THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of his request for amendment of
his Report of Transfer or Discharge (DD Form 214) to show that he was
awarded the Army Commendation Medal (ARCOM).

2.  The applicant states that he received the ARCOM after leaving Vietnam
and it was later stolen from his residence during a burglary.  He states
that he decided to find out how to have it replaced and discovered that it
was not listed on his DD Form 214.  He states that he requested to have his
DD Form 214 updated and that he asked for information on how to have the
ARCOM replaced.  He states that he was told that his DD Form 214 would not
be updated, as he had not submitted any evidence that he had been awarded
the ARCOM.  He states that he believed that the Army had the paperwork for
his ARCOM and therefore, he sent no evidence with his previous request.  He
states that he would like to have his DD Form 214 corrected and to have the
ARCOM replaced.

3.  The applicant provides in support of his application copies of a
citation and certificate awarding him the ARCOM.

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records, which were
summarized in the previous consideration of the applicant's case by the
Army Board for Correction of Military Records (ABCMR) in Docket Number
AR2003084954 on 2 October 2003.

2.  On 19 July 1966, he enlisted in the Army in Syracuse, New York, for 3
years, in the pay grade of E-1.  He successfully completed his training as
a ground surveillance radar repairman.  He was transferred to Vietnam on 29
July 1968 and he remained in Vietnam until he returned to the Continental
United States on 9 May 1969.

3.  The certificate and citation that the applicant submitted in support of
his application shows that on 28 May 1969, he was awarded the ARCOM for
meritorious service in the Republic of Vietnam for the period covering
June 1968 to May 1969.




4.  On 11 May 1969, the applicant was honorably released from active duty
and transferred to the United States Army Reserve Control Group
(Reinforcement).  He had completed 2 years, 9 months and 23 days net active
service.

5.  The DD Form 214 that the applicant was furnished at the time of his
discharge shows that he was awarded the National Defense Service Medal, the
Vietnam Service Medal, the Vietnam Campaign Medal and one Overseas Bar.

6.  In an application to this Board dated 27 December 2002, the applicant
requested that the ARCOM be included on his DD Form 214.  His application
was considered by the ABCMR on 2 October 2003, and the ABCMR directed that
his DD Form 214 be corrected to reflect his correct social security number;
his award of the Vietnam Service Medal w/2 Bronze Service Stars, the
Republic of Vietnam Gallantry Cross w/Palm Unit Citation Badge, and the
Sharpshooter Qualification Badge w/Rifle Bar; and his service in Vietnam.
However, based on insufficient evidence, the ABCMR denied that portion of
his request that pertained to the ARCOM.

7.  Army Regulation 600-8-22 provides that the ARCOM may be awarded to any
member of the Armed Forces of the United States who, while serving in any
capacity with the Army after 6 December 1941, distinguished himself or
herself by heroism, meritorious achievement or meritorious service.  As
with all personal decorations, formal recommendations, approval through the
chain of command, and announcement in orders are required.

DISCUSSION AND CONCLUSIONS:

1.  The applicant has now provided evidence that shows that he was
recommended for and awarded the ARCOM.

2.  Both the certificate and citation that he submitted in support of his
application shows that he was awarded the ARCOM for meritorious service in
the Republic of Vietnam for the period covering June 1968 to May 1969 and
his DD Form 214 should be corrected to reflect his award.

3.  Accordingly, it would now be in the interest of justice to correct the
applicant's records as recommended below.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
amendment of the ABCMR’s decision in Docket Number AR2003084954, dated
2 October 2003.  As a result, the Board recommends that all Department of
the Army records of the individual concerned be corrected by amending the
DD Form 214 to show that he was awarded the Army Commendation Medal on 28
May 1969, for meritorious service in the Republic of Vietnam for the period
covering June 1968 to May 1969.
