The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that his report of separation (DD Form 214) be
corrected to reflect his award of the Purple Heart.
2. The applicant states that he was awarded the Purple Heart; however, it
was not added to his DD Form 214 at the time of his release from active
duty (REFRAD).
3. The applicant provides a copy of a picture of his Purple Heart showing
his name engraved on the back.
CONSIDERATION OF EVIDENCE:
1. He was inducted in St Louis, Missouri, on 7 September 1951 and was
transferred to Fort Custer, Michigan, for processing. He was then
transferred to Fort Riley, Kansas to undergo his training. He completed
his training as a rifleman and was transferred to Fort Lawton, Washington,
for departure to Japan on 29 April 1952.
2. He arrived in Yokohama, Japan, on 12 May 1952 and departed for Korea on
18 May 1952. He arrived in Pusan, Korea on 21 May 1952 and was assigned to
Company B, 31st Infantry Regiment on 29 May 1952. He was awarded the
Combat Infantryman Badge on 19 June 1952 and was advanced to the rank of
corporal on 5 July 1952.
3. On 14 October 1952, he sustained a flesh wound of the right thigh by a
small arms bullet while advancing against opposing forces in North Korea.
He was evacuated to a hospital in Japan and was awarded the Purple Heart by
General Order Number 81, published by the 382nd General Hospital on 23
October 1952.
4. He was returned to his unit in Korea on 25 November 1952, was promoted
to the rank of sergeant on 26 December 1952 and was promoted to the rank of
Sergeant First Class on 25 February 1953.
5. He departed Korea on 11 March 1953 for Japan. He arrived in Japan on
12 March 1953 and remained there until 26 March 1953 when he departed for
Seattle, Washington. He arrived in Seattle on 9 April 1953 and was
transferred to Camp Crowder, Missouri, where he remained until he was
REFRAD on 8 June 1953. He had served 1 year, 9 months and 2 days of total
active service and his DD Form 214 shows he was awarded the Korean Service
Medal with two bronze service stars, the United Nations Service Medal, and
the Combat Infantryman Badge. His DD Form 214 did not indicate that he had
been wounded or that he was awarded the Purple Heart. Additionally, his
records show that he was awarded the Good Conduct Medal and the Republic of
Korea Presidential Unit Citation (ROKPUC) and those awards were also
omitted from his DD Form 214 at the time of his REFRAD.
6. Army Regulation 600-8-22 provides that the National Defense Service
Medal (NDSM) was established by Executive Order 10448 dated 22 April 1953
and is awarded for honorable active service for any period between 27 June
1950 and 27 July 1954.
7. As a matter of information, on the occasion of the 50th anniversary of
the Korean War, the Government of the Republic of Korea issued the Korea
War Service Medal to, pay tribute to eligible Korean War veterans for their
historic endeavors to preserve the freedom of the Republic of Korea and the
free world. On 20 August 1999, the Department of Defense approved
acceptance and wear of this foreign service award to eligible US Veterans
of the Korean War, or their surviving next of kin. The medal is provided
at no cost to veterans.
8. The Department of Defense assigned responsibility to the Department of
the Air Force for distribution of the Korean War Service medal to eligible
veterans or their surviving next of kin. To apply, veterans must submit a
copy of their discharge paper (DD Form 214) to the Awards and Decorations
Section, Headquarters, Air Force Personnel Center. 550 C Street West, Suite
12, Randolph Air Force Base, Texas 78150-4714. A sample request form is
being provided to the applicant with his copy of these proceedings. Once
the Korean War Service Medal has been authorized by the Department of the
Air Force, the applicant may apply to this Board to add this foreign award
to his DD Form 214.
DISCUSSION AND CONCLUSIONS:
1. The applicant was awarded the Purple Heart for wounds received in
action in Korea on 14 October 1952 and therefore is entitled to have that
award and the date of his wound reflected in his records.
2. Additionally, the applicant was awarded the ROKPUC and the GCMDL and
those awards should also be added to his records at this time.
3. The applicant was also entitled to be awarded the NDSM. Accordingly,
it would be in the interest of justice to issue him that medal at this time
and to add the award of the NDSM to his records as well.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief. As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
showing that he was awarded the Purple Heart for wounds received in Korea
on 14 October 1952, the ROKPUC, the GCMDL and by issuing him the NDSM and
adding it to his records as well.

Once the Korean War Service Medal has been authorized by the Department of the Air Force, the applicant may apply to this Board to add this foreign award to his DD Form 214. However, the evidence of record does show that the applicant is entitled to be awarded the NDSM for his service. Evidence shows that the applicant’s records contain administrative error which does not require action by the Board.
