THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, correction of his discharge
document.
2. The applicant states, in effect, that his discharge document is
incorrect and should be corrected to show his total prior active service,
total prior inactive service, and all of his awards.
3. The applicant provides a copy of his DD Form 214 (Certificate of
Release or Discharge from Active Duty), with an effective date of 27 August
2004; two
DD Forms 220 (Active Duty Report), dated 22 December 2000 and 5 July 1990;
and two NGB Forms 22 (National Guard Bureau Report of Separation and Record
of Service), with effective dates of 17 June 1989 and 11 August 1987.
CONSIDERATION OF EVIDENCE:
1. The applicant is requesting correction of an alleged error which
occurred on 27 August 2004, the date of his release from active duty with
the U.S. Army. The application submitted in this case is dated 14 December
2004.
2. The applicant's military personnel record contains a DA Form 2-1
(Personnel Qualification Record). Item 35 (Record of Assignments) of this
document shows that the applicant enlisted in the U.S. Air Force, Army
National Guard, on
24 April 1986; transferred to the U.S. Army, California Army National
Guard, on 12 August 1987 as an enlisted Soldier; and was commissioned as an
officer in the Adjutant General Corps of the U.S. Army Reserve, on 17 June
1989.
3. The applicant's service record contains his active duty orders, active
duty reports, and separation documents which document the periods of
inactive and active service he has completed during the course of his
military service. These documents show that, prior to issuance of his DD
Form 214 (with an effective date of 27 August 2004), the applicant had
completed the following periods of active military service: 16 June 1986
through 2 October 1986; 22 April 1990 through 20 July 1990; 29 November
1990 through 11 June 1991; and
15 October 2000 through 19 December 2000, which represents the completion
of 1 year, 3 months, and 4 days of total prior active service. These
documents also show that, prior to issuance of this DD Form 214, the
applicant completed
16 years, 7 months, and 1 day of total prior inactive service since
entering military service on 24 April 1986.
4. The applicant's DD Form 214 shows he was honorably discharged, by
reason of completion of required service, effective 27 August 2004. Item
12 (Record of Service), Section d (Total Prior Active Service) and Section
e (Total Prior Inactive Service) of the document both contain the entry,
"SEE BLOCK #18". Item 18 (Remarks) of the DD Form 214 contains, in
pertinent part, the following entry, "…//SEPARATED FROM SERVICE ON
TEMPORARY RECORDS AND SOLDIER'S AFFIDAVIT//DD FORM 215 WILL BE ISSUED TO
PROVIDE MISSING INFORMATION//…".
5. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons
Awarded or Authorized (All periods of service)), of the applicant's DD Form
214, with an effective date of 27 August 2004, shows the following awards:
National Defense Service Medal (2nd Award), Global War On Terrorism
Expeditionary Medal, Armed Forces Reserve Medal, Armed Forces Reserve Medal
w/ M Device, and Army Service Ribbon.
6. The applicant's service record contains a DD Form 214, with an
effective date of 2 October 1986, which shows in Item 13 that he was
awarded the Air Force Training Ribbon.
7. The applicant's service record contains a DD Form 214, with an
effective date of 11 June 1991, which shows in Item 13 that he was awarded
the Army Service Ribbon, National Defense Service Medal, Meritorious Unit
Citation (Commendation), Southwest Asia Service Medal, Marksman (Rifle),
Overseas Service Ribbon, Army Commendation Medal, and Army Reserve
Components Overseas Training Ribbon.
8. The applicant's record contains a DD Form 215 (Correction to DD Form
214, Certificate of Release or Discharge from Active Duty), dated 25
February 1992, which shows in Item 5 (Original DD Form 214 is Corrected as
Indicated Below), "Separation Date on DD Form 214 Being Corrected: 11 Jun
1991". This document also shows the following entry, "Item 13, "DELETED"
SOUTHWEST ASIA SERVICE MEDAL//OVERSEAS SERVICE RIBBON"//"ADDED" SOUTHWEST
ASIA SERVICE MEDAL W/3 BRONZE SERVICE STARS//KUWAIT LIBERATION MEDAL//AIR
FORCE TRAINING RIBBON/ /NOTHING FOLLOWS".
9. Item 9 (Awards, Decorations and Campaigns) of the applicant's DA Form 2-
1 (prepared in 1997), shows that he was awarded the Air Force Training
Ribbon, Army Service Ribbon, National Defense Service Medal, Meritorious
Unit Commendation, Southwest Asia Service Medal with 3 bronze service
stars, Army Commendation Medal, Army Reserve Components Overseas Training
Ribbon, Kuwait Liberation Medal, Army Reserve Components Achievement Medal,
Army Achievement Medal (1st Oak Leaf Cluster), Overseas Service Ribbon, and
Armed Forces Reserve Medal with Mobilization Device.
10. A review of the applicant's record reveals that he may be entitled to
additional awards that are not shown on his DD Form 214.
11. The applicant's record contains a copy of an Army Commendation Medal
Certificate, dated 24 April 1991, awarded under authority of Headquarters,
7th Personnel Group (Operation Desert Strom), Order Number 4-284, dated
24 April 1991, which shows that he was awarded the Army Commendation Medal
for meritorious achievement, from 17 January 1991 to 8 April 1991.
12. The applicant's record contains a copy of an Army Commendation Medal
Certificate, dated 30 August 1996, awarded under authority of Headquarters,
3rd Personnel Command, Jackson, Mississippi, Permanent Order Number
243-15, dated 30 August 1996, which shows that he was awarded the Army
Commendation Medal (1st Oak Leaf Cluster) for meritorious service, from
1 June 1995 to 31 July 1996.
13. The applicant's record contains a copy of an Army Commendation Medal
Certificate, dated 31 August 2000, awarded under authority of Headquarters,
641st Area Support Group, Nashville, Tennessee, Permanent Order Number
244-03, dated 31 August 2000, which shows that he was awarded the Army
Commendation Medal for meritorious service, from 1 May 1997 to
31 January 1999.
14. The applicant's record contains a copy of an Army Achievement Medal
Certificate, dated 3 October 1994 ,awarded under authority of Headquarters,
81st U.S. Army Reserve Command, East Point, Georgia, Permanent Order Number
012-017, dated 3 October 1994, which shows that he was awarded the Army
Achievement for meritorious achievement, from 10 January 1994 to
1 October 1994.
15. The applicant's record contains a copy of an Army Achievement Medal
Certificate, dated 1 October 1994, awarded under authority of Headquarters,
357th Combat Support Battalion, Athens, Georgia, Permanent Order Number
4-1, dated 1 October 1994, which shows that he was awarded the Army
Achievement for meritorious achievement on 1 October 1994.
16. The applicant's DD Form 214, with an effective date of 11 June 1991,
shows that he served in Southwest Asia in support of Operation Desert
Shield/Desert Storm, from 21 December 1990 through 15 May 1991.
17, The applicant's DD Form 214, with an effective date of 27 August 2004,
shows that he served in Kuwait and Iraq in support of Operation Iraqi
Freedom, from 10 March 2004 through 7 August 2004.
18. The applicant provides documentary evidence in support of his
application that includes his DD Form 214, two DD Forms 220, and NGB Form
22, which offer further support and documentary evidence regarding the
periods of his active and inactive military service.
19. Army Regulation 600-8-22 (Military Awards) provides that the Army
Commendation Medal may be awarded to any member of the Armed Forces of the
United States who, while serving in any capacity with the Army after
6 December 1941, distinguished himself or herself by heroism, meritorious
achievement or meritorious service. As with all personal decorations,
formal recommendations, approval through the chain of command, and
announcement in orders are required.
20. Army Regulation 600-8-22 provides, in pertinent part, that the Army
Achievement Medal is awarded to any member of the armed forces of the
United States, who while serving in a noncombat area on or after 1 August
1981, distinguished themselves by meritorious service or achievement. As
with all personal decorations, formal recommendations, approval through the
chain of command, and announcement in orders are required.
21. Army Regulation 600-8-22 states, in pertinent part, that the bronze
oak leaf cluster is awarded to denote the second and succeeding awards of
certain decorations, among which is the Army Commendation Medal and Army
Achievement Medal.
22. The Kuwait Liberation Medal awarded by the Kingdom of Saudi Arabia
(KLM-SA) was approved on 3 January 1992 and is awarded to members of the
Armed Forces of the United States who participated in the Persian Gulf War
between 17 January 1991 and 28 February 1991.
23. The Kuwait Liberation Medal awarded by the Government of Kuwait (KLM-
K) was approved on 9 November 1995 and is awarded to members of the Armed
Forces of the United States who participated in the Persian Gulf War
between 2 August 1990 and 31 August 1993.
24. Army Regulation 635-5 (Separation Documents) prescribes the separation
documents that must be prepared for Soldiers on retirement, discharge,
release from active duty service, or control of the Active Army. It also
establishes standardized policy for preparing and distributing the DD Form
214. Chapter 2 contains guidance on the preparation of the DD Form 214.
It states, in pertinent part, that the source documents for entering
information on the DD Form 214 will be the Personnel Qualification Record
(PQR), Enlisted/Officer Record Brief (ERB/ORB), or any other document
authorized for filing in the OMPF.
DISCUSSION AND CONCLUSIONS:
1. The applicant contends, in effect, that Item 12, Section d and Section
e, of his DD Form 214, should be corrected because his total prior active
service and total prior inactive service is not shown on the document. The
applicant further contends that Item 13 of the document is in error because
it does not show all of the awards that he is authorized.
2. The applicant provides documents which support the military service
dates and periods of active and inactive service documented in his military
personnel service records.
3. Evidence of record shows that the applicant's DD Form 214, with an
effective date of 27 August 2004, was prepared based on limited information
at the time of his release from active duty.
4. Evidence of record confirms that the applicant completed 1 year, 3
months, and 4 days of total prior active service at the time of his
separation on
27 August 2004. Therefore, Item 12, Section d (Total Prior Active Service)
of his DD Form 214 should be corrected to show that he completed "01
Year(s),
03 Month(s), and 04 Day(s)" of total prior active service.
5. Evidence of record confirms that the applicant completed 16 years,
7 months, and 1 day of total prior inactive service at the time of his
separation, on 27 August 2004. Therefore, Item 12, Section e (Total Prior
Inactive Service) of his DD Form 214 should be corrected to show that he
completed "16 year(s),
07 Month(s), and 01 Day(s)" of total prior inactive service.
6. Evidence of record shows the applicant was awarded the Air Force
Training Ribbon, Meritorious Unit Commendation, Southwest Asia Service
Medal with 3 bronze service stars, Marksman Qualification Badge with Rifle
Bar, Army Reserve Components Overseas Training Ribbon, Army Reserve
Components Achievement Medal, three awards of the Army Commendation Medal,
and two awards of the Army Achievement. Therefore, it would be appropriate
to correct his records to show these awards.
7. Evidence of record also shows that the applicant is authorized award of
the Kuwait Liberation Medal (Saudi Arabia) and Kuwait Liberation Medal
(Kuwait). Therefore, it would be appropriate to correct his records to
show these awards.

The Board determined that the evidence presented was sufficient to warrant
