      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that he be awarded the Purple Heart.

2.  The applicant states that he only received one of the three Purple
Hearts that he "was put in for."  He was wounded on 26 October 1967, during
the 1968 Tet Offensive, and in May of 1968 by an RPG (rocket propelled
grenade).

3.  The applicant provides no substantiating documentation.

CONSIDERATION OF EVIDENCE:

1.  The applicant is requesting correction of an alleged error or injustice
which occurred on 31 October 1989, the date of his retirement from active
duty.  The application submitted in this case is dated 12 January 2001;
however it was received on 4 January 2005.

2.  Title 10, U.S. Code, Section 1552(b), provides that applications for
correction of military records must be filed within 3 years after discovery
of the alleged error or injustice.  This provision of law allows the Army
Board for Correction of Military Records (ABCMR) to excuse failure to file
within the 3-year statute of limitations if the ABCMR determines that it
would be in the interest of justice to do so.  In this case, the ABCMR will
conduct a review of the merits of the case to determine if it would be in
the interest of justice to excuse the applicant’s failure to timely file.

3.  The applicant entered active duty on 21 March 1967 and served on
continuous active duty until he retired as a staff sergeant (E-6) on 31
October 1989.  He initially completed training as an infantryman in
military occupational specialty (MOS) 11B and was redesignated as military
police (MOS 95B) on 1 October 1973.

4.  The applicant served in Vietnam with A Company, 3rd Battalion, 12th
Infantry Regiment, 4th Infantry Division from 8 to 14 September 1967 and
with B Company, 3rd Battalion, 12th Infantry Regiment, 4th Infantry
Division from
15 September to 20 September 1968.

5.  His DA Forms 20 (Enlisted Qualification Records) [The form was redone
in September 1971 but the original is available on his microfiche.]  Blocks
39 show he was credited with participation during four campaign periods.
Blocks 40 (Wounds) are blank.  Blocks 41 (Awards and Decorations) list the
National Defense Service Medal, the Vietnam Service Medal, the Vietnam
Campaign Medal [with "1960-" Device] the Bronze Star Medal, the Armed
Forces Expeditionary Medal (for Korea), the Republic of Vietnam Gallantry
Cross with Palm Unit Citation and the Expert Qualification Badge with Rifle
Bar.  His final DD Form 214 (Certificate of Release or Discharge from
Active Duty) lists the same Vietnam Era awards.

5.  In August 1974 the applicant requested waiver of a bar to reenlistment
[he had in advisedly declined to extend for foreign duty assignment].  The
request form lists his awards, but does not include the Purple Heart.

6.  There are no orders or any other indication in the available records
that the applicant was awarded the Purple Heart or that he was treated for
a wound sustained while in action against the enemy or as the result of
enemy action.

7.  Army Regulation 600-8-22 provides, in pertinent part, that the Purple
Heart is awarded for a wound sustained while in action against an enemy or
as a result of hostile action.  Substantiating evidence must be provided to
verify that the wound was the result of hostile action, the wound must have
required treatment by a medical officer, and the medical treatment must
have been made a matter of official record.

8.  Army Human Resources Command Message (Date Time Group 9 February 2004)
published implementing instructions for award of the Korea Defense Service
Medal.  This message specified criteria for the award of the Korea Defense
Service Medal as follows:  a) service members of the armed forces must have
served in support of the defense of the Republic of Korea from 28 July 1954
through a future date to be determined by the Secretary of Defense;  b) the
area of eligibility encompasses all land area of the Republic of Korea, and
the contiguous water out to 12 nautical miles, and all air spaces above the
land and water areas;  c) service members must have been mobilized with
units or assigned or attached to units operating in the area of eligibility
and have been physically deployed in the area of eligibility for 30
consecutive or 60 non-consecutive days.

9.  The implementing message also authorized award of the Korea Defense
Service Medal if a Soldier meets one or more of the following criteria:  a)
be engaged in actual combat during an armed engagement, regardless of the
time in the area of eligibility;  b) is wounded or injured in the line of
duty and requires medical evacuation from the area of eligibility;  c)
participates as a regularly assigned air crew member flying sorties for 30
consecutive days or 60 nonconsecutive days into, out of, within, or over
the area of eligibility in support of military operations; or  d) served in
operations and exercises conducted in the area of eligibility as long as
the basic time criteria is met.  The message further provided that, due to
extensive time period for the Korea Defense Service Medal eligibility, the
non-consecutive service period for eligibility remains cumulative
throughout the entire period.

10.  As a matter of information, on the occasion of the 50th anniversary of
the Korean War, the Government of the Republic of Korea issued the Korean
War Service Medal to pay tribute to eligible Korean War veterans for their
historic endeavors to preserve the freedom of the Republic of Korea and the
free world.  On 20 August 1999, the Department of Defense approved
acceptance and wear of this foreign service award to eligible US veterans
of the Korean War, or their surviving next of kin. The medal is provided at
no cost to veterans.

11.  The Department of Defense assigned responsibility to the Department of
the Air Force for distribution of the Korean War Service Medal to eligible
veterans or their surviving next of kin.  To apply, veterans must submit a
copy of their discharge paper (DD Form 214) to the Awards and Decorations
Section, Headquarters, Air Force Personnel Center, 550 C Street West, Suite
12, Randolph Air Force Base, Texas 78150-4714.  A sample request form is
being provided to the applicant.  Once the Korean War Service Medal has
been authorized by the Department of the Air Force, the applicant may apply
to the Army Board for Correction of Military Records to add this foreign
award to his DD Form 214.

DISCUSSION AND CONCLUSIONS:

1.  There is no available evidence to indicate that the applicant was
awarded or recommended for the Purple Heart or that he was treated for a
wound that was sustained while he was in action against the enemy or as the
result of hostile action.

2.  In order to justify correction of a military record the applicant must
show to the satisfaction of the Board, or it must otherwise satisfactorily
appear, that the record is in error or unjust.  The applicant has failed
satisfy this requirement.

3.  The applicant is eligible for the Korea Defense Service Medal.
However, this does not require action by the Board.  Therefore,
administrative correction of the applicant's records will be accomplished
by the Case Management Support Division (CMSD), St. Louis, Missouri, as
outlined by the Board in paragraph 3 of the BOARD
DETERMINATION/RECOMMENDATION section below.  He can use the application
provided to apply to the U.S. Air Force for the Korean War Service Medal.
5.  Records show the applicant should have discovered the alleged error or
injustice now under consideration on 31 October 1989, the time for the
applicant to file a request for correction of any error or injustice
expired on 30 October 1992.  The applicant did not file within the 3-year
statute of limitations and has not provided a compelling explanation or
evidence to show that it would be in the interest of justice to excuse
failure to timely file in this case.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented does not demonstrate
the existence of a probable error or injustice.  Therefore, the Board
determined that the overall merits of this case are insufficient as a basis
for correction of the records of the individual concerned.

2.  As a result, the Board further determined that there is no evidence
provided which shows that it would be in the interest of justice to excuse
the applicant's failure to timely file this application within the 3-year
statute of limitations prescribed by law.  Therefore, there is insufficient
basis to waive the statute of limitations for timely filing or for
correction of the records of the individual concerned.

3.  The Board determined that administrative error in the records of the
individual should be corrected.  Therefore, the Board requests that the
CMSD-St. Louis administratively correct the records of the individual
concerned by adding the Korea Defense Service Medal to the DD Form 214.
