The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, reconsideration of his request for
the Army of Occupation Medal (AOM)-Japan Clasp and American Campaign Medal.
2. The applicant states, in effect, his unit, the 188th Glider Infantry
Regiment was an original integral unit of the 11th Airborne Division, and
it continued to be until the unit was disbanded in 1949. He claims that in
late August 1945, the entire division, to include the 188th landed in Japan
and remained there until it was redeployed to the United States in 1949.
He claims to have been quartered in Sendi until early 1946, at which time
he returned to the United States. In regard to the American Campaign
Medal, he claims he meets the portion of the regulatory requirement cited
that indicates the award is authorized for active combat against the enemy,
or award of a combat decoration.
3. The applicant provides a self-authored statement and unit historical
documents in support of his application.
CONSIDERATION OF EVIDENCE:
1. Incorporated herein by reference are military records which were
summarized in the previous consideration of the applicant's case by the
Army Board for Correction of Military Records (ABCMR) in Docket Number
AR2004104702,
on 18 November 2004.
2. During its original deliberations, the Board concluded the applicant’s
unit was not authorized occupation credit for Japan by proper Army
authority, as indicated in Department of the Army Pamphlet 672-1, which is
the official source for authorization of this award during World War II.
Further, the Board concluded the applicant was not entitled to the American
Campaign Medal because he had not served within the continental limits of
the United States for a period of one year.
3. Army Regulation 600-8-22 (Military Awards) provides the Army’s awards
policy. Paragraph 5-14 contains guidance on award of the American Campaign
Medal. It states, in pertinent part, that it was awarded for service
within the American Theater between 7 December 1941 and 2 March 1946.
4. The awards regulation defines the boundaries of the American Theater as
follows: (1) Eastern boundary. The eastern boundary is located from the
North Pole, south along the 75th meridian west longitude to the 77th
parallel north latitude, thence southeast through Davis Strait to the
intersection of the 40th parallel north latitude and the 35th meridian west
longitude, thence south along the meridian to the 10th parallel north
latitude, thence southeast to the intersection of the Equator and the 20th
meridian west longitude, thence south along the 20th meridian west
longitude to the South Pole; and Western boundary. The western boundary is
located from the North Pole, south along the 141st meridian west longitude
to the east boundary of Alaska, thence south and southeast along the Alaska
boundary to the Pacific Ocean, thence south along the 130th meridian to its
intersection with the 30th parallel north latitude, thence southeast to the
intersection of the Equator and the 100th meridian west longitude, thence
south to the South Pole.
5. Department of the Army (DA) Pamphlet 672-1 (Unit Campaign Participation
Credit Register-World War II) establishes the eligibility of individual
members for campaign participation credit, assault landing credit, and unit
citation badges awarded during World War II. This source confirms that
occupation of Japan credit was not granted to the 188th Glider Infantry
Regiment, 11th Airborne Division.
DISCUSSION AND CONCLUSIONS:
1. The applicant’s request for the AOM with Japan Clasp and American
Campaign Medal, and the supporting unit history documents he submitted were
carefully considered. However, there is insufficient evidence to support
amending the original Board decision on these issues.
2. The source publication, DA Pamphlet 672-1, confirms the Army did not
award the 188th Glider Infantry Regiment, 11th Airborne Division occupation
of Japan credit during World War II. This confirms the Army was aware the
applicant’s unit was part of the 11th Airborne Division, and still did not
award his unit occupation credit for Japan. As a result, it would not be
in the interest of all those who served during World War II and who faced
similar circumstances to award the applicant the AOM with Japan Clasp at
this late date.
3. By regulation, in order to receive the American Campaign Medal, any
qualifying period of service, or combat service would have had to have been
completed while the member was assigned within the territorial limits of
the American Theater. In this case, it is clear the applicant’s combat
service was performed while he was serving in the Pacific Theater of
Operations, and that he was appropriately recognized for this combat
service with the Asiatic-Pacific Campaign Medal.
4. In order to justify correction of a military record the applicant must
show to the satisfaction of the Board, or it must otherwise satisfactorily
appear, that the record is in error or unjust. The applicant has failed to
submit evidence that would satisfy this requirement.

BOARD DETERMINATION/RECOMMENDATION:
The evidence presented does not demonstrate the existence of a probable
error or injustice. Therefore, the Board determined that the overall
merits of this case are insufficient as a basis to amend the decision of
the ABCMR set forth in Docket Number AR2004104702, on 18 November 2004.
