THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, that his military records be corrected to show that he was awarded the Combat Infantryman Badge.
2. The applicant essentially states that his entire infantry unit was awarded the Combat Infantryman Badge upon their redeployment from Iraq in September 2004.
3. The applicant provides his DD Form 214 (Certificate of Release or Discharge From Active Duty) in support of this application.
CONSIDERATION OF EVIDENCE:
1. The applicant is requesting correction of an alleged error which occurred on
17 January 2005, the date of his discharge from the Regular Army. The application submitted in this case is dated 5 May 2005.
2. The applicants records show that he possessed an infantry military occupational specialty (MOS) at the time of his deployment to Iraq in support of Operation Iraqi Freedom from 6 September 2003 to 6 September 2004, and that he served with Company D, 2nd Battalion, 504th Parachute Infantry Regiment (PIR). However, Item 18 (Decorations, Medals, Badges, Commendations, Citations, and Campaign Ribbons Awarded or Authorized) of the applicants
DD Form 214 does not show that he was awarded the Combat Infantryman Badge. There are also no orders in the applicants records awarding him the Combat Infantryman Badge. Additionally, there is no evidence in the available records which shows that the applicant actively engaged in ground combat during his deployment to Iraq. There is also no award citation or other document in the applicants military records which shows that he actively engaged in combat.
3. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, that the Combat Infantryman Badge is awarded to infantry officer and enlisted personnel who have an infantry MOS. They must have served in active ground combat while assigned or attached to an infantry unit of brigade, regimental or smaller size. A recipient must be personally present and under hostile fire while serving in an assigned infantry primary duty, in a unit actively engaged in ground combat with the enemy. It also states that battle or campaign participation credit alone is not sufficient.
DISCUSSION AND CONCLUSIONS:
1. The applicant contends that his military records should be corrected to show the award of the Combat Infantryman Badge.
2. Although the applicant possessed an infantry MOS and deployed to Iraq from 6 September 2003 to 6 September 2004 while serving with Company D, 2nd Battalion, 504th PIR, there is no evidence in the applicants military records which shows that he was personally present and under hostile fire while serving in an assigned infantry or special forces primary duty, in a unit actively engaged in ground combat with the enemy. Regrettably, absent this evidence, there is no basis for awarding the Combat Infantryman Badge to the applicant in this case.
