RECORD OF PROCEEDINGS
IN THE CASE OF:
BOARD DATE: 19 May 2005
DOCKET NUMBER: AR20040006721
I certify that hereinafter is recorded the true and complete record
of the proceedings of the Army Board for Correction of Military Records in
the case of the above-named individual.
| |Mr. Carl W. S. Chun | |Director |
| |Mr. Joseph A. Adriance | |Analyst |
The following members, a quorum, were present:
| |Mr. Raymond J. Wagner | |Chairperson |
| |Ms. Barbara J. Ellis | |Member |
| |Ms. LaVerne M. Douglas | |Member |
The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, that his record be corrected to
reflect his service in the Republic of Vietnam (RVN) and all awards to
which he is entitled based on that RVN service.
2. The applicant states, in effect, that his separation document (DD Form
214) does not reflect his RVN service, or the awards he is entitled to
based on that service.
3. The applicant provides his Enlisted Qualification Record (DA Form 20)
and DD Form 214 in support of his application.
CONSIDERATION OF EVIDENCE:
1. The applicant is requesting correction of alleged error or injustice
that occurred on 11 March 1970. The application submitted in this case is
dated
18 August 2004.
2. Title 10, U.S. Code, Section 1552(b), provides that applications for
correction of military records must be filed within 3 years after discovery
of the alleged error or injustice. This provision of law allows the Army
Board for Correction of Military Records (ABCMR) to excuse failure to file
within the 3-year statute of limitations if the ABCMR determines that it
would be in the interest of justice to do so. In this case, the ABCMR will
conduct a review of the merits of the case to determine if it would be in
the interest of justice to excuse the applicant’s failure to timely file.
3. The applicant’s record shows he was inducted into the Army and entered
active duty on 19 March 1968. He was trained in, awarded and served in
military occupational specialty (MOS) 94B (Cook) and the highest rank he
attained while serving on active duty was private first class (PFC).
4. The applicant’s DA Form 20 confirms he served in the RVN from 31 May
1969 through 10 March 1970. During his RVN tour, he was assigned to
Headquarters and Headquarters Company (HHC), 3rd Battalion, 7th Infantry
Regiment,
199th Infantry Brigade, performing duties in MOS 94B.
5. Item 41 (Awards and Decorations) of the applicant’s DA Form 20 shows
that during his active duty tenure, the applicant earned the following
awards: Army Commendation Medal (ARCOM), Vietnam Service Medal (VSM), RVN
Campaign Medal with 60 Device and Marksman Qualification Badge with Rifle
Bar.
6. The applicant’s Military Personnel Records Jacket (MPRJ) contains a
copy of Headquarters, 199th Infantry Brigade General Orders (GO) Number
2385, dated 14 December 1969. These orders awarded the applicant the ARCOM
for meritorious achievement for the period 16 June 1969 through 15 November
1969. The MPRJ also contains a copy Headquarters, 199th Infantry Brigade
GO Number 540, dated 24 February 1970. These orders awarded the applicant
the ARCOM 1st Oak Leaf Cluster, for meritorious service during the period
June 1969 through March 1970.
7. On 11 March 1970, the applicant was honorably separated after
completing
1 year, 11 months and 23 days of active military service. Item 24
(Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons
Awarded or Authorized) of the DD Form 214 he was issued shows he earned the
ARCOM and National Defense Service Medal during his active duty tenure.
8. Army Regulation 635-5 (Separation Documents) prescribes the separation
documents that are issued to individuals who are retired, discharged or
released from active duty. The regulation also contains guidance on
preparation of the
DD Form 214. The regulation in effect at the time of the applicant’s
release from active duty specified that RVN service would be recorded in
Item 30 (Remarks) by using inclusive dates of service, for example
“Vietnam: 1 Aug 68-31 Jul 69”.
9. Army Regulation 600-8-22 (Military Awards) prescribes Army policy and
criteria concerning individual military awards. Paragraph 2-13 contains
guidance on award of the VSM. It states, in pertinent part, that a bronze
service star is authorized with this award for each RVN campaign a member
is credited with participating in while serving in the RVN.
10. Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit
Register) establishes the eligibility of individual members for campaign
participation credit, assault landing credit, and unit citation badges
awarded during the Vietnam Conflict. It confirms that during his RVN
tenure of assignment, his unit (HHC, 3rd Battalion, 7th Infantry Regiment,
199th Infantry Brigade) earned RVN Gallantry Cross with Palm Unit Citation
and RVN Civil Actions Honor Medal First Class Unit Citation.
11. Army Pamphlet 672-3 further shows that during his RVN tour, the
applicant was credited with participating in the TET 69 Counteroffensive,
Vietnam Summer-Fall 1969 and Vietnam Winter-Spring 1970 campaigns.
DISCUSSION AND CONCLUSIONS:
1. The applicant contention that his RVN service and the awards he earned
based on this service were not properly document in his record and on his
final DD Form 214 was carefully considered and found to have merit.
2. The separation documents regulation in effect at the time of the
applicant’s separation provided for documenting RVN service with an entry
in Item 30. The evidence of record confirms the applicant served in the
RVN from 31 May 1969 through 11 March 1970. Therefore, it would be
appropriate to add the following entry to Item 30 of the applicant’s DD
Form 214: “Vietnam - 31 May 60 -11 Mar 70”.
3. The applicant’s MPRJ contains orders confirming the applicant was
awarded the ARCOM for meritorious achievement and the ARCOM 1st Oak Leaf
Cluster for meritorious service. As a result it would appropriate to add
these awards to his record and separation document at this time.
4. The evidence of record also shows that based on his service and
campaign participation in the RVN, the applicant is entitled to the RVN
Gallantry Cross with Palm Unit Citation, RVN Civil Actions Honor Medal
First Class Unit Citation and
3 bronze service stars with his VSM.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief and to excuse failure to timely file. As a
result, the Board recommends that all Department of the Army records of the
individual concerned be corrected by amending his 11 March 1970 DD Form 214
by deleting the entry in Item 24 and replacing it with the entry “Army
Commendation Medal 1st Oak Leaf Cluster, National Defense Service Medal,
Vietnam Service Medal with 3 bronze service stars, Republic of Vietnam
Campaign Medal with 1960 Device, Republic of Vietnam Gallantry Cross with
Palm Unit Citation, Republic of Vietnam Civil Actions Honor Medal First
Class Unit Citation and Marksman Qualification Badge with Rifle Bar; by
adding the entry
“Vietnam: 31 May 69-10 Mar 70”; and by providing him a corrected
separation document that includes these changes.

The applicant requests, in effect, that the Purple Heart (PH) and Army Commendation Medal 1st Oak Leaf Cluster he earned be added to Item 24 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) of his 7 November 1969 separation document (DD Form 214). It states, in pertinent part, that the PH is awarded to any member who has been wounded or killed in action. As a result, it would be appropriate to award the applicant the first award of the...

The applicant's MPRJ contains no orders, or other documents that indicate he was ever recommended for, or awarded a second award of the ARCOM or that he was ever recommended for or awarded the ARCOM with V Device. Army Regulation 600-8-22 (Military Awards) prescribes Army policy and criteria concerning individual military awards. It confirms that during his tenure of assignment in the RVN, the applicants unit (Co C, 1st Battalion, 5th Infantry Regiment) earned the RVN Gallantry Cross...
ARMY | BCMR | CY2011 | 20110002020
Evidence of record shows the applicant served in Vietnam from 2 February 1968 to 1 February 1970. Although it was not until March 1972 that Change Number 15 to Army Regulation 635-5 authorized an entry on the DD Form 214 to indicate Indochina and Korea service on or after 5 August 1964, there is no harm in adding his Vietnam service during the period 2 February 1968 to 1 February 1970 at this time. As a result, the Board recommends that all Department of the Army records of the individual...
ARMY | BCMR | CY2011 | 20110019345
It shows that during the applicant's tenure of assignment in the RVN, his unit, 3rd Battalion, 39th Infantry Regiment, was cited for award of the RVN Gallantry Cross with Palm Unit Citation for the period 1 July-13 November 1968 by Department of the Army GO (DAGO) 31, dated 1969 and the RVN Civil Actions Honor Medal First Class Unit Citation for the period 19 December 1968-28 June 1969 by DAGO 43, dated 1970. In this case, the evidence of record clearly shows the applicant was assigned to...

Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) lists the awards received by units serving in Vietnam. Although the applicant's record is void of specific evidence of his personal participation in active ground combat with his unit in the RVN, it does confirm he served as an infantryman in MOS 11C with a qualifying infantry unit during his tour of duty in the RVN. As a result, the Board recommends that all Department of the Army records of...

He also provides orders that awarded him the BSM with "V" Device for heroism in action in the RVN on this same date, while serving as a platoon Medic for this same unit. The evidence of record confirms the applicant was awarded the BSM with "V" Device for heroism in connection with the 15 June 1968 action in question, while he was serving as a platoon Medic with Company E, 2nd Battalion, 506th Infantry Regiment. The evidence of record also shows that the applicant received a second award...

The DD Form 214 he was issued lists the following awards: * National Defense Service Medal * Vietnam Service Medal (VSM) * RVN Campaign Medal (RVNCM) * ARCOM with V Device * Combat Medical Badge * BSM 8. Therefore, it would be appropriate and serve the interest of justice and equity to award him the first award of the AGCM for his qualifying period of honorable active duty service from 4 April 1968 through 4 January 1970, and to add this award to his record and DD Form 214. As a result,...

The applicant states, in effect, that the list of authorized awards contained in Item 24 (Decorations, Medals, Badges , Commendation, Citations, and Campaign Ribbons) of his separation document (DD Form 214) does not include the following awards he earned while serving on active duty: PH 1st Oak Leaf Cluster (OLC); ARCOM 1st OLC; and AM (2nd Award). The applicant’s Military Personnel Records Jacket (MPRJ) contains a copy of General Orders (GO) Number (#) 27, dated 2 March 1970, and GO # 49,...
