      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that his record be corrected to
reflect his service in the Republic of Vietnam (RVN) and all awards to
which he is entitled based on that RVN service.

2.  The applicant states, in effect, that his separation document (DD Form
214) does not reflect his RVN service, or the awards he is entitled to
based on that service.

3.  The applicant provides his Enlisted Qualification Record (DA Form 20)
and DD Form 214 in support of his application.

CONSIDERATION OF EVIDENCE:

1.  The applicant is requesting correction of alleged error or injustice
that occurred on 11 March 1970.  The application submitted in this case is
dated
18 August 2004.

2.  Title 10, U.S. Code, Section 1552(b), provides that applications for
correction of military records must be filed within 3 years after discovery
of the alleged error or injustice.  This provision of law allows the Army
Board for Correction of Military Records (ABCMR) to excuse failure to file
within the 3-year statute of limitations if the ABCMR determines that it
would be in the interest of justice to do so.  In this case, the ABCMR will
conduct a review of the merits of the case to determine if it would be in
the interest of justice to excuse the applicant’s failure to timely file.

3.  The applicant’s record shows he was inducted into the Army and entered
active duty on 19 March 1968.  He was trained in, awarded and served in
military occupational specialty (MOS) 94B (Cook) and the highest rank he
attained while serving on active duty was private first class (PFC).
4.  The applicant’s DA Form 20 confirms he served in the RVN from 31 May
1969 through 10 March 1970.  During his RVN tour, he was assigned to
Headquarters and Headquarters Company (HHC), 3rd Battalion, 7th Infantry
Regiment,
199th Infantry Brigade, performing duties in MOS 94B.

5.  Item 41 (Awards and Decorations) of the applicant’s DA Form 20 shows
that during his active duty tenure, the applicant earned the following
awards:  Army Commendation Medal (ARCOM), Vietnam Service Medal (VSM), RVN
Campaign Medal with 60 Device and Marksman Qualification Badge with Rifle
Bar.

6.  The applicant’s Military Personnel Records Jacket (MPRJ) contains a
copy of Headquarters, 199th Infantry Brigade General Orders (GO) Number
2385, dated 14 December 1969.  These orders awarded the applicant the ARCOM
for meritorious achievement for the period 16 June 1969 through 15 November
1969.  The MPRJ also contains a copy Headquarters, 199th Infantry Brigade
GO Number 540, dated 24 February 1970.  These orders awarded the applicant
the ARCOM 1st Oak Leaf Cluster, for meritorious service during the period
June 1969 through March 1970.

7.  On 11 March 1970, the applicant was honorably separated after
completing
1 year, 11 months and 23 days of active military service.  Item 24
(Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons
Awarded or Authorized) of the DD Form 214 he was issued shows he earned the
ARCOM and National Defense Service Medal during his active duty tenure.

8.  Army Regulation 635-5 (Separation Documents) prescribes the separation
documents that are issued to individuals who are retired, discharged or
released from active duty.  The regulation also contains guidance on
preparation of the
DD Form 214.  The regulation in effect at the time of the applicant’s
release from active duty specified that RVN service would be recorded in
Item 30 (Remarks) by using inclusive dates of service, for example
“Vietnam:  1 Aug 68-31 Jul 69”.

9.  Army Regulation 600-8-22 (Military Awards) prescribes Army policy and
criteria concerning individual military awards.  Paragraph 2-13 contains
guidance on award of the VSM.  It states, in pertinent part, that a bronze
service star is authorized with this award for each RVN campaign a member
is credited with participating in while serving in the RVN.
10.  Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit
Register) establishes the eligibility of individual members for campaign
participation credit, assault landing credit, and unit citation badges
awarded during the Vietnam Conflict.  It confirms that during his RVN
tenure of assignment, his unit (HHC, 3rd Battalion, 7th Infantry Regiment,
199th Infantry Brigade) earned RVN Gallantry Cross with Palm Unit Citation
and RVN Civil Actions Honor Medal First Class Unit Citation.

11.  Army Pamphlet 672-3 further shows that during his RVN tour, the
applicant was credited with participating in the TET 69 Counteroffensive,
Vietnam Summer-Fall 1969 and Vietnam Winter-Spring 1970 campaigns.

DISCUSSION AND CONCLUSIONS:

1.  The applicant contention that his RVN service and the awards he earned
based on this service were not properly document in his record and on his
final DD Form 214 was carefully considered and found to have merit.

2.  The separation documents regulation in effect at the time of the
applicant’s separation provided for documenting RVN service with an entry
in Item 30.  The evidence of record confirms the applicant served in the
RVN from 31 May 1969 through 11 March 1970.  Therefore, it would be
appropriate to add the following entry to Item 30 of the applicant’s DD
Form 214:  “Vietnam - 31 May 60 -11 Mar 70”.

3.  The applicant’s MPRJ contains orders confirming the applicant was
awarded the ARCOM for meritorious achievement and the ARCOM 1st Oak Leaf
Cluster for meritorious service.  As a result it would appropriate to add
these awards to his record and separation document at this time.

4.  The evidence of record also shows that based on his service and
campaign participation in the RVN, the applicant is entitled to the RVN
Gallantry Cross with Palm Unit Citation, RVN Civil Actions Honor Medal
First Class Unit Citation and
3 bronze service stars with his VSM.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief and to excuse failure to timely file.  As a
result, the Board recommends that all Department of the Army records of the
individual concerned be corrected by amending his 11 March 1970 DD Form 214
by deleting the entry in Item 24 and replacing it with the entry “Army
Commendation Medal 1st Oak Leaf Cluster, National Defense Service Medal,
Vietnam Service Medal with 3 bronze service stars, Republic of Vietnam
Campaign Medal with 1960 Device, Republic of Vietnam Gallantry Cross with
Palm Unit Citation, Republic of Vietnam Civil Actions Honor Medal First
Class Unit Citation and Marksman Qualification Badge with Rifle Bar; by
adding the entry
“Vietnam:  31 May 69-10 Mar 70”; and by providing him a corrected
separation document that includes these changes.
