      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that the rank shown on his DD Form 214
(Certificate of Release or Discharge from Active Duty) be corrected from
master sergeant (MSG) to first sergeant (1SG).

2.  The applicant states, in effect, he was serving in a 1SG position at
the time he was promoted to pay grade E-8 and he never served in a MSG
position or wore MSG insignia.

3.  The applicant provides copies of a academic evaluation report showing
completion of the 1SG course at the Sergeants Major Academy, promotion
orders, seven noncommissioned officer evaluation reports (NCOERs) covering
periods from July 1999 to May 2003, 23 September 2003 retirement orders,
and his DD Form 214.

CONSIDERATION OF EVIDENCE:

1.  The applicant, a career Regular Army NCO was released from active duty
on 31 March 2004 and placed on the retired list as a master sergeant.  He
had 23 years, 4 months, and 3 days of continuous active duty.

2.  The promotion and retirement orders list his rank as MSG; however the
NCOERS show he possessed the first sergeant's special qualification
identifier (SQI) "M" and served continuously for almost four years in three
different 1SG assignments.  During those assignments, his senior raters
ranked him exclusively in the top box.

3.  Army Regulation 635-200 prescribes the policy and procedure for the
separation of enlisted personnel.  Paragraph 12-17 (Grade Title on Retired
List of former 1SGs) stipulates that noncommissioned officers holding the
grade of MSG at retirement, whose records show successful service as a 1SG
sergeant, will be placed on the Retired List in the grade title, 1SG.  It
states, in pertinent part, that the only criteria for such placement on the
Retired List is that the Soldier must be serving in and retiring in the
grade of MSG, must possess the SQI M and must have served as a 1SG in the
grade of MSG.

DISCUSSION AND CONCLUSIONS:

1.  By regulation, noncommissioned officers holding the grade of MSG at
retirement, who hold the "M" SQI and whose records show successful service
as a 1SG sergeant, will be placed on the Retired List in the grade title of
1SG.

2.  The evidence of record confirms the applicant held the required SQI and
served successfully as the 1SG of three different units for almost four
years, including while in the grade of MSG.  Therefore, it would be
appropriate to correct his record to show his rank title as 1SG.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief and to excuse failure to timely file.  As a
result, the Board recommends that all Department of the Army records of the
individual concerned be corrected by showing his retired rank title as
First Sergeant and by issuing him a corrected separation document that
reflects this change.
