The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of item 11 (Primary Specialty) on his
DD Form 214 (Certificate of Release or Discharge from Active Duty) to show
his primary military occupational specialty (PMOS) as 13E (Field Artillery
Cannon Fire Direction Specialist); correction of item 12f (Foreign Service)
to show his deployment in support of Operation Iraqi Freedom; correction of
item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons
Awarded or Authorized) to show the Army Commendation Medal (ARCOM); and
correction of item 14 (Military Education) to show he completed the Unit
Armorer Course and the Combat Lifesavers Course.
2. The applicant states, in effect, that these errors should be corrected
on his DD Form 214.
3. The applicant provides three Certificates of Training; his diploma from
the U.S. Army Field Artillery School; his separation orders; his DD Form
214; and a DA Form 638 (Recommendation for Award).
CONSIDERATION OF EVIDENCE:
1. The applicant served in support of Operation Iraqi Freedom.
2. The applicant enlisted in the Regular Army on 23 April 2002 for a
period of three years.
3. One of the applicant's Certificates of Training shows he completed 80
hours of training at a Ten-Day Unit Armorer Course in Fort Hood, Texas
during the period 19 November 2002 through 4 December 2002.
4. Another one of his Certificates of Training shows he successfully
completed 40 hours of training in the Combat Lifesavers Course from 9
December to 13 December 2002 at Fort Hood, Texas.
5. The applicant’s DA Form 638 dated 7 June 2003 shows he was awarded the
ARCOM by Headquarters, Division Artillery Europe Permanent Orders Number
284-114 dated 1 November 2003 for meritorious achievement from 29 March
2003 to 30 September 2003. Achievement Number 1 under Part III
(Justification and Citation Data) of the DA Form 638 describes the
applicant's outstanding achievement during Operation Iraqi Freedom.
6. His Enlisted Record Brief dated 10 November 2004 shows his PMOS as 13E.
7. Information obtained from the Defense Finance and Accounting Service
(DFAS) on 8 June 2006 revealed the applicant received hostile fire pay from
April 2003 through March 2004.
8. The applicant was honorably released from active duty on 22 April 2005.
9. Item 11 on his DD Form 214 shows the entry "13B1O 00 CANNON CREWMEMBER
- - 2 YRS – 7 MOS//NOTHING FOLLOWS."
10. Item 12f on his DD Form 214 does not show any foreign service and item
18 does not show he served in support of Operation Iraqi Freedom.
11. Item 13 on his DD Form 214 shows he was awarded the Army Lapel Button,
the Global War on Terrorism Service Medal, the National Defense Service
Medal, and the Army Service Ribbon.
12. Item 14 on his DD Form 214 shows the entry “NONE//NOTHING FOLLOWS.”
13. Army Regulation 635-5 (Separation Documents) governs the preparation
of the DD Form 214. It states that the DD Form 214 is a synopsis of the
Soldier's most recent period of continuous active duty. It provides a
brief, clear-cut record of active Army service at the time of release from
active duty, retirement or discharge. In pertinent part, it directs that
the titles of all MOS or area of concentration (AOC) served in for at least
one year will be entered in item 11 and will include the number of years
and months served.
14. Army Regulation 635-5 directs that foreign service performed during
the period covered by the DD Form 214 will be entered in item 12f.
15. Army Regulation 635-5 states that item 14 will list formal in service
training courses of 40 hours or more successfully completed during the
period of service covered by title, length in weeks, and month and year
completed. This information is to assist the Soldier after separation in
job placement and counseling; therefore, training courses for combat skills
are not listed.
16. Informal research revealed that the Combat Lifesaver course is a basic
medical care course for unit nonmedical personnel.
17. Army Regulation 635-5 states that item 18 (Remarks) is used for
entries required by Headquarters, Department of the Army for which a
separate block is not available and for completing entries that are too
long for their blocks.
Paragraph 18(f)(2) states that the entry, "SERVICE IN (NAME OF COUNTRY
DEPLOYED) FROM (inclusive dates)" will be entered in item 18 for active
duty Soldiers deployed to a foreign country with their unit.
18. Human Resources Command Message (Date Time Group 17 March 2004)
disseminated implementing instructions for award of the Global War on
Terrorism Expeditionary Medal (GWOTEM) for Soldiers who deploy abroad for
service in the Global War on Terrorism Operations on or after 11 September
2001 to a date to be determined. To be eligible for this award a Soldier
must be mobilized with or assigned or attached to a unit participating in
designated operations for 30 consecutive days or for 60 nonconsecutive days
in the areas of eligibility designated, or must meet one of the following
criteria: a) be engaged in actual ground combat against the enemy and under
circumstances involving grave danger of death or serious bodily injury from
enemy action, regardless, of the time in the area of eligibility; b) while
participating in the designated operation, regardless of time, is killed or
wounded/injured requiring medical evacuation from the area of eligibility,
or c) participate as a regularly assigned air crew member flying sorties
for 30 consecutive days or 60 nonconsecutive days into, out of, within, or
over the area of eligibility in direct support of Operations Enduring
Freedom and/or Iraqi Freedom. The message also states that under no
condition will any Soldier in the United States receive this award.
19. Military Awards Branch Message [dated 8 April 2005] provided the
following implementing instructions for award of the Iraq Campaign Medal.
Award of the Iraq Campaign Medal is authorized for service in direct
support of Operation Iraqi Freedom on or after 19 March 2003 to a future
date to be determined by the Secretary of Defense or the cessation of the
operation. The area of eligibility encompasses all land area of the
country of Iraq and the contiguous sea area out to 12 nautical miles and
the air space above these areas. To qualify for award of this campaign
medal, service members must have been assigned or attached to or mobilized
with units operating in these areas of eligibility for 30 consecutive days
or for 60 non-consecutive days or meet one of the following criteria: a)
be engaged in combat during an armed engagement, regardless of the time in
the area of eligibility; b) be medically evacuated from the area of
eligibility for wounds or injuries resulting from participation in an
operation or official duties; or
c) participates as a regularly assigned air crewmember flying sorties
into, out of, within or over the area of eligibility in direct support of
the military operations [each day of operations counts as one day of
eligibility]. This campaign medal may be awarded posthumously.
20. Only one award of the Iraq Campaign Medal may be authorized for any
individual. Service stars are not prescribed for wear with this medal;
however, the Iraq Campaign Medal may be awarded with the bronze arrowhead
device to eligible Soldiers. Effective 30 April 2005, the GWOTEM is no
longer authorized to be awarded for service in Iraq; however, service
members who qualified for the GWOTEM by reason of service between 19 March
2003 and 30 April 2005 in an area for which the Iraq Campaign Medal was
subsequently authorized shall remain qualified for the GWOTEM. Upon
application, any such service member may be awarded the Iraq Campaign Medal
in lieu of the GWOTEM for such service; however, no service member shall be
entitled to award of the Iraq Campaign Medal and the GWOTEM for the same
act, achievement or period of service.
21. The applicant elected to be awarded the Iraq Campaign Medal on 11 July
2006 by phone conversation with the Board analyst. He also informed the
Board analyst that he served in Iraq from 16 April 2003 to 13 April 2004.
DISCUSSION AND CONCLUSIONS:
1. The evidence of record shows the applicant completed training in PMOS
13E (Field Artillery Cannon Fire Direction Specialist) in August 2002. His
Enlisted Record Brief shows his PMOS as 13E. It appears he continued to
serve in PMOS 13E until the time of his release from active duty on 22
April 2005. However, his DD Form 214 was prepared to reflect he served in
PMOS 13B for 2 years and 7 months. It appears an administrative error has
occurred in this case and it would be appropriate to amend item 11 on his
DD Form 214 to reflect his PMOS as 13E.
2. Although the applicant informed the Board analyst that he served in
Iraq from 16 April 2003 to 13 April 2004, his military pay records at DFAS
show he received hostile fire pay from April 2003 to March 2004. As a
matter of equity, it would be appropriate to amend item 12f on his DD Form
214 to reflect 11 months and 16 days of foreign service to cover the period
16 April 2003 to 31 March 2004.
3. Based on the applicant’s service in Iraq, item 18 on his DD Form 214
should be amended to show the entry “SERVICE IN IRAQ FROM 16 APRIL 2003 TO
31 MARCH 2004.”
4. The applicant served a period of qualifying service in support of
Operation Iraqi Freedom for award of the GWOTEM and the Iraq Campaign
Medal. However, Military Awards Branch Message dated 8 April 2005 directs
that no service member shall be entitled to award of the Iraq Campaign
Medal and the GWOTEM for the same act, achievement or period of service.
The applicant stated that he preferred award of the Iraq Campaign Medal in
lieu of the GWOTEM. Therefore, his DD Form 214 should be amended to show
the Iraq Campaign Medal.
5. The applicant was awarded the ARCOM for meritorious achievement from
29 March 2003 to 30 September 2003. Therefore, the ARCOM should be added
to his DD Form 214.
6. The applicant completed a Ten-Day Unit Armorer Course in December 2002.
Therefore, this course should be added to his DD Form 214.
7. The applicant completed the Combat Lifesavers Course in December 2002.
It appears that the Combat Lifesavers Course was a basic medical care
course for nonmedical unit personnel. Since it was not strictly a combat
training course, it would be appropriate to add this course to his DD Form
214.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief. As a result, the Board recommends that the DD
Form 214 of the individual concerned be corrected by:
a. deleting the entry "13B1O 00 CANNON CREWMEMBER - - 2 YRS –
7 MOS//NOTHING FOLLOWS" from item 11;
b. adding the entry "13E1O 00 Field Artillery Cannon Fire Direction
Specialist - - 2 YRS – 7 MOS//NOTHING FOLLOWS" to item 11;
c. adding the entry “0000 11 16” to item 12f ;
d. adding the entry “SERVICE IN IRAQ FROM 16 APRIL 2003 TO 31 MARCH
2004” to item 18;
e. adding the Iraq Campaign Medal and the ARCOM to item 13; and
f. adding the entries “Combat Lifesavers Course, 1 Week, December
2002” and “Unit Armorer Course, 2 Weeks, December 2002” to item 14.
