      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that his retirement date be changed from 1
January 1988 to 29 January 1988.

2.  The applicant states that granting his request would give him exactly
28 years of military service.  He states "It is only right and fair" to do
so.

3.  The applicant provides a copy of Orders D118-3, US Total Army Personnel
Command, Alexandria, Virginia, dated 21 June 1994, establishing his
retirement date as 1 January 1988.

CONSIDERATION OF EVIDENCE:

1.  The applicant is requesting correction of an alleged error or injustice
which occurred on 21 June 1994, the date of his retirement order.  The
application submitted in this case is dated 5 October 2004.

2.  Title 10, U.S. Code, Section 1552(b), provides that applications for
correction of military records must be filed within 3 years after discovery
of the alleged error or injustice.  This provision of law allows the Army
Board for Correction of Military Records (ABCMR) to excuse failure to file
within the 3-year statute of limitations if the ABCMR determines that it
would be in the interest of justice to do so.  In this case, the ABCMR will
conduct a review of the merits of the case to determine if it would be in
the interest of justice to excuse the applicant’s failure to timely file.

3.  The applicant entered military service on 30 January 1960.  On 1
December 1987, a Physical Evaluation Board (PEB) found him physically unfit
for continued service with a disability rating of 10 percent.  The PEB
recommended separation with disability severance pay.  The applicant
declined separation with physical disability and opted for transfer to the
Retired Reserve.  He was separated on 6 October 1988 and transferred to the
Retired Reserve.

4.  The applicant petitioned the ABCMR seeking physical disability
retirement.  On 11 May 1994, the Board amended the 1 December 1987 PEB
results to show the applicant had a 30 percent disability rating.  The
Board further voided his 6 October 1988 retirement and directed that he be
retired effective 1 January 1988 with a 30 percent disability rating.

5.  On 17 August 2001, the applicant again petitioned the ABCMR seeking to
increase his disability rating from 30 percent to 60 percent.  On 13 June
2002, the Board denied the applicant's request.

DISCUSSION AND CONCLUSIONS:

1.  The applicant's 1 December 1987 PEB decision was amended by the ABCMR
to show he was 30 percent disabled.  In doing this, the Board corrected his
retirement date to 1 January 1988, the month following the PEB decision.

2.  The applicant's retirement date is correct; there is no error or
injustice.  The applicant's statement that "It is only right and fair" to
give him a full 28 years of service is not accepted.  The applicant did not
serve 28 years.

3.  Records show the applicant should have discovered the alleged error or
injustice now under consideration on 21 June 1994, the date of his
retirement order establishing 1 January 1988 as his retirement date;
therefore, the time for the applicant to file a request for correction of
any error or injustice expired on 31 December 1991.  The applicant did not
file within the 3-year statute of limitations and has not provided a
compelling explanation or evidence to show that it would be in the interest
of justice to excuse failure to timely file in this case.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented does not demonstrate
the existence of a probable error or injustice.  Therefore, the Board
determined that the overall merits of this case are insufficient as a basis
for correction of the records of the individual concerned.

2.  As a result, the Board further determined that there is no evidence
provided which shows that it would be in the interest of justice to excuse
the applicant's failure to timely file this application within the 3-year
statute of limitations prescribed by law.  Therefore, there is insufficient
basis to waive the statute of limitations for timely filing or for
correction of the records of the individual concerned.
