THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of an earlier request for
correction of his DD Form 214 (Report of Transfer or Discharge) to show
award of the Combat Infantryman Badge.

2.  The applicant states that he received the Combat Infantryman Badge on
the same day he was awarded the Army Commendation Medal in Vietnam;
however, his DD Form 214 does not reflect the Combat Infantryman Badge.  He
states, in effect, that his military occupational specialty (MOS) was 05B
(radio operator) and that he was assigned to Detachment B56 (also known as
Project Sigma, Studies and Observation Group), 5th Special Forces Group and
all of his missions were Top Secret in Vietnam.  He contends that he was
involved in a dozen operations on the ground and that his unit was
presented the Presidential Unit Citation for extraordinary heroism in
military operations against an armed enemy.

3.  The applicant provides an undated eyewitness statement.

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were
summarized in the previous consideration of the applicant's case by the
Army Board for Correction of Military Records (ABCMR) in Docket Number
AR20050009275 on 9 March 2006.

2.  The applicant provided an undated eyewitness statement from a fellow
Soldier at the time in question.  He attests that he and the applicant were
roommates in Vietnam while assigned to Detachment B56, 5th Special Forces
Group.  He states that the 5th Special Forces Group had three special
projects at the time, Delta Project, Sigma Project, and Omega Project.  He
further states that the applicant went out on at least 10 combat
operations, that he stood next to the applicant when the applicant was
awarded the Combat Infantryman Badge and Army Commendation Medal in
Vietnam, and that he remembers when the applicant was wounded in action on
a Top Secret operation.

3.  The applicant’s submission is new evidence which will be considered by
the Board.

4.  The applicant enlisted on 4 February 1966 for a period of 3 years.
Upon completion of basic combat training, advanced individual training, and
airborne training he was awarded MOS 05B.  He served in MOS 05B assigned to
Headquarters and Headquarters Company, (Detachment B56), 5th Special Forces
Group (Airborne), of the 1st Special Forces in Vietnam from 22 December
1967 until he was wounded in action on 12 May 1968 and transferred to the
United States on 30 May 1968 for further medical treatment.  On 1 October
1968, the applicant was released from active duty.

5.  The applicant’s DD Form 214 shows the Parachutist Badge, the National
Defense Service Medal, the Vietnam Service Medal, the Army Commendation
Medal for meritorious achievement in connection with military operations
against a hostile force, the Bronze Star Medal for meritorious service in
connection with military operations against a hostile force, the Purple
Heart, and the Expert Marksmanship Qualification Badge with Rifle Bar as
authorized awards.

6.  There are no orders for the Combat Infantryman Badge in the available
records.

7.  A DD Form 215 (Correction to DD Form 214), dated 26 May 2006, amended
the applicant’s DD Form 214 to add the Vietnam Service Medal with one
bronze service star, the Good Conduct Medal, the Presidential Unit
Citation, the Republic of Vietnam Gallantry Cross with Palm Unit Citation
Badge, the Meritorious Unit Commendation, and the Republic of Vietnam Civil
Actions Honor Medal First Class Unit Citation Badge.

8.  Army Regulation 600-8-22 (Military Awards) provides, in pertinent part,
that the Combat Infantryman Badge is awarded to infantry officers and to
enlisted and warrant officer persons who have an infantry MOS.  They must
have served in active ground combat while assigned or attached to an
infantry unit of brigade, regimental or smaller size.  The Awards Branch of
the U.S. Army Human Resources Command has advised, in similar cases, that
during the Vietnam era the Combat Infantryman Badge was awarded only to
enlisted individuals who held and served in MOS 11B, 11C, 11F, 11G, or 11H.

9.  U.S. Army Vietnam (USARV) Regulation Number 672-1 (Awards and
Decorations) provided, in pertinent part, for award of the Combat
Infantryman Badge.  Appendix 3 to Annex A of this regulation listed
positions which qualified for award of the Combat Infantryman Badge.  The
regulation authorized award of the Combat Infantryman Badge to individuals
in certain listed positions considered infantry positions to include
Province Senior Advisor, operations advisor, and radio operators provided
their primary duty was to accompany infantry or infantry-type units on
tactical operations.




DISCUSSION AND CONCLUSIONS:

1.  Evidence of record shows the applicant held and served in MOS 05B while
assigned to the Special Forces in Vietnam.  Evidence of record also shows
that he was awarded the Bronze Star Medal for meritorious service in
connection with military operations against a hostile force and the Army
Commendation Medal for meritorious achievement in connection with military
operations against a hostile force.  His unit received the Presidential
Unit Citation.  In addition, he was wounded in action.

2.  Although the Combat Infantryman Badge was not specifically authorized
for Special Forces personnel until 1989, USARV Regulation Number 672-1
authorized the Combat Infantryman Badge to certain individuals in infantry-
type units, to include radio operators who accompanied that infantry-type
unit on tactical operations.

3.  All of the above information, combined with the eyewitness statement,
is sufficient evidence on which to amend his DD Form 214 to show the Combat
Infantryman Badge.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
amendment of the ABCMR’s decision in Docket Number AR20050009275, dated 9
March 2006.  As a result, the Board recommends that all Department of the
Army records of the individual concerned be corrected by amending his DD
Form 214 to show award of the Combat Infantryman Badge.
