      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of
Release or Discharge from Active Duty) to show award of the Army
Commendation Medal (ARCOM), the ARCOM with “V” Device, the Combat Action
Badge (CAB), and the Iraq Campaign Medal.

2.  The applicant states he went on terminal leave and was awarded medals
prior to his expiration of term of service.

3.  The applicant provides a copy of his DD Form 214;two DA Forms 638
(Recommendation for Award); and two award certificates for the ARCOM.

CONSIDERATION OF EVIDENCE:

1.  The applicant is requesting correction of his records to show award of
the CAB.  The U.S. Army Human Resources Command provided processing
procedures for award of the CAB on 3 June 2005.  The applicant has been
notified by separate correspondence of the procedures for applying for this
badge.  As a result, the CAB will not be discussed further in this Record
of Proceedings.

2.  The applicant enlisted in the Regular Army on 15 November 2001.  He
completed the required training and was awarded military occupational
specialty 19K (M1 Abrams Armor Crewman).

3.  His DD Form 214 shows he served in Iraq from 12 May 2003 through 17
July 2004.

4.  Headquarters, 2nd Armored Cavalry Regiment, Permanent Orders Number 362-
45 dated 28 December 2003 awarded the applicant the ARCOM for meritorious
service from 11 May 2003 to 15 April 2004.

5.  Headquarters, 2nd Armored Cavalry Regiment, Permanent Orders Number 167-
31 dated 16 June 2004 awarded the applicant the ARCOM with “V” Device for
actions during 14 May 2004 to 14 May 2004.

6.  The applicant was honorably released from active duty on 14 November
2004.  His DD Form 214 shows he was awarded the Army Achievement Medal
(Fourth Award), the Army Good Conduct Medal, the National Defense Service
Medal, the Army Service Ribbon, the Overseas Service Ribbon, the Army Lapel
Button, the Global War on Terrorism Expeditionary Medal, and the Global War
on Terrorism Service Medal.
7.  Military Awards Branch Message [dated 8 April 2005] provided the
following implementing instructions for award of the Iraq Campaign Medal.
Award of the Iraq Campaign Medal is authorized for service in direct
support of Operation Iraqi Freedom on or after 19 March 2003 to a future
date to be determined by the Secretary of Defense or the cessation of the
operation.  The area of eligibility encompasses all land area of the
country of Iraq and the contiguous sea area out to 12 nautical miles and
the air space above these areas.  To qualify for award of this campaign
medal, service members must have been assigned or attached to or mobilized
with units operating in these areas of eligibility for 30 consecutive days
or for 60 non-consecutive days or meet one of the following criteria:  a)
be engaged in combat during an armed engagement, regardless of the time in
the area of eligibility; b) be medically evacuated from the area of
eligibility for wounds or injuries resulting from participation in an
operation or official duties; or
c)  participates as a regularly assigned air crewmember flying sorties
into, out of, within or over the area of eligibility in direct support of
the military operations [each day of operations counts as one day of
eligibility].  This campaign medal may be awarded posthumously.

8.  Only one award of the Iraq Campaign Medal may be authorized for any
individual.  Service stars are not prescribed for wear with this medal;
however, the Iraq Campaign Medal may be awarded with the bronze arrowhead
device to eligible Soldiers.  Effective 30 April 2005, the Global War on
Terrorism Expeditionary Medal (GWOTEM) is no longer authorized to be
awarded for service in Iraq; however, service members who qualified for the
GWOTEM by reason of service between 19 March 2003 and 30 April 2005 in an
area for which the Iraq Campaign Medal was subsequently authorized shall
remain qualified for the GWOTEM.  Upon application, any such service member
may be awarded the Iraq Campaign Medal in lieu of the GWOTEM for such
service; however, no service member shall be entitled to award of the Iraq
Campaign Medal and the GWOTEM for the same act, achievement or period of
service.

9.  In a 26 July 2006 email to the applicant, the Board analyst informed
him that he had to decide whether to receive the Iraq Campaign Medal in
lieu of the GWOTEM for his service in Iraq.  The applicant elected to keep
award of the GWOTEM.

DISCUSSION AND CONCLUSIONS:

1.  The applicant was awarded two awards of the ARCOM, one for meritorious
service and one for valor.  Therefore, his DD Form 214 should be corrected
to show these awards.

2.  Military Awards Branch Message dated 8 April 2005 directs that no
service member shall be entitled to award of the Iraq Campaign Medal and
the GWOTEM for the same act, achievement or period of service.  The
applicant stated that he preferred to keep award of the GWOTEM in lieu of
award of the Iraq Campaign Medal.  Therefore, there is no basis for
correcting his DD Form 214 to show the Iraq Campaign Medal.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to
warrant a recommendation for partial relief.  As a result, the Board
recommends that all Department of the Army records of the individual
concerned be corrected by showing he was awarded the ARCOM (First Oak Leaf
Cluster) with “V” Device.

2.  The Board further determined that the evidence presented is
insufficient to warrant a portion of the requested relief.  As a result,
the Board recommends denial of so much of the application that pertains to
showing award of the Iraq Campaign Medal.
