THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that DA Forms 2627-1 (Record of Proceedings
Under Article 15, UCMJ), dated 28 August 1963 and 28 August 1970, be
expunged from his military records.
2. The applicant requests correction of items 3a (Grade, Rate, or Rank),
3b (Date of Rank), item 10a (Highest Civilian Education Level), item 10b
(Major Course or Field), item 13b (Type of Certificate Issued), item 25a
(Specialty Number and Title), item 26 (Decorations, Medals, Badges,
Commendations, Citations and Campaign Ribbons Awarded or Authorized), and
item 28a (Service Schools or Courses, College Training Courses and/or Post-
Graduate Courses Successfully Completed) on his DD Form 214 (Report of
Transfer or Discharge) for the period ending 20 March 1964.
3. The applicant also requests a promotion to E-8.
4. In an undated letter, the applicant requests, in effect, the issuance
of service ribbons and medals, two awards of the Combat Infantryman Badge,
and six awards of the Purple Heart.
5. The applicant states, in effect, that the circumstances surrounding his
28 August 1963 Article 15 (found sitting in a vehicle while posted as a
sentinel) is not enough to warrant the Article 15. He contends that he
found unsecured property and was sitting in the vehicle doing the
paperwork. He also states this Article 15 cost him a promotion to E-4 and
awards and decorations on his DD Form 214 for the period ending 20 March
1964. He contends that he completed training for military occupational
specialty (MOS) 95B or 950.00 (military policeman) between May 1961 and
July 1961; however, since he was a minor he could not perform military
policeman duties and was "failed at MP [military policeman] school." He
states that item 10a on this DD Form 214 should show he completed 12 years
of education, and item 10b should be corrected to show "High School." He
states he was issued a DD Form 256A (Honorable Discharge Certificate) on 20
March 1964 and his conduct and efficiency ratings were excellent. He also
contends that his DD Form 214 for the period ending
20 March 1964 is missing awards and decorations and should be corrected to
show award of the Armed Forces Expeditionary Medal, the National Defense
Service Medal, the Army of Occupation Medal, the Army of Occupation Medal
with Berlin Clasp (i.e, the Berlin Airlift Device), the Good Conduct Medal,
the Army Service Ribbon, the Meritorious Unit Commendation, the
Presidential Unit Citation, the French Fourragere, the Marksman
Marksmanship Qualification Badge with Rifle Bar, the Marksman Marksmanship
Qualification Badge with Carbine Bar, the Sharpshooter Marksmanship
Qualification Badge with Pistol Bar, and the Sharpshooter Marksmanship
Qualification Badge with Rifle Bar. He further claims the 28 August 1970
Article 15 cost him a promotion to E-8.
6. The applicant provides four applications; numerous service personnel
records to include 2 pages of a 4-page DA Form 20 (Enlisted Qualification
Record); a DD 214 for the period ending 20 March 1964; a DD Form 214 for
the period ending 12 December 1967; his high school diploma; two associate
degrees dated
6 August 1990 and 11 May 1991; and a letter, dated 30 December 2005.
CONSIDERATION OF EVIDENCE:
1. The applicant is requesting correction of alleged errors which occurred
around 1973/1974. The applications submitted in this case are dated 23
February 2005, 24 February 2005, 18 March 2005, and 2 May 2005.
2. Title 10, U.S. Code, Section 1552(b), provides that applications for
correction of military records must be filed within 3 years after discovery
of the alleged error or injustice. This provision of law allows the Army
Board for Correction of Military Records (ABCMR) to excuse failure to file
within the 3-year statute of limitations if the ABCMR determines that it
would be in the interest of justice to do so. In this case, the ABCMR will
conduct a review of the merits of the case to determine if it would be in
the interest of justice to excuse the applicant’s failure to timely file.
3. The applicant’s military records are not available to the Board. This
case is being considered using reconstructed records, which primarily
consist of a DD Form 214 for the period ending 20 March 1964 and the
service personnel records provided by the applicant.
4. The applicant enlisted on 17 March 1961 for a period of 3 years. His
service record shows his duty (i.e. training) MOS was 950.00 (military
policeman) during the period 11 July 1961 to 25 July 1961. There is no
evidence the applicant was awarded MOS 95B or MOS 950.00.
5. DA Form 2627-1, dated 28 August 1963, shows that nonjudicial punishment
was imposed against the applicant for sitting in a vehicle while posted as
a sentinel. His punishment consisted of a reduction to E-2, restriction,
and extra duty.
6. Records show the applicant was promoted to E-3 effective 18 November
1963.
7. The applicant served as a light weapons infantryman in Frankfurt,
Germany from 22 November 1961 through 6 March 1964 and was released from
active duty and transferred to the U.S. Army Reserve on 20 March 1964 in
the rank of private first class (PFC).
8. Item 3a on the applicant's DD Form 214 for the period ending 20 March
1964 shows the entry, "PFC E3 (P)." Item 3b shows the entry, "18 Nov 63."
Item 10a shows the entry, "9 Years." Item 10b shows the entry, "General."
Item 13b shows the entry, "None." Item 25a shows the entry, "111.00 Lt
Wpns Inf" [light weapons infantryman]. Item 26 shows the entries,
"Sharpshooter (BAR)" and "Expert (MG M-60)." Item 28 on this DD Form 214
shows the entries, "None" and "NA."
9. There is no evidence in the available records which shows the applicant
was promoted to E-4 prior to his discharge on 20 March 1964.
10. The applicant provided a copy of his high school diploma, dated 31 May
1962.
11. There are no orders for the Good Conduct Medal in the available
records. His service record shows he received an academic efficiency
rating of “UNSAT” [unsatisfactory] during the period 18 August 1961 to 16
September 1961.
12. There is no evidence the applicant served in Berlin or served a period
of qualifying service for award of the Army of Occupation Medal.
13. Section 9 (Medals, Decorations, and Citations) of the applicant's
Service Record shows he was awarded the Marksman Marksmanship Qualification
Badge with Rifle Bar, the Marksman Marksmanship Qualification Badge with
Carbine Bar, the Marksman Marksmanship Qualification Badge with Pistol Bar,
the Sharpshooter Marksmanship Qualification Badge with "BAR," the
Sharpshooter Marksmanship Qualification Badge with Pistol Bar [Cal .45],
and the Expert Marksmanship Qualification Badge with Machinegun Bar. Since
the Sharpshooter Marksmanship Qualification Badge with "BAR" and the Expert
Marksmanship Qualification Badge with Machinegun Bar are shown on the
applicant's DD Form 214 for the period ending 20 March 1964, these two
issues in his request will not be discussed further in these proceedings.
14. There is no evidence in the available records which shows the
applicant was awarded the Sharpshooter Marksmanship Qualification Badge
with Rifle Bar prior to 24 March 1964.
15. The applicant enlisted on 13 July 1964 for a period of 3 years. He
served in MOS 71A (clerk) and MOS 76H (senior aircraft parts specialist)
assigned to the 18th Aviation Company in Vietnam from 12 October 1964
through 14 December 1966. He served in MOS 76T (aircraft repair parts
specialist) assigned to the 18th Aviation Company in Vietnam from 18 August
1967 until he was honorably discharged on 12 December 1967 apparently for
the purpose of immediate reenlistment. He subsequently served in the Army,
to include two additional tours in Vietnam, until around 1973/1974;
however, the available records do not contain any other discharge
documents.
16. The applicant's DD Form 214 for the period ending 12 December 1967
shows the Vietnam Service Medal, the National Defense Service Medal, the
Vietnam Campaign Medal, the first award of the Good Conduct Medal, and the
Sharpshooter Marksmanship Qualification Badge with Rifle Bar as authorized
awards.
17. DA Form 2627-1, dated 28 August 1970, shows that nonjudicial
punishment was imposed against the applicant for being absent without leave
from 24 August 1970 to 25 August 1970 while serving in Vietnam. His
punishment consisted of a forfeiture of pay and restriction.
18. There is no evidence in the available records which shows the
applicant was promoted to E-8.
19. There are no orders for the Combat Infantryman Badge in the available
records.
20. There is no evidence in the available records which shows that the
applicant was awarded the Purple Heart or was wounded as a result of
hostile action in Vietnam.
21. The applicant's DA Form 20, which he last audited on 8 November 1973,
does not show entitlement to the Purple Heart and item 40 (Wounds) on his
DA Form 20 is blank. The applicant's name does not appear on the Vietnam
Casualty Roster.
22. Records show the applicant participated in five campaigns in Vietnam
during the periods 12 October 1964 through 14 December 1966 and 18 August
1967 through 12 December 1967.
23. Department of the Army Pamphlet 672-3 shows the applicant’s unit was
cited for award of the Meritorious Unit Commendation for actions during the
period October 1964 to December 1965 by Department of the Army General
Orders Number 3, dated 1967.
24. Department of the Army Pamphlet 672-3 shows the applicant's unit was
cited for award of the Navy Presidential Unit Citation for actions during
the period
29 March 1966 to 30 June 1967 based on Department of the Army General
Orders Number 59, dated 1969.
25. There is no evidence of record which shows the applicant's unit was
cited for the French Fourragere.
26. Department of the Army Pamphlet 672-3 also shows the applicant's unit
is entitled to one award of the Republic of Vietnam Gallantry Cross with
Palm Unit Citation (1 March 1966 to 26 March 1967) based on Department of
the Army General Orders Number 22, dated 1968, and one award of the
Republic of Vietnam Gallantry Cross with Palm Unit Citation (27 March 1967
to 17 May 1968) based on Department of the Army General Orders Number 46,
dated 1969.
27. Army Regulation 600-8-104 (Military Personnel Information
Management/Records) prescribes the policies governing the Official Military
Personnel File (OMPF), the MPRJ (Military Personnel Records Jacket), the
Career Management Individual file, and Army Personnel Qualification
Records. Table 2-1 of the regulation provides, in pertinent part, that a
DA Form 2627 issued before 1 November 1982 showing any other type
punishment than extra duty or restriction for 14 days of less, an oral or
written reprimand, forfeiture of pay for one month, or any combination of
the above, will be filed in the Commendatory and Disciplinary section of
the OMPF.
28. Army Regulation 635-5 establishes the standardized policy for
preparing and distributing the DD Form 214. It provides, in pertinent
part, that the primary MOS will be entered in item 25a on the DD Form 214
and that service schools successfully completed during the period covered
by the DD Form 214 would be entered in item 28.
29. Army Regulation 600-8-22 (Military Awards), provides, in pertinent
part, that the Armed Forces Expeditionary Medal is authorized for
participants in military operations within a specific geographic area
during a specified time period. Paragraph 2-13d specifically provides that
individuals qualified for the Armed Forces Expeditionary Medal for service
in Vietnam from 1 July 1958 and 3 July 1965 (inclusive) shall remain
qualified for that medal. Upon request, a unit personnel officer may award
the Vietnam Service Medal in lieu of the Armed Forces Expeditionary Medal,
but the regulation requires that the Armed Forces Expeditionary Medal be
removed from the records of the individual. No person will be entitled to
both awards for Vietnam service.
30. Army Regulation 600-8-22 provides, in pertinent part, that the
National Defense Service Medal is awarded for honorable active service for
any period between 27 July 1950 through 27 July 1954, 1 January 1961
through 14 August 1974, 2 August 1990 through 30 November 1995, and 11
September 2001 to a date to be determined.
31. Army Regulation 600-8-22 provides, in pertinent part, that the Army of
Occupation Medal is awarded for service of thirty consecutive days at a
normal post of duty in a qualifying location. Personnel at a qualifying
location as an inspector, courier, escort, temporary or detached duty are
precluded from eligibility. This medal was authorized for service in
various countries in Europe and the Far East during the period 1945 to 1955
and in Berlin from 9 May 1945 to 2 October 1990. The Berlin Airlift Device
is awarded for service with a unit credited with participation in the
Berlin Airlift entirely within the period from 2 June 1948 to 30 September
1949.
32. Army Regulation 672-5-1, in effect at the time, provided policy and
criteria concerning individual military decorations. It stated that the
Army Good Conduct Medal was awarded for each 3 years of continuous enlisted
active Federal military service completed on or after 27 August 1940 and,
for the first award only, upon termination of service on or after 27 June
1950 of less than 3 years but more than 1 year. At the time, a Soldier's
conduct and efficiency ratings must
have been rated as "excellent" for the entire period of qualifying service
except that a service school efficiency rating based upon academic
proficiency of at least "good" rendered subsequent to 22 November 1955 was
not disqualifying. However, there was no right or entitlement to the medal
until the immediate commander made positive recommendation for its award
and until the awarding authority announced the award in General Orders.
33. Army Regulation 600-8-22 shows that the Army Service Ribbon was
established by the Secretary of the Army on 10 April 1981. The regulation
states, in pertinent part, that effective 1 August 1981, all members of the
Active Army, Army National Guard, and Army Reserve in an active Reserve
status are eligible for the award upon successful completion of initial
entry training. The award may be awarded retroactively to those personnel
who completed the required training before 1 August 1981 provided they had
an Active Army status on or after 1 August 1981.
34. Army Regulation 600-8-22, in pertinent part, sets forth requirements
for award of basic marksmanship qualification badges. The qualification
badge is awarded to indicate the degree in which an individual has
qualified in a prescribed record course, and an appropriate bar is
furnished to denote each weapon with which the individual has qualified.
The qualification badges are in three classes: Expert, Sharpshooter, and
Marksman.
35. Army Regulation 600-8-22 provides, in pertinent part, that the Combat
Infantryman Badge is awarded to infantry officers and to enlisted and
warrant officer persons who have an infantry MOS. They must have served in
active ground combat while assigned or attached to an infantry unit of
brigade, regimental or smaller size. The Awards Branch of the U.S. Army
Human Resources Command has advised, in similar cases, that during the
Vietnam era, the Combat Infantryman Badge was awarded only to enlisted
individuals who held and served in MOS 11B, 11C, 11F, 11G, or 11H. The
regulation also states, in pertinent part, that a separate award of the
Combat Infantryman Badge has been authorized for qualified Soldiers in any
of three conflicts: (1) World War II; (2) the Korean Conflict (27 June
1950 to 27 July 1953), and (3) the Vietnam Conflict.
36. Army Regulation 600-8-22 provides, in pertinent part, that the Purple
Heart is awarded for a wound sustained as a result of hostile action.
Substantiating evidence must be provided to verify that the wound was the
result of hostile action, the wound must have required treatment, and the
medical treatment must have been made a matter of official record. The
bronze oak leaf cluster is awarded to denote the second and succeeding
awards of certain decorations, among which is the Purple Heart.
37. Army Regulation 600-8-22, in pertinent part, authorizes award of a
bronze service star, based on qualifying service, for each campaign listed
in Appendix B of the regulation and states that authorized bronze service
stars will be worn on the appropriate service medal. This regulation
provides that a silver service star is authorized in lieu of five bronze
service stars.
38. Army Regulation 600-8-22 provides for award of the French Fourragere
as an approved foreign unit award. The French Fourragere may be awarded by
the French Government when a unit has been cited twice for award of the
French Croix de Guerre.
39. Paragraph 6 (Miscellaneous Information) of Department of the Army
Pamphlet 672-3 states that only one award of the Republic of Vietnam
Gallantry Cross with Palm Unit Citation may be worn; however, records
should show entitlement to all authorized awards of this foreign unit
award. This guidance also provides that when a single unit receives
duplicate awards of the Republic of Vietnam Gallantry Cross with Palm Unit
Citation during the same period, then only one award of the Republic of
Vietnam Gallantry Cross with Palm Unit Citation will be recorded in
official personnel records.
DISCUSSION AND CONCLUSIONS:
1. The DA Form 2627-1, dated 28 August 1963, is properly filed in the
applicant's military records in accordance with the governing regulation.
There is no evidence it was improperly imposed. It appears to have been
the commander's judgment that a sentinel found sitting in a vehicle while
on post warranted a one-grade reduction as punishment. The Board will not
substitute its judgment for that of the commander.
2. The DA Form 2627-1, dated 28 August 1970, is properly filed in the
applicant's military records in accordance with the governing regulation.
There is no evidence it was improperly imposed.
3. There is no evidence in the available records which shows the applicant
was promoted to E-4 prior to his discharge on 20 March 1964. Therefore,
there is no basis for granting the applicant's request for a promotion to E-
4 or amending items 3a and 3b on his DD Form 214 for the period ending 20
March 1964.
4. The high school diploma provided by the applicant is accepted as
sufficient evidence on which to amend item 10a on his DD Form 214 for the
period ending 20 March 1964 to show he completed 12 years of education (his
associate degrees were not completed until almost 30 years later). Since
item 10b on this DD Form 214 shows the entry, "General," and a high school
education is considered a general education, there is no basis for amending
item 10b on this DD Form 214.
5. Evidence of record shows the applicant was released from active duty on
20 March 1964 and not discharged. Therefore, the entry in item 13b on his
DD Form 214 for the period 20 March 1964 is correct and there is no basis
for granting the applicant's request to amend item13b on this DD Form 214.
6. There is no evidence of record which shows the applicant completed
training as a military policeman or was awarded MOS 95B or 950.00. Since
the applicant admitted that he "was failed at MP school," there is no basis
for granting his requests to amend items 25a or item 28 on his DD Form 214
for the period ending 20 March 1964.
7. The applicant's request for the Armed Forces Expeditionary Medal was
noted. However, since his DD Form 214 for the period ending 12 December
1967 shows the Vietnam Service Medal, and no person will be awarded both
medals, it appears he was awarded the Vietnam Service Medal in lieu of the
Armed Forces Expeditionary Medal.
8. The applicant served a period of qualifying service for award of the
National Defense Service Medal. Therefore, his DD Form 214 for the period
ending
20 March 1964 should be corrected to show this medal.
9. There is no evidence which shows the applicant served in Berlin or
served a period of qualifying service for award of the Army of Occupation
Medal or the Army of Occupation Medal with Berlin Airlift Device.
Therefore, there is insufficient evidence on which to base award of these
medals.
10. There are no orders for the Good Conduct Medal in the available
records. The applicant's military records show he received an academic
efficiency rating of unsatisfactory during the period 18 August 1961 to 16
September 1961 which is a disqualifying factor for award of the Good
Conduct Medal. Therefore, the applicant does not meet the eligibility
criteria for award of the Good Conduct Medal for the period ending 20 March
1964.
11. Since the applicant did not have an Active Army status on or after 1
August 1981, there is no basis for granting his request for the Army
Service Ribbon.
12. The entries in Section 9 of the applicant's service record which show
he was awarded the Marksman Marksmanship Qualification Badge with Rifle
Bar, the Marksman Marksmanship Qualification Badge with Carbine Bar, and
the Sharpshooter Marksmanship Qualification Badge with Pistol Bar are
accepted as sufficient evidence on which to amend his DD Form 214 for the
period ending
20 March 1964 to show these marksmanship badges.
13. There is no evidence of record which shows the applicant was awarded
the Sharpshooter Marksmanship Qualification Badge with Rifle Bar prior to
24 March 1964. Therefore, there is insufficient evidence on which amend
his DD Form 214 for the period ending 20 March 1964 to show this
marksmanship qualification badge.
14. There is no evidence in the available records which shows the
applicant was promoted to E-8. Therefore, there is no basis for granting
the applicant's request for a promotion to E-8.
15. Evidence of record shows the applicant served in MOS 71A, MOS 76H, and
MOS 76T in Vietnam between 12 October 1964 and 12 December 1967. There is
no evidence of record which shows the applicant held an infantry MOS or
served in active ground combat while an assigned member of an infantry unit
of brigade or smaller size in Vietnam, World War II, or Korea. Therefore,
there is insufficient evidence on which to base any award of the Combat
Infantryman Badge in this case.
16. Although the applicant contends that he was wounded/injured six times
in Vietnam, there is no evidence of record which shows that the applicant
was wounded or treated for any injuries as a result of hostile action in
Vietnam. Therefore, there is insufficient evidence on which to base any
award of the Purple Heart in this case.
17. The applicant participated in five campaigns in Vietnam between 12
October 1964 and 12 December 1967 which entitles him to award of the
Vietnam Service Medal with one silver service star. Therefore, his DD Form
214 for the period ending 12 December 1967 should be corrected to show this
award.
18. The applicant's unit was cited for award of the Meritorious Unit
Commendation and the Navy Presidential Unit Citation while he was assigned
to it.
19. There is no evidence of record which shows the applicant's unit was
cited twice for award of the French Croix de Guerre. Therefore, there is
insufficient evidence on which to base award of the French Fourragere.
20. The applicant’s unit was awarded two awards of the Republic of Vietnam
Gallantry Cross with Palm Unit Citation and so he is entitled to wear one
of those awards. However, his DD Form 214 should be corrected to show two
awards of the Republic of Vietnam Gallantry Cross with Palm Unit Citation.
21. Since the latest available DD Form 214 is for the period ending
12 December 1967, awards for his subsequent tours in Vietnam will not be
considered.
22. The Army Board for Correction of Military Records does not issue
medals. The applicant may receive the awards shown on his DD Form 214 or
DD Form 215 (Correction to DD Form 214) by submitting a request in writing
to the following address: National Personnel Records Center, ATTN: Army
Medals, 9700 Page Avenue, St. Louis, Missouri 63132-5100. A copy of the DD
Form 214 or DD Form 215 should be included with the request.
23. Records show the applicant should have discovered the alleged errors
now under consideration around 1973/1974; therefore, the time for the
applicant to file a request for correction of any error expired around
1976/1977. The applicant did not file within the 3-year statute of
limitations; however, based on the available evidence it would be in the
interest of justice to excuse failure to timely file in this case.

BOARD DETERMINATION/RECOMMENDATION:
1. The Board determined that the evidence presented was sufficient to
warrant a recommendation for partial relief and to excuse failure to timely
file. As a result, the Board recommends that all Department of the Army
records of the individual concerned be corrected by:
a. deleting the entry in item 10a on his DD Form 214 for the period
ending 20 March 1964;
b. adding the entry "12 Years" in item 10a on this DD Form 214;
c. amending item 26 on his DD Form 214 for the period ending 20
March 1964 to show that he was awarded the National Defense Service Medal,
the Marksman Marksmanship Qualification Badge with Rifle Bar, the Marksman
Marksmanship Qualification Badge with Carbine Bar, and the Sharpshooter
Marksmanship Qualification Badge with Pistol Bar; and
d. amending item 24 (Decorations, Medals, Badges, Commendations,
Citations and Campaign Ribbons Awarded or Authorized) on his DD Form 214
for the period ending 12 December 1967 to show that he was awarded the
Vietnam Service Medal with one silver service star, the Meritorious Unit
Commendation, the Navy Presidential Unit Citation, and two awards of the
Republic of Vietnam Gallantry Cross with Palm Unit Citation.
2. The Board further determined that the evidence presented is
insufficient to warrant a portion of the requested relief. As a result,
the Board recommends denial of so much of the application as pertains to
expunging DA Forms 2627-1, dated 28 August 1963 and 28 August 1970, from
his military records; amendment of items 3a, 3b, 10b, 13b, 25a and 28 on
his DD Form 214 for the period ending 20 March 1964; a promotion to E-4, a
promotion to E-8, award of the Armed Forces Expeditionary Medal, the Army
of Occupation Medal, the Army of Occupation Medal with Berlin Airlift
Device, the Army Service Ribbon, the Sharpshooter Marksmanship
Qualification Badge with Rifle Bar, two awards of the Combat Infantryman
Badge, and six awards of the Purple Heart.
