDENCE:

22.  On 19 July 2006, new information was received from the applicant in regard to the decision of the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20040003371, dated 17 February 2005.

23.  The evidence submitted consists of a time line of events, unit manning rosters, military orders, memorandums, a copy of his promotion packet, officer evaluation reports, and his college transcript.  

24.  In the processing of this case, a staff advisory opinion was obtained from the Chief, Personnel Division, National Guard Bureau, 111 South George Mason Drive, Arlington, Virginia 22204-1382.  Based upon a directive from the Army Review Boards Agency to amend the applicant's date of rank to first lieutenant from 19 June 2002 to 15 December 2000, it opined that the applicant's records should be forwarded to a Special Selection Board (SSB) for promotion consideration to captain under the 2003 promotion criteria.   

ADDITIONAL DISCUSSION AND CONCLUSIONS:

8.  At the time of the decision of the ABCMR in Docket Number AR20040003371, dated  17 February 2005, it was the intent of the ABCMR to make the applicant’s record as administratively correct as it should properly have been at the time.

9.  The ABCMR's decision in Docket Number AR20040003371 failed to direct that the applicant's records be submitted for consideration by an SSB for promotion consideration to captain under to 2003 promotion criteria.

2.  The Board determined that the evidence presented was sufficient to warrant amendment of the decision of the Army Board for Correction of Military Records set forth in Docket Number AR20040003371, dated 17 February 2005, to show that the applicant's records should be submitted to a Special Selection Board for promotion consideration to captain under the 2003 promotion criteria.
