      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction to his enlistment military contract
date to show 25 March 2005 for entitlement to a United States Army Reserve
(USAR) enlistment bonus.

2.  The applicant states that there was a discovery of an administrative
error of date discrepancies on his enlistment contract and his DA Form 5261-
R (Selected Reserve Incentive Program (SRIP) – Enlistment Bonus Addendum).
This constitutes a non-payment of funds he was entitled to.

3.  The applicant provides copies of his DD Form 4/1
(Enlistment/Reenlistment Document, Armed Forces of the United States);
his DA Form 5261-R; his DD Form 214 (Certificate of Release or Discharge
from Active Duty); his Congressional request for assistance; and
responses from Congressman Christopher H. Smith and the Chief, Military
Personnel Management Division, Headquarters, USAR Command, Fort
McPherson, Georgia.

CONSIDERATION OF EVIDENCE:

1.  The applicant's military records show he enlisted in the USAR as a
private, in pay grade E-1, effective 25 March 2003, with entitlement to a
$5,000 Enlistment Bonus.

2.  His DD Form 4/1 is dated 25 March 2003 and his DA Form 5261-R is dated
22 March 2003.

3.  On 15 March 2004, the Chief, Military Personnel Management Division,
Headquarters, USAR Command, advised Congressman Smith that an
administrative error was discovered between the applicant's enlistment
contract and his DA Form 5261-R.  The date of the contract was 25 March
2003 and the date of the DA Form 5261-R was 22 March 2003.  The applicant
was advised that if his request for an exception to policy was disapproved,
he may elect to remain in his unit as a drilling Reservist without the SRIP
incentive, or request discharge according to Army regulatory guidance, or
apply to the Army Review Boards Agency.

4.  The Policy Integrator, Incentive and Budget Branch, Enlisted Accessions
Division, Office of the Deputy Chief of Staff, G1, on 20 July 2005,
expressed the opinion that in reviewing the applicant's case, the Solider
was qualified for a $5,000 Enlistment Bonus based on his enlistment date,
military occupational specialty, and unit assignment contained in the
Assistant Secretary of the Army for Manpower and Reserve Affair's approved
First Half Fiscal Year 2003 SRIP.  The problem occurred at the time of
enlistment when a quality control check did not detect that the contract
date and incentive addendum date did not match, which precluded the Defense
Finance and Accounting Services from being able to pay the bonus.  In view
of the foregoing, he recommended the applicant's be authorized the $5,000
Enlistment Bonus annotated in his enlistment contract and bonus addendum to
his contract.

5.  The opinion was forwarded to the applicant for acknowledgment and
possible rebuttal on 6 September 2005.  He did not respond.

DISCUSSION AND CONCLUSIONS:

1.  The evidence shows an administrative error was made during the
preparation of the applicant's enlistment contract, which resulted in non-
payment of the bonus.  The contract date and incentive addendum date did
not match, which precluded the Defense Finance and Accounting Services from
being able to pay the bonus.

2.  The applicant's DD Form 4/1 shows it was signed on 25 March 2003 and
his DA Form 5261-R erroneously shows it was signed on 22 March 2003.  The
applicant was entitled to an enlistment bonus of $5,000 based on his
enlistment date, military occupational specialty, and unit assignment.
Therefore, the applicant is entitled to the $5,000 enlistment bonus as
annotated on his enlistment contract and bonus addendum to his contract.

3.  In view of the foregoing, the applicant's records should be corrected
as recommended below.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief.  As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
showing the applicant is entitled to and payment of the $5,000 Enlistment
Bonus.
