      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of item 13 (Decorations, Medals,
Badges, Citations and Campaign Ribbons Awarded or Authorized) on his DD
Form 214 (Certificate of Release or Discharge from Active Duty) be
corrected to show five awards of the Army Achievement Medal.

2.  The applicant states that two awards of the Army Achievement Medal were
given to him after his DD Form 214 was issued.

3.  The applicant provides a copy of his DD Form 214 and five award
certificates for the Army Achievement Medal.

CONSIDERATION OF EVIDENCE:

1.  The applicant initially enlisted in the Regular Army on 27 July 2000.
He completed basic training at Fort Knox, Kentucky and was reassigned to
Fort Gordon for advanced individual training (AIT).  Upon successful
completion of AIT, he was awarded military occupational specialty 31L
(Cable Systems Installer).

2.  The applicant was awarded the Army Achievement Medal by Headquarters,
304th Signal Battalion, Camp Colbern, Korea Permanent Orders Number
152-002, dated 1 June 2001, for meritorious achievement during the period
    11 April 2001 to 26 April 2001.

3.  The applicant was awarded the Army Achievement Medal by Headquarters,
304th Signal Battalion, Camp Colbern, Korea Permanent Orders Number
270-002, dated 27 September 2001, for meritorious service during the period

10 August 2001 to 31 August 2001.

4.  Headquarters, 40th Signal Battalion, Fort Huachuca, Arizona Permanent
Orders Number 02-331-01, dated 27 November 2002, show the applicant
received the Army Achievement Medal for meritorious achievement during the
period 12 November 2002 to 16 November 2002.

5.  Headquarters, 11th Signal Brigade, Fort Huachuca, Arizona Permanent
Orders Number 145-01, dated 25 May 2003, show  the applicant received the
Army Achievement Medal for meritorious service during the period 7 January
2003 to 16 June 2003.


6.  Headquarters, 504th Signal Battalion, 11th Signal Brigade, Fort
Huachuca, Arizona Permanent Orders Number 106-03, dated 15 April 2004, show
the applicant received the Army Achievement Medal for outstanding service
during the period 3 January 2002 to 8 July 2004 (this period completely
overlaps that shown on Headquarters, 40th Signal Battalion, Fort Huachuca,
Arizona Permanent Orders Number 02-331-01, dated 27 November 2002 (for
achievement) and on Headquarters, 11th Signal Brigade, Fort Huachuca,
Arizona Permanent Orders Number 145-01, dated 25 May 2003 (for service)).

7.  The applicant was honorably released from active duty on 8 July 2004.
His DD Form 214 shows three awards of the Army Achievement Medal.

8.  Paragraph 1-18 of Army Regulation 600-8-22 states that only one
decoration will be awarded to an individual for the same act, achievement,
or period of meritorious service.

DISCUSSION AND CONCLUSIONS:

1.  Orders show the applicant received five awards of the Army Achievement
Medal, two awards for achievement and three awards for meritorious service.

2.  Since the second and third awards for meritorious service are for
overlapping dates of service, only one of these awards is valid in
accordance with the governing regulation.  Therefore, the applicant is
entitled to one additional award of the Army Achievement Medal and
correction of his DD Form 214 to reflect a total of four awards of the Army
Achievement Medal.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to
warrant a recommendation for partial relief.  As a result, the Board
recommends that all Department of the Army records of the individual
concerned be corrected by:

      a.  deleting the Army Achievement Medal (Third Award) from item 13 on
his DD Form 214; and

      b.  adding the Army Achievement Medal (Fourth Award) to item 13 on
his DD Form 214.

2.  The Board further determined that the evidence presented is
insufficient to warrant a portion of the requested relief.  As a result,
the Board recommends denial of so much of the application that pertains to
showing five awards of the Army Achievement Medal.
