      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, correction to his DA Form 5074-1-R
(Record of Award of Entry Grade Credit (Health Services Officers)).

2.  The applicant states, the date of issue of his first license was not
listed, rather a later date was used.  The correct date was 14 June 2000
and not 20 August 2000.  The date on file for his medical license on his DA
Form 5074-1-R is in error.  The file copy of his Ohio license with the
correct date was entered into his records of his two-times the citizen, but
was not entered correctly on his DA Form 5074-1-R.

3.  The applicant provides copies of his Ohio Veterinary License, his DA
Form 5074-1-R, an electronic mail correspondence from the Program Manager,
Army Medical Specialist Corps (SP)/Veterinary Corps(VC)/Dental Corps (DC)
Branch, Health Services Directorate, US Army Recruiting Command (USAREC),
and his previous request to the Army Board for Correction of Military
Record (ABCMR).

CONSIDERATION OF EVIDENCE:

1.  The applicant’s military records show that he was awarded a license
to practice veterinary medicine in the State of Ohio, with an effective
date of 14 June 2000.

2.  He was appointed in the United States Army Reserve (USAR), VC, as a
first lieutenant effective 25 May 2003, with 4 years, 9 months and 15 days
constructive service credit (CSC).

3.  His DA Form 5074-1-R, dated 10 June 2003, shows he was awarded 4 years
credit for his basic qualifying degree (Doctor of Veterinary Medicine
(DVM)) and 9 months and 15 days credit for his professional experience,
License #5536 – inclusive dates from 20 August 2000 to Present - for a
total of 4 years, 9 months, and 15 days CSC.  Two years credit was applied
toward his entry grade of first lieutenant and the excess credit of 2
years, 9 months, and 15 days adjusted his date of rank for first lieutenant
to 10 August 2000.

4.  On 23 June 2004, the applicant applied to the ABCMR requesting
correction of several errors on his DA Form 5074-1-R.  On 15 September
2004, the ABCMR advised the applicant that it would not consider an
application until the individual had exhausted all administrative remedies
to correct the error or injustice.  The applicant was directed to have his
troop program unit administrator review his DA Form 5074-1-R to ensure the
form was correct.  Once this was done, all supporting documents should be
forwarded to the USAREC for a review and final decision.

5.  On 21 March 2005, the Program Manager, SP/VC/DC Branch, Health
Services Directorate, USAREC, advised the applicant it appeared that his
DA Form 5074-1-R should be corrected to reflect the date of his Ohio
License.  However, because it would change his date of rank, which may in
turn effect other data in his military files, he should go through
official channels to request this correction.  He further advised the
applicant to complete a DD Form 149 (Application for Correction of
Military Records) and attach his DA Form 5074-1-R and Ohio License;
forwarded his request to his office and the corrected DA Form 5074-1-R
would be returned to the ABCMR where it would then make all necessary
corrections to his records.

6.  A "Corrected Copy" DA Form 5074-1-R, dated 22 November 2005, shows he
was awarded 4 years credit for his basic qualifying degree (DVM) and
10 months and 18 days credit for his professional experience, License
#5536 – inclusive dates from 14 June 2000 through 20 March 2002 for a
total of 4 years, 10 months, and 18 days CSC.  Two years credit was
applied toward his entry grade of first lieutenant and the 2 years, 10
months, and 18 day excess credit adjusted his date of rank for first
lieutenant to 7 July 2000.

7.  In an advisory opinion, dated 22 November 2005, the Program Manager,
SP/VC/DC Branch, Health Services Directorate, stated that upon review of
the documents submitted with the applicant's application, it had been
determined that his DA Form 5074-1-R was incorrect and must be changed to
reflect the initial date of his Ohio License.  A corrected DA 5074-1-R was
provided and reflected entry grade credit of 4 years, 10 months, and 18
days CSC.  In view of the foregoing, it was recommended the applicant's
request be approved.

8.  The favorable staff advisory opinion was forwarded to the applicant for
his acknowledgment/rebuttal on 23 November and he concurred on 29 November
2005.

9.  Army Regulation 135-101, prescribes the policies, procedures and
eligibility criteria for appointment of commissioned officers in the
Reserve, in the six branches of the Army Medical Department (AMEDD).  This
regulation provides that officers will be granted CSC for the basic
qualifying degree and for periods of professional training and experience
accrued after receipt of the basic qualifying degree.
DISCUSSION AND CONCLUSIONS:

1.  Based on correction to the DA Form 5074-1-R to show the applicant's
correct date he was licensed to practice veterinary medicine in Ohio, which
resulted in award of additional CSC, the applicant is entitled to a further
adjustment to his date of rank for first lieutenant.

2.  The applicant is entitled to correction to his records to show he was
appointed in the USAR, VC, as a first lieutenant effective 25 May 2003,
with 4 years, 10 months, and 18 days CSC and an adjusted date of rank to
7 July 2000.

3.  In view of the foregoing, the applicant’s records should be corrected
as recommended below.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief.  As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
showing he was appointed in the United States Army Reserve, Veterinary
Corps, as a first lieutenant, effective 25 May 2003, with 4 years, 10
months, and 18 days constructive service credit and an adjusted date of
rank to 7 July 2000.
