                            RECORD OF PROCEEDINGS

      IN THE CASE OF:

      BOARD DATE: 6 DECEMBER 2005
      DOCKET NUMBER: AR20050011376

I certify that hereinafter is recorded the true and complete record
of the proceedings of the Army Board for Correction of Military Records in
the case of the above-named individual.

| |Mr. Carl W. S. Chun | |Director |
| |Ms. Rene’ R. Parker | |Analyst |

The following members, a quorum, were present:

| |Mr. Bernard Ingold | |Chairperson |
| |Mr. Donald Steenfott | |Member |
| |Mr. Edward Montgomery | |Member |

The Board considered the following evidence:

Exhibit A - Application for correction of military records.

Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests award of the Purple Heart.

2. The applicant states, in effect, that he was wounded by tank fire
during WWII in March 1945.

3. The applicant provides two supporting statements and his WD AGO Form
53-55 (Enlisted Record and Report of Separation).

CONSIDERATION OF EVIDENCE:

1. Records available to the Board show that the applicant was inducted
into active service on 7 September 1944. He served in the European Theater
from 30 January 1945 until 13 July 1946. He was honorably discharged on
             2 August 1946.

2. The SGO (Office of The Surgeon General) files show that the applicant
was admitted to the hospital as a battle casualty on 6 March 1945.

3. The applicant provided two supporting statements from former “co-
workers.” The author of the first statement recalled that the applicant
was wounded with shrapnel in his foot, during an enemy night attack on
their position. He stated that the applicant was transported to a field
hospital for treatment. The author of the second statement supports the
applicant’s claim based on information that the applicant knew concerning
the death and wounding of fellow comrades. The author stated “If you
remember these men’s names and the area that I mentioned above, that would
mean that you were there and were one of the wounded.”

4. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part,
that the Purple Heart is awarded for a wound sustained as a result of
hostile action. Substantiating evidence must be provided to verify that
the wound was the result of hostile action, the wound must have required
treatment by a medical officer, and the medical treatment must have been
made a matter of official record.

DISCUSSION AND CONCLUSIONS:

The SGO files show the applicant was admitted to the hospital as a battle
casualty on 6 March 1945. Therefore, based on the evidence provided, he is
entitled to the award of the Purple Heart for wounds sustained on 6 March
1945.

BOARD VOTE:

__BI____ __DS____ ___EM __ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

________ ________ ________ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief. As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
showing that the applicant was awarded the Purple Heart for wounds
sustained on 6 March 1945.

The former service member’s military records are not available to the Board for review. In April 2003 the applicant was informed that his father’s military records had likely been destroyed by the 1973 fire in St. Louis, but could confirm that his father was entitled to the World War II Victory Medal, and an Honorable Service Lapel Button based on his military service during World War II. Although the former service member’s unit of assignment while overseas cannot be confirmed, the...

Contrary to the newspaper article provided by the applicant which states the applicant was wounded on 9 March 1945, evidence of record shows the applicant was wounded as a result of hostile action on 8 March 1945 in the Asiatic Pacific Theater of Operations. The applicant was a member of the 43d Infantry Division when it was cited for award of the Philippine Republic Presidential Unit Citation; therefore, he is entitled to correction of his records to show this foreign unit award. His records were burned in the National Personnel Records Center (NPRC) fire on 12 July 1973 and only partial records remain. The applicant's complete military records are not available to the Board for review. In the absence of corroborating evidence of record which shows the applicant was wounded or injured as a result of hostile action during World War II, there is insufficient evidence upon which to base award of the Purple Heart in this case.
