                            RECORD OF PROCEEDINGS

      IN THE CASE OF:

      BOARD DATE: 19 JANUARY 2006
      DOCKET NUMBER: AR20050005508

I certify that hereinafter is recorded the true and complete record
of the proceedings of the Army Board for Correction of Military Records in
the case of the above-named individual.

| |Mr. Carl W. S. Chun | |Director |
| |Ms. Deborah L. Brantley | |Senior Analyst |

The following members, a quorum, were present:

| |Mr. John Infante | |Chairperson |
| |Mr. William Crain | |Member |
| |Mr. Gerald Purcell | |Member |

The Board considered the following evidence:

Exhibit A - Application for correction of military records.

Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests that his records be corrected to reflect award
of the Purple Heart.

2. The applicant states he received the award but it is not reflected on
his separation document. He states he sustained shell fragment wounds to
his left leg, arm, and neck from a mortar round.

3. The applicant provides a copy of his separation document in support of
his request.

CONSIDERATION OF EVIDENCE:

1. Records available to the Board indicate the applicant was inducted and
entered active duty on 7 July 1966. In January 1967, following completion
of training, the applicant was assigned to Vietnam. He was initially
assigned to the 3rd Brigade of the 4th Infantry Division. The division was
redesignated as the 25th Infantry Division in August 1967. The applicant
remained assigned to that organization until January 1968 when he returned
to the United States.

2. The applicant's record contains a copy of a Western Union Telegram
indicating he was slightly wounded in action on 24 June 1967 as a result of
hostile action. The telegram stated the applicant sustained fragment
wounds to his neck, left arm, and left leg when his base camp came under
hostile mortar attack. The telegram states he was treated at the 45th
Surgical Hospital. The applicant's name is among a list of individuals
reported as combat casualties during the Vietnam War. Item 40 (wounds) on
his Department of the Army Form 20 (Enlisted Qualification Record) also
contains an entry confirming his 24 June 1967 combat wound. There is,
however, no indication the applicant was ever awarded the Purple Heart.

3. A review of Department of the Army Pamphlet 672-3 (Unit Citation and
Campaign Participation Credit Register) notes the applicant’s unit was
credited with participating in two designated campaigns (Vietnam
Counteroffensive Phases II and III) during the applicant’s period of
assignment. Two bronze service stars on the Vietnam Service Medal, which
is recorded on his separation document, should reflect his campaign
participation. The unit was also awarded a Valorous Unit Award, two awards
of the Republic of Vietnam Gallantry Cross Unit Citation with Palm and one
Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation
during his tenure with the organization. The unit awards were also omitted
from his separation document.
DISCUSSION AND CONCLUSIONS:

1. The evidence confirms the applicant was wounded as a result of hostile
action and as such, is entitled to an award of the Purple Heart. His
records should be corrected accordingly.

2. The evidence also confirms the applicant is entitled to two bronze
service stars on his Vietnam Service Medal, a Valorous Unit Award, two
awards of the Republic of Vietnam Gallantry Cross Unit Citation with Palm
and one Republic of Vietnam Civil Actions Honor Medal First Class Unit
Citation.

BOARD VOTE:

__JI ____ __WC___ __GP ___ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

________ ________ ________ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief. As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected:

      a. by awarding him the Purple Heart wounds sustained on 24 June 1967
while in Vietnam; and

      b. by showing that he is entitled to two bronze service stars on his
Vietnam Service Medal, a Valorous Unit Award, two awards of the Republic of
Vietnam Gallantry Cross Unit Citation with Palm and one Republic of Vietnam
Civil Actions Honor Medal First Class Unit Citation.
