      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction to her date of rank on her DD Form
214 (Certificate of Release or Discharge from Active Duty).

2.  The applicant states that her date of rank was adjusted due to
constructive service credit (CSC) that did not reflect on her orders for
activation, so her adjusted date of rank was not entered on her DD Form
214.

3.  The applicant provides copies of her DD Form 214, her DA Form 5074-1-R
(Record of Award of Entry Grade Credit (Health Services Officers)), her
Appointment Memorandum, her Oath of Office, and her active duty assignment
orders.

CONSIDERATION OF EVIDENCE:

1.  The applicant's military records show she was appointed in the United
States Army Reserve (USAR), Army Nurse Corps, as a first lieutenant,
effective 13 September 2001, with 2 years and 18 days CSC.  Based on the
excess CSC, her date of rank for first lieutenant was adjusted to 26 August
2001.

2.  Her DA Form 5074-1-R, dated 18 September 2001, shows she was awarded
2 years and 18 days CSC for professional experience.  Her total award of
2 years was applied towards her entry grade of first lieutenant and the 18
days excess credit adjusted her date of rank within that grade.

3.  She entered on active duty effective 20 March 2003.  She was released
from active duty, as a first lieutenant, effective 20 March 2005.  Item 12h
(Effective Date of Pay Grade) shows the entry "2001 09 13" (13 September
2001).

4.  Army Regulation 635-5 provides instructions for the preparation of the
DD Form 214.  It states, in pertinent part, that item 12h will list the
effective date of promotion to the current pay grade.

DISCUSSION AND CONCLUSIONS:

1.  The applicant was appointed in the USAR, Army Nurse Corps, as a first
lieutenant, effective 13 September 2001.  Based on her awarded 18 days
excess CSC, her date of rank for first lieutenant was adjusted to 26 August
2001.  She was released from active duty effective 20 March 2003.  She was
issued a DD Form 214 that shows her effective date of pay grade for first
lieutenant as 13 September 2001.
2.  The evidence of record shows that applicant's date of rank for first
lieutenant was 26 August 2001.  Therefore, she is entitled to correction to
her DD Form 214, Item 12h, to show 26 August 2001, as her effective date of
pay grade for first lieutenant.

3.  In view of the foregoing, the applicant’s records should be corrected
as recommended below.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief.  As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
showing on her DD Form 214, Item 12h, her effective date of pay grade for
first lieutenant as 26 August 2001.
