                            RECORD OF PROCEEDINGS

      IN THE CASE OF:

      BOARD DATE: 25 July 2006
      DOCKET NUMBER: AR20050017721

I certify that hereinafter is recorded the true and complete record
of the proceedings of the Army Board for Correction of Military Records in
the case of the above-named individual.

| |Mr. Carl W. S. Chun | |Director |
| |Mr. Jessie B. Strickland | |Analyst |

The following members, a quorum, were present:

| |Mr. Allen L. Raub | |Chairperson |
| |Ms. LaVerne Douglas | |Member |
| |Ms. Peguine M. Taylor | |Member |

The Board considered the following evidence:

Exhibit A - Application for correction of military records.

Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests that his report of separation (DD Form 214)
dated 15 August 1995 be corrected to reflect all of his service.

2. The applicant states that his DD Form 214 dated 15 August 1995 does
not reflect all of his service.

3. The applicant provides a copy of his DD Form 214 and the first page of
his enlistment contract dated 30 March 1994.

CONSIDERATION OF EVIDENCE:

1. The applicant enlisted in the United States Army Reserve on 30 March
1994 for a period of 8 years, training as a food service specialist under
the alternate training program and an enlistment bonus.

2. He entered active duty for training (ADT) on 3 June 1994 and was
transferred to Fort Jackson, South Carolina, where he attended his basic
combat training. After serving 2 months and 3 days of active service, he
was returned to his USAR unit in South Carolina.

3. On 15 June 1995, he was ordered to ADT and was transferred to Fort Lee,
Virginia, to undergo his advanced individual training (AIT) as a food
service specialist. After serving 2 months and 1 day of ADT, he was
released from ADT (REFRADT) on 15 August 1995 and was returned to his unit.
His DD Form 214 issued at the time of his REFRADT shows that he had served
2 months and 1 days of active service during his current period of ADT and
2 months and 3 days of active service during his previous period of ADT
(basic training). It also reflects that he had served 1 year and 12 days
of prior inactive service.

4. Army Regulation 635-5 serves as the authority for the preparation of
the DD Form 214. It provides, in pertinent part, that the DD Form 214 will
be prepared to reflect information as it exists at the time of separation.
Changes that occur subsequent to the separation date will not be entered on
the DD Form 214.

DISCUSSION AND CONCLUSIONS:

1. While the applicant has not explained what service is not reflected on
his DD Form 214, there appears to be no basis to change the information
contained on his DD Form214. The applicant served 1 year, 4 months and 15
days of active and inactive service from the time of his enlistment on 30
March 1994 until his REFRADT on 15 August 1995, which accounts for the
entire time he was in the USAR up until that date.

2. Inasmuch as all of his time is accounted for on the DD Form 214, there
appears to be no basis to change that form.

3. In order to justify correction of a military record the applicant must
show or it must otherwise satisfactorily appear, that the record is in
error or unjust. The applicant has failed to submit evidence that would
satisfy this requirement.

BOARD VOTE:

________ ________ ________ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable
error or injustice. Therefore, the Board determined that the overall
merits of this case are insufficient as a basis for correction of the
records of the individual concerned.
