The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, that item 13 (Decorations, Medals,
Badges, Citation and Campaign Ribbons Awarded or Authorized), of his DD
Form 214 (Certificate of Release or Discharge from Active Duty), dated
17 September 2005, be corrected to show all awards and decorations to which
he is entitled.
2. The applicant states, in effect, that item 18 (Remarks), of his DD Form
214, has errors. He states that he has never served in Korea, Honduras, or
Bosnia.
3. The applicant provides a copy of his DD Form 214, dated 17 September
2005.
CONSIDERATION OF EVIDENCE:
1. The applicant is currently serving in the Texas Army National Guard
(TXARNG), in the pay grade of E-4.
2. The applicant's DD Form 214, dated 17 September 2005, shows he was
ordered to active duty on 15 August 2004 and was released from active duty
on 17 September 2005.
3. Item 12f (Foreign Service), of the applicant's DD Form 214, shows the
entry
"00 07 27" (7 months and 27 days). Item 18, of the applicant's DD Form 214
shows the entry, "Imminent Danger Pay Area IRAQ from 030406 (6 April 2003)
to 030806 (6 August 2003) // 031213 (13 December 2003) to 040213
(13 February 2004) // 050301 (1 March 2005) to 050610 (10 June 2005)." It
is apparent the applicant received Imminent Danger Pay for 9 months for his
service in IRAQ: however, the dates of his service there are not available.
4. Item 13, of his DD Form 214, shows he was awarded the Army Achievement
Medal (2nd Award), the National Defense Service Medal (2nd award), the Army
Service Ribbon, the Armed Forces Reserve Medal with Device"M" (2nd Award),
the Parachutist Badge, the Global War on Terrorism Service Medal, and the
Iraq Campaign Medal. His DD Form 214 shows no additional awards.
5. Item 18, of his DD Form 214, shows the entry "Service in Korea from
970323 (23 March 1997) to 980322 (22 March 1998)// Honduras from 010327
(27 March 2001) to 28 July 2001 (28 July 2001)//Bosnia from 010729 (29 July
2001) to 011003 (3 October 2001)."
6. Item 5 (Overseas Service), of the applicant’s DA Form 2-1 (Personnel
Qualification Record - Part II), is blank. In his application to the
Board, the applicant states, "I have never served in Korea, Honduras, or
Bosnia."
7. Army Regulation 635-5 establishes the standardized policy for preparing
and distributing the DD Form 214. In pertinent part, it directs that
foreign service performed during the period covered by the DD Form 214 will
be entered in item
12f. The regulation also states that the amount of foreign service will be
taken from the Soldier’s Enlisted Qualification Record or, if necessary,
verified from the Soldier’s Military Personnel Records Jacket. However,
for active duty Soldiers deployed with their unit during their continuous
period of active service, the entry "SERVICE IN (NAME OF COUNTRY DEPLOYED)
from (Inclusive dates, for example, YYYYMMDD-YYYYMMDD) will be entered in
item 18 (Remarks), of the DD Form 214.
8. Army Regulation (AR) 15-185, states, in effect, that the ABCMR will
consider individual applications that are properly brought before it. The
ABCMR will decide cases on the evidence of record – evidence that is
submitted by applicants in support of their issue and evidence that is
contained in their service personnel records. It is not an investigative
body.
DISCUSSION AND CONCLUSIONS:
1. There is no evidence, and the applicant has provided none to show that
he was awarded any additional awards or decorations during the period
15 August 2004 to 17 September 2005.
2. The evidence of record corroborated the applicant's statement that he
never served in Korea, Honduras, or Bosnia. Therefore, the entries located
in item 18, of his DD Form 214, dated 17 September 2005, pertaining to his
service in Korea, Honduras, and Bosnia, should be removed entirely.
3. Item 12f, of his DD Form 214, shows foreign service of 7 months and
7 days. The number of months during which the applicant was paid imminent
danger pay total 9 months. However, with the available information in his
service records, and the information provided by the applicant, a further
correction (to include the data specified in Paragraph 7 above) can not be
made to the applicant's DD Form 214.

BOARD DETERMINATION/RECOMMENDATION:
1. The Board determined that the evidence presented was sufficient to
warrant a recommendation for partial relief. As a result, the Board
recommends that all Department of the Army records of the individual
concerned be corrected by removing the entries:
a. service in Korea from 970323 (23 March 1997) to 980322 (22 March
1998);
b. service in Honduras from 010327 (27 March 2001) to 28 July 2001
(28 July 2001); and
c. service in Bosnia from 010729 (29 July 2001) to 011003 (3 October
2001) in item 18 (Remarks), of his DD Form 214, dated 17 September 2005.
2. The Board further determined that the evidence presented is
insufficient to warrant a portion of the requested relief. As a result,
the Board recommends denial of so much of the application that pertains to
correction of item 13, of his DD Form 214, to show any additional awards.
