      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that the separation documents of his deceased
father, a former service member (FSM), be corrected to show his awards of
the Master Aviator Badge, the Legion of Merit (LOM), the Army Reserve
Components Overseas Training Ribbon (ARCOTR), the Meritorious Unit
Commendation (MUC) and the Republic of Vietnam Gallantry Cross with Palm
(RVNGC w/Palm) Unit Citation.

2.  The applicant states, in effect, that his father was awarded those
awards but they were never included on his separation documents.

3.  The applicant provides a copy of the FSM’s death certificate, orders
designating the FSM as a Master Army Aviator, award of the LOM, orders
transferring the FSM to Germany for active duty training (ADT), a report of
separation (DD Form 214) dated 12 December 1969, and two General Orders
awarding the MUC and the RVNGC w/Palm Unit Citation.

CONSIDERATION OF EVIDENCE:

1.  The FSM was born on 15 July 1934 and was inducted in Cincinnati, Ohio
on 6 March 1953.  He completed his training and served overseas for 11
months and 29 days.  He served in Korea with the 25th Medical Battalion and
was awarded the National Defense Service Medal, the Korea Service Medal
(KSM) and the United Nations Service Medal.  He was honorably released from
active duty (REFRAD) on 26 February 1955 and was transferred to the United
States Army Reserve (USAR) to complete his 8-year statutory obligation.


2.  He enlisted in the Kansas Army National Guard (KSARNG) on 1 November
1956 and on 21 November 1961, he was commissioned as a second lieutenant in
the KSARNG.  He was promoted to the rank of captain on 1 December 1966 and
on 13 May 1968, he was ordered to active duty and was transferred to
Vietnam as an aviation officer with Headquarters and Headquarters
Detachment, 58th Transportation Detachment.  He served 11 months and 25
days in Vietnam and was honorably REFRAD at Fort Riley, Kansas on 12
December 1969.  He was transferred to the KSARNG and his DD Form 214 issued
at the time of his REFRAD shows that he was awarded the Republic of Vietnam
Campaign Medal (RVNCM), the Vietnam Service Medal (VSM), the National
Defense Service Medal NDSM), the Armed Forces Reserve Medal (AFRM), the
United Nations Service Medal (UNSM), the Army Commendation Medal (ARCOM),
the Bronze Star Medal (BSM), and the Air Medal (AM).

3.  He continued to serve in the KSARNG and was issued a Notification of
Eligibility for Retired Pay at Age 60 (20-Year Letter) on 3 June 1977,
which explained that he was eligible for retired pay upon application at
age 60 ( 15 July 1994).  He attained the rank of colonel on 31 December
1980.

4.  On 15 July 1989, he was honorably discharged from the KSARNG and was
transferred to the USAR Control Group (Retired).  His NGB Form 22 shows
that he had 36 years, 4 months and 9 days of service for pay and that he
was awarded the Army Aviator Badge, the NDSM with one oak leaf cluster, the
KSM, the AFRM (second award), UNSM, VSM, the AM with numeral 6, the RVNCM,
the BSM, the ARCOM with fourth oak leaf cluster, the Senior Army Aviator
Badge, the Army Reserve Component Achievement Medal (ARCAM) with four oak
leaf clusters, the Meritorious Service Medal (MSM) with one oak leaf
cluster, the Army Service Ribbon, and several Kansas State Military awards.


5.  The FSM applied for his retired pay benefits on 22 February 1994 and
his request to be retired effective 15 July 1994 was approved.  He had over
32 creditable years of service for retired pay purposes and over 41 years
of service for pay purposes.  The FSM passed away on 5 December 1997, at
the age of 63.

6.  On 28 January 1982, the National Guard Bureau (NGB) awarded the FSM the
Master Army Aviator Badge effective 1 December 1981.

7.  On 21 April 1982, orders were published that ordered the FSM to ADT in
Germany for the purpose of attending training during the period of 13 to 22
May 1982 (10 days) plus travel time.

8.  On 2 May 1989, orders were published that awarded the FSM the LOM for
the period of 1 June 1979 to 1 June 1989.

9.  Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit
Register-Vietnam Era) was published to assist commanders and personnel
officers in determining or establishing the eligibility of individual
members for campaign participation credit, assault landing credit, and unit
citation badges awarded during the Vietnam Conflict.  Table 1 (Army Units
in Numerical Order) of the pamphlet indicates that the FSM’s unit was
subsequently awarded the Republic of Vietnam Gallantry Cross with Palm
(RVNGC w/Palm) Unit Citation and the Meritorious Unit Commendation (MUC)
during the period he was assigned to the unit.

10.  Army Human Resources Command Message (Date Time Group 9 February 2004)
published implementing instructions for award of the Korea Defense Service
Medal (KDSM).  This message specified criteria for the award of the Korea
Defense Service Medal as follows:  a) service members of the armed forces
must have served in support of the defense of the Republic of Korea from 28
July 1954 through a future date to be determined by the Secretary of
Defense;  b) the area of eligibility encompasses all land area of the
Republic of Korea, and the contiguous water out to 12 nautical miles, and
all air spaces above the land and water areas;  c) service members must
have been mobilized with units or assigned or attached to units operating
in the area of eligibility and have been physically deployed in the area of
eligibility for 30 consecutive or 60                non-consecutive days.

11.  Army Regulation 600-8-22 (Military Awards), in pertinent part,
provides for award of the Army Reserve Components Overseas Training Ribbon
(ARCOTR).  It is awarded to members of the Reserve Components of the Army,
(Army National Guard and U.S. Army Reserve), for successful completion of
annual training (AT) or active duty for training (ADT) for a period not
less than 10 consecutive duty days on foreign soil.

DISCUSSION AND CONCLUSIONS:

1.  The FSM was awarded the Master Aviator Badge and the LOM.
Additionally, his unit was awarded the MUC and the RVNGC w/Palm Unit
Citation.  Accordingly, he is entitled to have those awards reflected on
his separation documents.

2.  The FSM also performed 10 days of ADT in Germany in 1982 and thus is
entitled to award of the ARCOTR and to have it added to his records.

3.  Additionally, the FSM is eligible for award of the KDSM and to have
that award added to his records as well.

4.  Inasmuch as his last separation document was his NGB Form 22 dated
15 July 1989, it would be appropriate to correct that document to reflect
all of his awards as of the date of his last separation.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief.  As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
awarding him the ARCOTR and the KDSM and by also showing that he was
awarded the Master Aviator Badge, the LOM, the MUC and the RVNGC w/Palm
Unit Citation on his NGB Form 22 dated 15 July 1989.
