The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that her enlistment contract be corrected by
changing her term of service from 8 years and 00 weeks to 5 years and 00
weeks.
2. The applicant states that her DD Form 4/3 (Enlistment/Reenlistment
Document, Armed Forces of the United States), should read 5 years 00 weeks,
and not, 8 years 00 weeks.
3. The applicant provides copies of her DD Form 4/3, with an effective
date of 30 June 2005, DD Form 4/1, Memorandum for Record (MFR) from the
U.S. Army Recruiting Command, copy of her training of choice reservation
notification, Regular Army Applicant Data Report and a Statement of
Understanding in support of her request.
CONSIDERATION OF EVIDENCE:
1. The DD Form 4/3 of the applicant's enlistment contract shows that she
enlisted in the Regular Army for 8 years and 00 weeks on 30 June 2005.
2. The applicant's DD Form 4/1, Item 8a, shows her enlistment in the in
the Army for not less than 5 years and 00 weeks.
3. On 7 July 2005, a MFR from the U.S. Army Recruiting Command (USAREC),
43rd Adjutant General Battalion, Fort Leonard Wood, Missouri, confirmed
that her DD Form 4/3 is incorrect and the term of her enlistment should be
corrected to read, "for a period of 5 years and 00 weeks."
4. The applicant’s training of choice reservation notification shows the
applicant enlisted for a term of 5 years and 00 weeks.
5. The applicant's Regular Army Applicant Data Report shows that her term
of service is 60 months.
6. In a Statement of Understanding, the applicant states that she
understood the options under her enlistment contract, and that she
submitted the requested change under no coercion and for her own benefit.
DISCUSSION AND CONCLUSIONS:
1. An error was made during the preparation of the applicant’s enlistment
contract, which resulted in an incorrect term of service being shown on her
DD Form 4/3.
2. The applicant's enlistment contract erroneously shows her term of
enlistment as 8 years and 00 weeks. The MFR from USAREC dated 7July 2005,
confirmed that her DD Form 4/3 is incorrect and should be corrected to
reflect the term of enlistment as 5 years and 00 weeks.
