      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant, as the daughter and legal representative of a deceased
former service member (FSM), requests that item 10 (Date of Birth) on her
late father's WD AGO Form 53-55 (Enlisted Record and Report of Separation)
be corrected to show 21 December 1923 instead of 23 December 1923.

2.  The applicant states, in effect, her father was born on 21 December
1923 and his date of birth on his WD AGO Form 53-55 is incorrect.

3.  The applicant provides the FSM's birth certificate; his WD AGO Form 53-
55; his death certificate; her birth certificate; a court order, dated 12
November 2003; and her marriage license.

CONSIDERATION OF EVIDENCE:

1.  The FSM's military records are not available to the Board for review.
A fire destroyed approximately 18 million service members' records at the
National Personnel Records Center in 1973.  It is believed that the FSM's
records were lost or destroyed in that fire.  However, there were
sufficient documents remaining in a reconstructed record for the Board to
conduct a fair and impartial review of this case.

2.  The FSM was inducted on 3 August 1943 and entered active duty on
24 August 1943.  He served in the European Theater of Operations from
8 February 1944 until approximately 14 January 1946.  On 26 April 1946, the
FSM was honorably discharged with a certificate of disability.

3.  Item 10 on the FSM’s WD AGO Form 53-55 shows that he was born on
23 December 1923.

4.  In support of her claim, the applicant provided the FSM's birth
certificate which shows he was born on 21 December 1923.  She also provided
his death certificate which shows he was born on 21 December 1923 and died
on
20 October 2003.

DISCUSSION AND CONCLUSIONS:

The applicant provides sufficient evidence to show the FSM was born on
      21 December 1923.  Therefore, it would be appropriate to correct item
10 on his WD AGO Form 53-33 to show this date.

BOARD DETERMINATION/RECOMMENDATION:

amending item 10 on his WD AGO Form 53-55 to show that he was born on
21 December 1923.
